The project involves constructing a pond and connecting it to an existing long dead end canal. Connecting a pond directly to a long canal can result in poor flushing and low dissolved oxygen concentrations. Such conditions may result in a violation of State Water Quality Standards for dissolved oxygen and will increase the potential for fish kills. As proposed, the project may be denied. However, you may submit a modified proposal for review. The modified proposal would utilize a spillway and would not provide channel access from the pond to the state surface waters. We feel the wildlife pond could be constructed with an appropriate spillway and still serve your primary goals. Taylor Koonce Beaufort County The following determination has been made regarding the subject project: ? A 401 Water Quality Certification will be required. A 401 Water Quality Certification will not be required. '@ See additional comments below. The proposed project is located near the terminus of SR 1317 in Beaufort County. The property consistsof about five acres and is bordered on the west by a f 20' canal which connects to the Pamlico River. This canal is approximately 2000 feet long and averages 2-3 feet deep NWL. A small wet- land area which lies within the five-acre tract, connects to this canal. The property is bordered on the east by SR 1317 and on the south by another canal. The applicant proposes to do the following: (1) excavate a t 200' long by t 4' V-ditch to obtain borrow material and facilitate drainage (no connection to canals) (2) excavate a f 150' by ± 50' by -4' deep NWL wildlife pond and connect pond to 2000' long canal by a f 5' wide channel The overall purpose of the project is to obtain borrow material for regrading the property which was disturbed by logging equipment and to construct a private wildlife pond. Forrest Westall 8-7-84 Page 2 We have reviewed similiar projects where the applicant proposed to connect a basin or pond to an existing long dead-end canal. Each time we have cited the adverse impacts associated with this type of construction activity. In this case, our primary concerns are the poor flushing and low dissolved oxygen concentrations usually found in long dead-end canals. These conditions most assuredly will increase the potential for fish kills. We would not oppose the construction of a wildlife pond on high ground provided there is no connection to State surface waters by an access channel. We feel the wildlife pond could be constructed with an appropriate spillway and still serve the primary goals of the applicant. It is recommended that this Division object to the project as proposed. Plantation, (circa 1730's) . My grandfather (W.W. McIllhenny) purchased slightly under 100 acres fro_, the Alison heirs (Snlaws) in 1902. He built a barn and started agricultural operations. In the 1970's the property was divided between the children of Z.T. and Elizabeth Koonce. These children were Anita Koonce Tyndall, Elizabeth Koonce Bar,•aick and me,.Z.T. Koonce. The area immediately surrounding the proposed pond has been cleared and cultivated -- on at least two occasions in recent times. As a boy, I remember evidence of field rows in the trees. In the late 1940's the area was pushed clear by bulldozer. It was planted in commercial flowers. Hurricane Hazel destroyed the crop and, young pines were set out on the rows. In times long past there was evidence of a "tram road" across one edge o the field. This was part of some earlv Naval Store (tar, ,Ditch, and tur,,.entine, harvest. Tilers' were also "tai" kil'-s" on the north side of road 1300. These have been leveled. No signs cf Indian pottery or arrorv,heads have been fo:ind in tr Ss - clearings. In March of 1984 the pine trees planted on the rows in 1955 were clear cut. This was done by modern machinery during a wet spell. The integrity of the lard was completely destroyed, both in its ability to drain properly or to regenerate a balance through natural processes in the near future. Ruts and tracks up to three feet deep were cut by the large tractors and debris was pressed haphazardly into the soft soils. The purpose of the proposed pond is to acc.-aire approximately *990 cubic yards of soil to put a proper crown on the land and the purpose of the proposed ditches is to restore the proper drainage. The land use after the proposed wor'.%_ has been clone will be for fruit trees and pecan trees. Environmental setting The application b :ir considered at this time is for work on a 5 acre tract of land owned by the applicant which is a portion of other land holdings he has in the general area. The property being considered at this time is located in what was once the South East Corner of the Ellison Plantation. The land has been in the applicant's fa ;lily since 1902.
