The Division has determined that your application is incomplete and cannot be processed. The application is on hold until the following item is addressed: In accordance with our recent phone conversation, please confirm that you plan to implement a pump around operation, generally as depicted in the attached details, rather than the piped diversion depicted in the PCN application, in order to comply with condition 11.9 of 401 Water Quality Certification 4139 . Alternatively, if you would like to implement the piped diversion as provided in the PCN application, please provide a restoration and stabilization plan for the disturbed streambanks. [15A NCAC 02H .0506 (b)(2)] Please note that either stream bypass method will require temporary impacts to the stream channel. Unless you notify me that more temporary impacts are required, the 401 approval will include 20 feet of additional temporary impacts associated with the stream pump around or piped diversion bypass operation. Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application.
