Dear Mr. Poteat:
The Pretreatment Unit of the Division of Water Quality has reviewed the Enforcement Response Plan (ERP)
for the Town of Pittsboro. This ERP was received by the Division on January 5, 1998.
The review indicates that, with the corrections below, the ERP will be adequate will meet the requirements
of 40 CFR 403.8 (f)(5). Proper implementation of an Enforcement Response Plan is also required by Part III
(B), of your NPDES permit. Please refer to the Comprehensive Guidance for North Carolina Pretreatment
Programs (Comprehensive Guide) for additional information and examples.
Please forward a corrected ERP to the Pretreatment Unit by August 31, 1998, addressing the following
concerns:
POTW Actions: Comprehensive Guide, Chapter 8, Sec. B, p2 & Appendix 8-A, pl
The ERP was simply a copy of the Division's Model ERP. While generally this is acceptable, the note
at the top of each page of the NC Model Enforcement Chart was intended as instructions to the POTW
in how to use the POTW Actions and Timeframe columns of the Model ERP Chart and were not
intended to become part of the final ERP itself as inclusion of them makes the POTW's intended
actions unclear. Please make appropriate changes to the ERP as indicated on the attached marked up
pages.
Response to this letter is required by August 31, 1998. You are also reminded on the August 1, 1998, due
date for submittal of a draft Industrial User Pretreatment Permit (IUP) for Hydro Tube South, as well as other
due dates listed in the Division's June 17, 1998, letter regarding pretreatment program development.
