JT?- Fr Subject: Martin Marietta Materials, Inc. - Rocky Point Quarry NPDES Permit No. NCG020166 Monitoring Information and Wetlands Standards, Pender County In Reply to Your Letter of March 5, 2002 Dear Mr. Shiver: Pursuant to the above letter and our subsequent meeting (April 16, 2002) regarding the Rocky Point Quarry, we have prepared a "Monitoring and Operations Plan" that addresses the issues of concern to the North Carolina Department of Environment and Natural Resources (NCDENR) - Division of Water Quality (DWQ) with respect to NPDES Permit NCG020166. We ask that you carefully read over the documentation and figures enclosed as we have attempted to address all of your concerns. Where possible, we have provided specific responses to issues you raised in your March 5 correspondence as clarified in our April 16 meeting. Where some of the issues of concern to the DWQ are dependent on actions yet to be implemented, such as the results of the ground water monitoring, we have provided a discussion of what data gathering efforts will be conducted (type, location, duration), and then the process to prepare an appropriate response (i.e., pumping plan), based on the data gathered, to your specific issues. As discussed during our meeting, DWQ will rely on the US Army Corps of Engineers (COE) to determine the extent of wetlands on and adjacent to the quarry site and that the location and extent of wetlands will affect the monitoring plan. Subsequently, a field visit with the Kimley-Horn and Associates, Inc staff and the COE (Mickey Sugg) was performed on April 30`' to determine the presence and, if possible, the extent of jurisdictional wetland areas adjacent to the quarry. In summary, Mr. Sugg could not provide an official Jurisdictional Determination on the exact limits of wetlands on the adjacent properties but he did provide an evaluation of the potential areas of special concern (areas that have hydric soils and could potentially be wetlands) and guidance/suggestions on what additional information COE would need to make a formal determination. These areas have been approximated on the figure included with the attached. Mr. Sugg did identify areas to the east of the quarry (although not a jurisdictional boundary) as meeting wetland criteria based on hydric soils and vegetation. The shallow water table monitoring locations proposed in the monitoring plan are located in these specific areas that were discussed during the field evaluation. The intent at each location is to monitor surficial hydrology in these geomorphic features (i.e. wet flat or drainage swale). Mr. Rick Shiver Page 2 May 9, 2002 The extent of wetlands on the adjacent property to the south of the quarry is undetermined at this time and will require additional information to be provided to Mr. Sugg in order to determine the extent or existence of wetlands. In summary, areas of hydric soils were found on these tracts without evidence of the presence of hydrology indicative of wetlands. The hydrology (drainage) on these parcels has been managed through silviculture activities (ditches, bedding, etc.) and has effectively drained portions of these parcels. The extent of the influence of the drainage on these hydric soils still needs to be determined through additional data collection. However, the COE indicated that significant areas if not all of these hydric soils may have been affected by the silviculture activities. For this reason (i.e. unidentified locations/limits of potential wetlands), monitoring to the south of the quarry is not proposed at this time. As discussed during our recent meeting, DWQ is expecting to have results from the monitoring plan we implement and a recommendation for a pumping plan by July 16 (90 days from our meeting). To that end, we are anxious to implement the monitoring plan as soon as possible. Your timely review of the attached would be greatly appreciated. Please let us know if there is anything we can do to help facilitate/expedite that review. We would be available/amenable to a meeting if necessary. We are currently in negotiations with well contractors so that we can install the wells as soon as we obtain your approval/concurrence on the monitoring plan.
