Our review indicates that the PAR is adequate and satisfies the requirements of 15A NCAC 2H .908(b) and the Comprehensive Guidance for North Carolina Pretreatment Programs. However, during the initial PAR review it was noted that the Permittee did not correctly identify an occurrence of Significant Noncompliance. Specifically, a Significant Industrial User was found to be in Significant Noncompliance for Technical Review Criteria as defined in 15A NCAC 02H .0903(34)(D); however, the Permittee did not take action as specified in their Enforcement Response Plan. Please note that Part IV, Section D.9 of the Permit requires that enforcement actions "be consistent with the Enforcement Response Plan(ERP)approved by the Division."This discrepancy has resulted in this Notice of Deficiency. Corrective actions were taken as noted in the revised PAR dated June 4, 2018.
