STORMWATER PERMITTING
As you know, we represent the Porters Neck Homeowner's Association, Inc. ("PNHOA")
and Porters Neck Country Club, Inc. ("PNCC"). PNHOA and PNCC each have official
governing boards charged with managing matters for their respective memberships in the
Porters Neck community. Eric Blaesing is the current President of PNHOA, and Don
Pastor is the current President of PNCC. Each entity and its related Board members are
concerned with the issues related to stormwater permitting and management within the
overall community.
The regulatory enforcement process recently initiated by the North Carolina Department
of Environmental Quality Division of Energy, Mineral and Land Resources ("DEMLR")
through the issuance of Notice of Violation NOV-2018-PC-0094 to Porters Neck Company,
Inc., for deficiencies related to State Stormwater Permit No. SW8 910401 ("Master

Permit") has raised that awareness and concern to a new level. Enforcement of the
Master Permit necessarily involves review and consideration of the other twenty -plus
State Stormwater Permits issued for various parts of the Porters Neck community, and
ultimately will result in the transfer of Stormwater Permits to PNCC, PNHOA, or some
combination thereof.
As the lengthy enforcement, compliance and transfer process continues, we want to make
clear who is authorized to speak for, and on behalf of, PNHOA and PNCC. At this time,
Mr. Blaesing is authorized to speak for PNHOA and Mr. Pastor is authorized to speak for
PNCC. We recognize that homeowners in the Porters Neck community may contact you
directly with their concerns, particularly about the neighborhoods in which they live.
However, no one other than Mr. Blaesing, Mr. Pastor and counsel for either entity, may
represent, or speak on their behalf.
