REGAN Secretnry LINDA CULPEPPER buerinr Dheuor The Division of Water Resources (DWR) has determined that the City of Lenoir's Pretreatment Program has failed to meet the minimum requirements as specified in 15A NCAC 2H .0900 and 40 CFR 403.8 (f). Specifically, the City of Lenoir has failed to conduct inspections at the significant industrial users (SIUs). According to Division records, there are three SIUs covered by the City of Lenoir pretreatment program. The City is required to sample and inspect each SIU at least annually. The permit renewals were received January 30, 2018. A request for copies of the most recent inspections was made and the Division was informed that the inspections had not been completed. A pretreatment compliance inspection was conducted by the Division on July 31, 2017. At that time, it was discovered that the last documentation of SIU inspections had been in 2014. Due to the circumstances of the previous pretreatment coordinator's' departure no action was taken by the Division at that time. A follow-up technical assistance visit was made on September 22, 2017. The SIU inspection requirements were discussed at both meetings. To prevent further enforcement action, perform the following actions by the indicated due date. 1. Respond in writing by June 29, 2018 addressing the causes of noncompliance and all actions that will be taken to prevent the recurrence of similar situations. 2. Inspect all SIUs and submit copies of the inspection reports no later than July 24, 2018.
