ASSESS CIVIL PENALTY

The North Carolina Division of Water Resources conducted an inspection of the Chemours
Company -Fayetteville Works on November 3, 2017. This inspection was conducted to verify
that the facility is operating in compliance with the conditions and limitations specified in
NPDES WW Permit No. NC0003573.
The inspection was conducted by Division of Water Resources staff from the Fayetteville
Regional Office. Chemours employees indicated during the November 3, 2017 inspection that on
October 6, 2017, there was a release of C3 Dimer Acid from the Vinyl Ethers South Stack. Rain
events on October 7ffi, 8th, and 9 h 2017 resulted in storm water carrying residual C3 Dimer Acid
to the adjacent open channel and Outfall 002. A discharge to the Cape Fear River of C3 Dimer
Acid occurred at Outfall 002.
Based on the review of information obtained,from our inspection, a violation of 15A NCAC 02B
.0216 (3)(a) occurred, which states:
"Sewage, industrial wastes, non process industrial wastes, or other wastes:
none shall be allowed except for those specified in Item (2) of this Rule and
Rule. 0104 of this Subchapter and none shall be allowed that have an adverse
effect on human health or that are not treated to the satisfaction of the
Commission and in accordance with the requirements of the Division. Any
dischargers or industrial users subject to pretreatment standards may be
required by the Commission to disclose all chemical constituents present or
potentially present in their wastes and chemicals that could be spilled or be
present in runoff from their facility which may have an adverse impact on

downstream water supplies. These facilities may be required to have spill and
treatment failure control plans as well as perform special monitoring for toxic
substances; "
A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of
North Carolina General Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00)
may be assessed against any person who violates or fails to act in accordance with the terms,
conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
This Notice of Violation serves to supplement the previous Notice of Violation signed on
November 13, 2017. If you wish to provide additional information regarding the noted violation,
request technical assistance, or discuss overall compliance please respond in writing within
ten (10) business days after receipt of this Notice. A review of your response will be considered
along with any additional information provided in determining if a civil penalty is warranted.
Remedial actions should have already been taken to correct this problem and prevent further
occurrences in the future. The,Division of Water Resources may pursue enforcement action for
this and any additional violations of State law.
