Dear Mr. Gaster:
The Division has reviewed your application for the subject permit. To enable us to complete our review
in accordance with N.C.G.S. 143-215.1 and 15A NCAC 2H.0105,please provide additional or revised
information to address the following comments:
To continue processing the permit renewal for the Black River WWTP, four(4)2nd species
toxicity tests are required.This requirement is stated on the EPA application form 2A Part E
which we received from you with your renewal request, and is also stated in Federal Regulations
40 CFR 122.21(j)(5). To make it more clear in the future we will be including a 2'Species
Toxicity Testing Requirement in permit renewals. Since this is an EPA requirement,EPA will not
approve your permit renewal without the tests. Perform these 2nd species tests at a frequency of
monthly until complete.For any questions regarding 2nd species toxicity testing,please contact
the Aquatic Toxicity Branch at 919-743-8401.
If no response is received within 60 calendar days [per 15A NCAC 2H.0107(b)],the project will be
deactivated and withdrawn from our review process and the documents recycled. If you have any
