Thank you for your PCN and attached information, dated 5/23/2018 (received 5/24/2018), for the above referenced
project. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide
Permit (NWP) 29 (http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information
below (via e-mail is fine):
1) The Chapel Ridge subdivision (Action ID: SAW -2005-21110) required a Corps authorization under NWP 39,
verified for use on 4/11/2006, for permanent impacts to 298 linear feet of stream and 0.499 acre of wetlands
necessary for two road crossings (see attached). Based on the information you provided, and per NWP 29
General Conditions 15 and 28, the Corps considers the proposed Byers Ridge development as part of the same
single and complete project as the Chapel Ridge subdivision (i.e. has no independent utility, relies on the
extension of a road [Chapel Ridge Dr.] that required Corps permits, same developer, etc.); as such the Corps
views the proposed wetland impacts as cumulative with those permitted for the Chapel Ridge subdivision. Since
the combined previously permitted and currently proposed wetland impacts exceed the 0.5 acre threshold
allowable for verification under NWP 29, we cannot verify the use of NWP 29 for the project as proposed.
Accordingly, you may:
a. Resubmit the PCN and plans for NWP 29 verification with the following changes:
i. Redesign the project to avoid impacts to wetlands/streams or reduce these impacts to fall below
the cumulative 0.5 acre/300 linear foot wetland/stream impact threshold, or;
ii. Redesign the development as a single and complete project, such that it has independent utility
(i.e. does not rely on access or infrastructure or share amenities with projects that required
previous Corps authorization, etc.
b. Pursue authorization through an Individual permit. If it is your intention to pursue an Individual Permit
(i.e. Standard Permit), the enclosed Individual Permit application (see also the attached instructions)
must be filled out completely and submitted to our office for processing;
2) Other items requiring additional information include the following:
a. Per NWP 29 General Condition 23(a & b), as well as the Clean Water Act section 404(b)(1) guidelines,
please provide additional information on how the project was designed and constructed to avoid and
minimize adverse effects to waters of the United States to the maximum extent practicable. The
proposed road as designed aligns with the largest extent of wetlands on site. Please redesign the project
to further avoid and minimize impacts to the wetland system, through changing the alignment. If this is
not practicable, please explain fully and in detail with respect to cost, logistics, and available technology.
b. Please specifically state how water would continue to flow to the proposed remaining wetland/stream
area. The Corps is concerned that the hydrology source for this wetland/stream would be removed from
the proposed project, thus indirectly removing aquatic functions from these resources;
c. Please provide the delineation information (i.e. delineation map, wetland/upland data forms, etc.) for
the portion of the project area that was not included in the Jurisdictional Determination dated
1/25/2017. If wetlands or other jurisdictional areas were identified during this delineation, show those
areas on the project plans. Note that the Corps may require an on-site meeting to verify the delineation
in this area.
Please provide the above information within 30 days of receipt of this Notification otherwise we may deny verification
of the use of the Nationwide Permit or consider your application withdrawn and close the file. If you choose to pursue
the project via an Individual Permit application (item 1b above), please notify us as soon as possible.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWTs are scheduled to be modified,
reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the.NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the
date that the relevant nationwide'permit is modified or revoked, you will have twelve (12) months from the date of the modification or
revocation of the NWT to complete the activity under the present terms and conditions of this nationwide permit. If; prior to the
expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid
until the expiration date identified below, provided it complies with all new and/or modified terms and conditions. The District

