Dear Mr. Ayoub:
On May 15, 2018, Mitch Hayes of the Division of Water Resources, conducted a compliance
evaluation inspection at the subject waste treatment system. Dried black solids and grease were
observed at the end of the discharge pipe.
This waste discharges into an unnamed tributary to Chunky Pipe Creek, a WS -IV, Nutrient
Sensitive Waters (NSW) in the Neuse River Basin.
Dried black solids and grease at the end of the discharge pipe is consistent with a failing /
improperly functioning waste treatment system. This is a violation of the following permit condition:
"Operations & Maintenance": Part 1, Condition
"2) Treatment systems shall be maintained at all times to prevent seepage of sewage to the
surface of the ground."
"6) A visual review of the outfall shall be executed twice a year (one at the time of sampling) to
ensure that no visible solids or other obvious evidence of system malfunctioning is observed. Any
visible signs of a malfunctioning system shall be documented and steps taken_ to correct the
problem. "
Requested Response
The Division requests that the Permittee secure a contractor / engineer to inspect your existing
system and determine if repairs are needed and/or components need replacing to ensure that the
system functions as intended and meets the conditions of your permit, including meeting the
effluent monitoring limits contained in the permit. Please do this within 60 days and submit a
written response to this office detailing how you will ensure in a timely manner that the system is
in full compliance of the permit conditions and functions as intended.

If the engineer determines that any part of the system needs to be repaired or replaced, the
Permittee should inform this office. The components that are required when replacing a system
are included in Section A of Part I of the general permit and in Attachment C of this letter. Before
construction begins, an Authorization to Construct (ATC) must be secured from the Division of
Water Resources. To apply for an ATC, you are required to submit the following:
a. A completed and signed Notice of Intent (NOI) application (attached) delivered to the
address shown at the bottom of the NOI.
b. A letter of request for an ATC to Charles Weaver, NPDES Permitting Unit, Division of
Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617.
Plans and specifications of the proposed sand filter system in triplicate. Plans and specifications
must be drawn and submitted by a licensed North Carolina professional engineer.
If you believe that the system is functioning properly, please provide recent effluent
monitoring results that demonstrate that the system is in compliance. This may be
accomplished by contacting a certified lab (see attached list) to perform this analysis and submit
the results to this office within 45 days of receipt of this letter. The parameter monitoring limits can
be found in Section A of Part I of the general permit and in Attachment C of this letter.
This office requires that the violation, as described above, be properly resolved in a timely manner.
These violations and any future violations are subject to a civil penalty assessment of up to
$25,000.00 per day for each violation. Should you have any questions regarding these matters,

for all major treatment components must be signed and sealed by a North Carolina registered
Professional Engineer and shall include a narrative description of the treatment system to be
constructed; per 15A NCAC 02H .0139.

A. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
Applicability of Coverage
This permit authorizes discharges (.pursuant to the conditions described in this permit) to all waters
of the state unless otherwise excluded in this section. Discharges to the following waters are
excluded from permit coverage and will require an individual permit to discharge:
Waters classified as WSI (Water Supplyl)
Waters classified as HQW (High Quality Waters, excluding WS 11)
Waters classified as SA
Waters classified as ORW (Outstanding Resource Waters)
Waters located in the Randleman Lake Watershed
Applicable to Treatment Systems:
1) Single Pass Filter Systems discharging less than 1.000 gallons per day (applicable to existing
facilities Only)
2) Multi -Phase Filter Systems (Primacy & Secondary Single Pass, *Recirculating Sand Filters as well
as other alternative technologies that provide treatment equivalent to, or greater than,
-recirculating sand filters) discharging less than 1000 gallons per day
