This form was forwarded to me by Ms. Amy Annino out of the Swannanoa Office (828 296 4656, amy.anninooncdenngov). The form header shows INTERNAL DRAFT -NOT FOR PUBLIC USE and other peculiarities that confuse us, but we hope it, and our other attachments, provides all the information you and the department require to perform the necessary analysis. Our site has been issued a Letter of Violation as I indicated on the form under form Section F -2a. I have attached that letter to this package because the instructions listed that as a requirement. We have responded, about 3 weeks ago, to that letter with our Restoration Plan. I did not include that plan in this package, but Ms. Annino should be able to supply copies if a review is necessary. I should note that the Restoration Plan includes a graphic depiction of the lot with contours, house layout, septic field, buffer location, proposed Access Path layout and shoreline. That might be of use in your analysis. I should also note that we are working on completing the form requesting Shoreline Stabilization (Rip Rap Revetment planned) along part of our shoreline that will follow. Because of the lack of availability of stabilization via barge on Lake Rhodhiss, we will be asking to perform this action from the land side which will require incursion into the buffer zone. Before and during Access Path installation reinforced silt fencing to be erected at the 50 -foot marker along the affected shoreline area. 2. A z 4 -inch layer of shredded tree mulch is spread over all bare ground in Zone 1 & 2 of the affected slope. Care to be taken not to disturb existing trees and undergrowth. 3. A thick layer of landscaping mulch is spread in areas to be planted up slope from Access Path on the West side of the house to absorb, slow and diffuse any flow of water as it approaches the Catawba Buffer area 4. A shallow (3-4" deep) trough will be leveled along the defined area for the Access Path. The Access Path will be comprised of 3 inches of Gravel (#1 & 2 sizes) used as a base and laid over Engineered Bio Filtering material fitted into the trough. #57 gravel will be laid over the top of the base. Although care will be taken to reduce or eliminate concentrated flow on the grounds approaching the 50 -foot buffer, this material will create an even more effective device for diffusion of all water that enters it. This allows for those waters to be absorbed into soils below it and it will also slow the velocity of any water as well, removing the threat of flow concentration into Lake Rhodhiss. Established points of concentrated flow on the lot have been lined with Rip -Rap (Class B and higher in some cases). These established points were determined by our civil engineer and his Drainage and Excavation plan was approved by Burke County and state authorities (Mr. Alan McKinney) as part of our septic approval. There are two major established flows that empty into naturally occurring gullies. Both are now remediated to slow and diffuse concentrated water flow and capture sediment that might otherwise enter Lake Rhodhiss. No trees will be removed to install this Access Path The Path will be constructed of small crushed stone and gravel. No Impervious or Impermeable materials will be used in the construction of this path The width of the Access Path is planned to be 6 -foot within the 50 -foot buffer zone DETERMINATION OF "NO PRACTICAL ALTERNATIVES This section is pursuant to 15A NCAC 02B.0243, Section 8. (i) The basic project purpose cannot be practically accomplished in a manner that would better minimize disturbance, preserve aquatic life and habitat, and protect water quality. "o //W11_ Access to our existing, properly permitted and approved dock is the reason for the request to install an Access Path in the buffer. As noted in the main body to this addendum, steps have been and will continue to be taken to support habitat, diffuse flow and filtering of waters finding their way from our property into the lake waters. For safety and some convenience an Access path to the existing dock is a necessity that cannot, safely, be avoided. The use cannot practically be reduced in size or density, reconfigured or redesigned to better minimize disturbance, preserve aquatic life and habitat, and protect water quality. • As noted above the disturbance will be minimized already using permeable materials as a base material. In fact, the Access Path and the materials used will only aid in diffusing and filtering runoff waters flowing into lake Rhodhiss. As to the size: we have carts with axels over 5 -feet (outside edge of tires) that would not be accommodated by a 4 -foot Access Path. It would not be practical to build a path that would not allow senior citizens to use carts to gain access to and carry supplies to the existing dock. Best management practices shall be used if necessary to minimize disturbance, preserve aquatic life and habitat, and protect water quality. • Our landscape designer/landscaper will use minimal equipment to provision the site with necessary materials for the build. Inside the 50 -foot buffer hand tools will be used to perform the actual laying out and depositing of substrate along the route of the path. Small (bobcat type) equipment will be used, they will operate only within the confines of the Access Path and will not venture into the buffer. Since our planned Access Path skirts the 50 -foot line for a major portion of its run this means that any small equipment usage will not operate on the lake side of the proposed Access Path. You were present for this site visit. The site visit was in response to a complaint alleging unauthorized clearing within the riparian buffer on the Catawba River (Lake Rhodhiss). DWR staff observed and noted impacts to the riparian buffer on the Catawba River (Lake Rhodhiss) which is subject to the Catawba River Buffer Rules. Impacts to the buffer include clearing of vegetation within the Catawba Buffer with insufficient sediment and erosion control measures and a failure to maintain diffuse flow within the Catawba Buffer. These unauthorized activities are in violation of the Catawba Buffer Rule. As a result of the site inspection and file review, the following violations were identified: VIOLATIONS I. Catawba Buffer Violation 15A NCAC 02B.0243 (4) and (5)— Unauthorized grading, vegetation clearing, and failure to maintain diffuse flow within the Catawba buffer are violations of the Catawba Buffer Rules which states that: Zones 1 and 2 of the riparian buffer remain in vegetation that is undisturbed except for those uses provided for in Item State of North Carolina I Environmental Quality 2090 U.S. Highway 701 S«annanoa, North Carolina 28778 828-296.4500 2089 Starboard Ln - Palmer NOV-2018-PC-0150 Page 2 of 3 (6) of this rule; Diffuse flow of runoff shall be maintained in the riparian buffer by dispersing concentrated flow and reestablishing vegetation. To resolve the violations related to the buffer impact: 1. You must take immediate action to stabilize all disturbed areas within the Catawba River Buffer. Sediment and erosion control measures must be established to prevent sediment from entering Lake Rhodhiss. In addition, measures must also be established to prevent any concentrated flow from entering the Catawba Buffer. 2. Please explain why the unauthorized vegetation clearing activity occurred prior to written approval. 3. Restore the buffer to pre-existing conditions which includes the restoration of the riparian buffer. Ensure that diffuse flow will be established and maintained within the Catawba buffer. a. Riparian Zone planting - Please submit a Restoration Plan to this office for review and approval. This plan must be developed to ensure that disturbed vegetation be replanted in an "in kind" manner. (Example: Disturbed areas with pre-existing grassed lawns must be replanted with grass. Disturbed areas with pre-existing trees or woody vegetation must be replanted with trees and woody vegetation. Disturbed areas with pre- existing forest vegetation must be replanted with forest vegetation including at least two different native hardwood tree species at a density sufficient to provide 320 trees per acre at maturity.) Restoration of trees/shrubs/forest must be completed by the first subsequent planting season (November 1 through March 30). Note, if the tree plantings do not survive, they will need to be replaced such that the density is sufficient to provide 320 trees per acre at maturity. This plan must include the types of native woody vegetation selected, methodology of planting, and a site map indicating the location of the replanting efforts. Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Resources regarding these issues and any future/continued violations that may be encountered. Your above- mentioned response to this correspondence will be considered in this process. This office requires that the violations, as detailed above, be abated immediately.