Additional Remarks and/or Special Permit Conditions:
1. The Permittee shall cause to be recorded in the Register of Deeds for Guilford County restrictive covenants for
the purpose of maintaining proposed conservation areas in their natural state in perpetuity. The permittee shall
also cause to be recorded a plat, showing the subdivision plan for the property, the boundary of the conservation
areas, and the boundary of jurisdictional waters of the United States. The restrictive covenants and plat, as

approved by the Corps En ineers. and attached as Exhibit A, shall be recorded prior to the sale or conveyance of
any lots, plisses; or other property within the subdivision. The permittee shall enforce the terms of the restrictions ,

set forth in the deed, and, prior to cox, Yeyance of the property, shall take no act.-., on the property described in the
deed inconsistent with the terms thereof.
2. In order to compensate for impacts to 298 linear feet of stream channel and 0.499 acre of wetlands the permittee
shall make payment to the North Carolina Ecosystem Enhancement Program (NCEEP) in the amount determined
by the NCEEP, sufficient to perform the -restoration of 298 linear feet of warm water stream channel and 0.499
acre of riparian forested wetlands in the Cape Fear River Basin, Cataloging Unit 03030002. Construction within
jurisdictional areas on the property shall begin only after the permittee has made full payment to the NC EEP and
provided a copy of the payment documentation to the Corps, and the NCEEP has provided written confirmation to
the Corps that it agrees to accept responsibility for the mitigation work required, in compliance with the MOU
between the North Carolina Department of Environment and Natural Resources and the United States Army
Corps of Engineers, Wilmington District, dated November 4,1998.

"The areas shown on the recorded plat (identify the plat by title, date, and
recording data) as conservation areas shall be maintained in perpetuity in their
natural or mitigated condition. No person or entity shall perform any of the
following activities on such conservation area:
a. fill, grade, excavate or perform any other land disturbing activities
b. cut, mow, burn, remove, or harm any vegetation
c. construct or place any roads, trails, walkways, buildings, mobile homes,
signs, utility poles or towers, or any other permanent or temporary
structures
d. drain or otherwise disrupt or alter the hydrology or drainage ways of the
conservation area
e. dump or store soil, trash, or other waste
f. graze or water animals, or use for any agricultural or horticultural
purpose
This covenant is intended to ensure continued compliance with the mitigation
condition of a Clean Water Act authorization issued by the United States of
America, U.S. Army Corps of Engineers, Wilmington District, Action ID , and
therefore may be enforced by the United States of America. This covenant is to
run with the land, and shall be binding on the Owner, and all parties claiming
under it."
If the restrictive covenants have a provision that the property owners (either all of
them or some percentage of them) can amend or modify the restrictive covenants, a
provision shall provide that our required paragraph (usually identified by
paragraph number) cannot be amended without the express written consent of the
U. S. Army Corps of Engineers, Wilmington District.

and responsible officer and title. If more than one party is associated with the application, please attach a sheet with
the necessary information marked Block 5.
Block 6. Address of Applicant. Please provide the full address of the party or parties responsible for the application
If more space is needed, attach an extra sheet of paper marked Block 6.
Block 7. Applicant Telephone Number(s). Please provide the number where you can usually be reached during
normal business hours.
Blocks 8 through 11. To be completed, if you choose to have an agent

