This site is located immediately east of the Rod Sullivan Road, Ammons Farm Road intersection and south of Moncure, in Lee County, North Carolina. The Pre-construction Notification (PCN) was received on May 25, 2018. The project is identified by the following Corps of Engineers Action ID: SAW-2009-01114 1. Section A.1a of the PCN submitted for this project indicates that you are requesting a verification under Nationwide Permit (NWP) #23 for Categorical Exclusions. Under the 2017 Nationwide Permit #23, the only agencies with approved categorical exclusions are: the Bureau of Reclamation, Federal Highways Administration, and the U.S. Coast Guard. Based on our telephone conversation on May 31, 2018, you indicated that this was an NCDOT project, but that the Federal Highways Administration is not funding the project nor did they provide the categorical exclusion. As such, this project is not eligible for Nationwide Permit #23. 2. Permanent wetland impacts associated with this project are 0.62 acre and 138 linear feet of stream (0.006 acre). Any other NWPs for which this project may qualify, (such as NWP #39 for Commercial and Institutional Developments), do not authorize discharges that cause the loss of greater than 0.5 acre of non-tidal waters of the United States. As such, the project should be redesigned to further avoid stream/wetland impacts (under 0.5 acre) or you must submit an application for an Individual Permit. If you do decide to submit an application for an individual permit, please contact me prior to submittal. Prior to the submittal of an Individual Permit application, a pre- application meeting is highly encourage in order to discuss additional requirements such as the purpose and need statement, alternatives analysis, etc. If you have any questions or concerns, please contact me.
