REGAN Secretary LINDA CULPEPPER Interim Director Water Resources Environmental Quality May 30, 2018 DWR #2017-0905 v2 Alamance County 1-40 Drive In, LLC Attn: Chuck Talley PO Box 872 Graham NC 27253-0872 Subject: REQUEST FOR ADDITIONAL INFORMATION Graham Drive In Dear Mr. Talley: On May 4, 2018, the Division of Water Resources — Water Quality Programs (Division) received your application requesting a 401 Water Quality Certification from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please provide the Division with a copy of your response to May 9, 2018 email from the U.S. Army Corps of Engineers requesting additional information. [15A NCAC 02H .0502(c)] Please re -submit your site plans at a scale of no smaller than 1"=50' with topographic contours shown. Please ensure that all streams, wetlands and buffers are clearly shown on the plan sheets. Specifically, please clearly show the buffers upstream of Crossing #2 and along streams that enter the property boundary from the north even if no impacts are proposed within these buffers. [15A NCAC 02H .0502(b)] 3. Please enumerate all wetland, stream and/or buffer impacts from all activities on the site plan including, but not limited to, fill/grading slopes, dissipater pads, proposed utility easements, temporary construction and/or erosion control measures, etc. The Division recommends highlighting by hatching or shading all impacts areas for temporary impact areas and permanent impact areas. [15A NCAC 02H .0502(8)] 4. Per Condition 11.11 of GC4139, please provide details on how you are going to maintain the physical integrity of the stream above and below the culvert. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section as closely as possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases water velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage. A construction sequence and detail should be provided to ensure the contractor is clear on construction of these benches. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the plan sheets. [15A NCAC 02H .0502(b)(3)] 6. The Jordan Lake Buffer Rules are implemented by the City of Graham, therefore please provide a Jordan Lake Buffer Authorization from the local delegated municipality to document that impacts to the protected riparian buffer are in accordance with the approved local ordinances. [15A NCAC 02B .0267(7)(b) or (c)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond within 30 calendar days of receipt of this letter by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form. Please note that the DWR# that is requested on the link is referenced above. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
