MOTION TO TERMINATE CONSENT DECREE
Plaintifl the United States of America, on behalf of the United States Environmental
Protection Agency ("EPA"), at the request and with the consent of the Defendants, City of
Wilmington, North Carolina, New Hanover County, North Carolina, and the Cape Fear Public
Utility Authority, moves the Court to Terminate the Consent Decree which was entered by this
Court on December 11, 2013. (Docket No. l3)
The provisions under Section XIX. FINAL REPORT AND TERMINATION of the
Consent Decree set forth the procedure for terminating the Consent Decree. The Defendants
have, as required by Paragraph 65, submitted a Final Report that describes all of the actions

undertaken by the Defendants toward achieving compliance with the Consent Decree and an
assessment of the effectiveness of such actions in eliminating sanitary sewer overflows
("SSOs"). See letter dated March 21,2018 from the Cape Fear Public Utility Authority appended
hereto as Exhibit A. The United States Protection Agency ("EPA") has determined that the
Defendants have fulfilled all of the obligations set forth in Paragraphs 65 and 67 andhave
therefore approved the Final Report. In accordance with Paragraph 68, the Defendants have
certified satisfaction of the requirements of the Consent Decree and have requested that it be
terminated. EPA has determined that the Defendants have complied with the requirements of
the Consent Decree and therefore seeks an order from the Court terminating the Consent Decree
herein. See May 31, 2018 email from Brad Ammons, Environmental Engineer, EPA Region 4,
Atlanta, Georgia concurring with Cape Fear Public Utility Authority's request to terminate the
Consent Decree.