directly impacted by the activity. If it is a minor (no name) stream, identify the waterbody the minor stream enters.
Block 14. Proposed Project Street Address. If the proposed project is located at a site having a street address (not
a box number), please enter it here.
Block 15. Location of Proposed Project. Enter the latitude and longitude of where the proposed project is located.
If more space is required, please attach a sheet with the necessary information marked Block 15.
Block 16. Other Location Descriptions. If available, provide the Tax Parcel Identification number of the site,
Section, Township, and Range of the site (if known), and / or local Municipality that the site is located in.
Block 17. Directions to the Site. Provide directions to the site from a known location or landmark. Include highway
and street numbers as well as names. Also provide distances from known locations and any other information that
would assist in locating the site. You may also provide description of the proposed project location, such as lot
numbers, tract numbers, or you may choose to locate the proposed project site from a known point (such as the right
descending bank of Smith Creek, one mile downstream from the Highway 14 bridge). If a large river or stream,
include the river mile of the proposed project site if known
Block 18. Nature of Activity. Describe the overall activity or project. Give appropriate dimensions of structures such
as wing walls, dikes (identify the materials to be used in construction, as well as the methods by which the work is to
be done), or excavations (length, width, and height). Indicate whether discharge of dredged or fill material is involved
Also, identify any structure to be constructed on a fill, piles, or float -supported platforms.
The written descriptions and illustrations are an important part of the application. Please describe, in detail, what you
wish to do. If more space is needed, attach an extra sheet of paper marked Block 18.
Block 19. Proposed Project Purpose. Describe the purpose and need for the proposed project. What will it be used
for and why? Also include a brief description of any related activities to be developed as the result of the proposed
project. Give the approximate dates you plan to both begin and complete all work.
Block 20. Reasons for Discharge. If the activity involves the discharge of dredged and/or fill material into a wetland
or other waterbody, including the temporary placement of material, explain the specific purpose of the placement of
the material (such as erosion control).
Block 21. Types of Material Being Discharged and the Amount of Each Type in Cubic Yards. Describe the
material to be discharged and amount of each material to be discharged within Corps jurisdiction. Please be sure this
description will agree with your illustrations. Discharge material includes: rock, sand, clay, concrete, etc.
Block 22. Surface Areas of Wetlands or Other Waters Filled. Describe the area to be filled at each location.
Specifically identify the surface areas, or part thereof, to be filled. Also include the means by which the discharge is to
be done (backhoe, dragline, etc.). If dredged material is to be discharged on an upland site, identify the site and the
steps to be taken (if necessary) to prevent runoff from the dredged material back into a waterbody. If more space is
needed, attach an extra sheet of paper marked Block 22.
Block 23. Description of Avoidance, Minimization, and Compensation. Provide a brief explanation describing
how impacts to waters of the United States are being avoided and minimized on the project site. Also provide a brief
description of how impacts to waters of the United States will be compensated for, or a brief statement explaining why
compensatory mitigation should not be required for those impacts.
Block 24. Is Any Portion of the Work Already Complete? Provide any background on any part of the proposed
project already completed. Describe the area already developed, structures completed, any dredged or fill material
already discharged, the type of material, volume in cubic yards, acres filled, if a wetland or other waterbody (in acres
or square feet). If the work was done under an existing Corps permit, identity the authorization, if possible.
Block 25. Names and Addresses of Adjoining Property Owners, Lessees, etc., Whose Property Adjoins the
Project Site. List complete names and full mailing addresses of the adjacent property owners (public and private)
lessees, etc., whose property adjoins the waterbody or aquatic site where the work is being proposed so that they
may be notified of the proposed activity (usually by public notice). If more space is needed, attach an extra sheet of
paper marked Block 24.
Information regarding adjacent landowners is usually available through the office of the tax assessor in the
county or counties where the project is to be developed.
Block 26. Information about Approvals or Denials by Other Agencies. You may need the approval of other
federal, state, or local agencies for your project. Identify any applications you have submitted and the status, if any
(approved or denied) of each application. You need not have obtained all other permits before applying for a Corps
permit.
Block 27. Signature of Applicant or Agent. The application must be signed by the owner or other authorized party
(agent). This signature shall be an affirmation that the party applying for the permit possesses the requisite property
rights to undertake the activity applied for (including compliance with special conditions, mitigation, etc.).
DRAWINGS AND ILLUSTRATIONS
General Information.
Three types of illustrations are needed to properly depict the work to be undertaken. These illustrations or drawings
are identified as a Vicinity Map, a Plan View or a Typical Cross -Section Map. Identify each illustration with a figure or
attachment number.
Please submit one original, or good quality copy, of all drawings on 8'/z x11 inch plain white paper (electronic media
may be substituted). Use the fewest number of sheets necessary for your drawings or illustrations.
Each illustration should identify the project, the applicant, and the type of illustration (vicinity map, plan view, or cross-
section). While illustrations need not be professional (many small, private project illustrations are prepared
by hand), they should be clear, accurate, and contain all necessary information.
