Austin Creek, it's floodplain and adjacent wetlands exist at the crossing location. Additionally, feature B was determined to be a jurisdictional stream, stops within the wetland and does not connect to feature J as shown on the exhibits and Jurisdictional Determination (JD). Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The proposed project includes one impact area proposing impacts to stream, wetland and riparian buffers. Impact Area #1 is a proposed road crossing over a perennial stream and wetlands. This proposed impact area includes 0.29 acres of permanent wetland impact, 77 linear feet of permanent stream impact for the 8'x 8' box culvert and headwalls, 64 linear feet of permanent, no permanent loss stream impact for the energy dissipater, 12 linear feet of temporary stream impact for construction activities and associated riparian buffer impacts. Note that there are riparian buffer impacts associated with stream J and stream B, however stream B per the USA CE and the JD isnot jurisdictional all the -way to the confluence of feature J. The extension location is set because Main Divide Drive was constructed and dedicated more than 15 -years ago and stubbed to this location. Homes have been constructed on both sides of Main Divide Drive which prevents realignment of Austin Ridge Parkway. The stream, wetland and riparian buffer impacts have been minimized to the maximum extent practicable. The typical Town of Wake Forest collector roadway section was altered to minimize the proposed crossing impact. The ROW was required to remain the same by the Town, but the back-to-back section was reduced from 39 -ft to 35 -ft through the crossing length. Additionally, the sidewalk was shifted away from the outer ROW edge to along the back of curb to minimize the culvert length and headwall height. Both bottomless culverts and bridge options were evaluated to meet the avoidance requirement. Based on site conditions with a high tension overhead power lines, elevation of the existing Main Divide Drive and the Town design criteria, the other options were eliminated. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 14. With respect to linear transportation crossings conditions (NWP 14 -Regional Conditions section 4.0) stream relocations will incorporate natural channel design; this project is not being used in conjunction with a NWP 18 to create an upland area; this project is not located within tidal waters/wetlands; and this project is not located within a designated trout watershed. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Per the project engineer. Two temporary riser basins converting to permanent wet ponds, diversion ditches, silt fence, and permanent level spreaders with filter strips are measures provided to treat the discharges from the disturbed areas during construction and permanently treating impervious areas. Access to sensitive buffers and streams will be restricted by tree protection limits of construction fencing. One road stream crossing is proposed. A temporary diversion ditch will channel flow around culvert installation until permanent route is established. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Austin Ridge Parkway Extension project is a collector street within a residential development and the town will own the future Right -of -Way. The project is located within the Town of Wake Forest, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited activities within the riparian buffer areas, in addition to "diffuse flow" requirements, and could require Best Management Practices that treat nitrogen if diffuse flow cannot be achieved; 2) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed, 4. Sewage Disposal (DWQ Requirement) 4a.
