Atlantic Intracoastal Waterway (AIWW), New Hanover County, North

• `This permit, issued on L/7ZE , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) No Spartina Alterniflora marsh will be excavated. The basin will have

(2) In order to protect juvenile shrimp and fin fish populations, no excavation
or filling will be permitted between April 1 and September 30 of any year
without the prior approval of the Division of Coastal Management.
(3) All excavated material will be placed directly on high ground. There will
be no double-handling of material which would require its placement in
waters or wetlands.
(4) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
'(5) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).

after set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases such that the turbidity in the stream is
25 NTU's or less are not considered significant).
Violations of any condition herein set forth shall result in revocation of
this Certification.
This Certification shall become null and void unless the above condition(s)
is made a condition of the Federal Permit(s).

.The applicant proposes to maintenance excavate an access channel 150
feet long, 25 feet wide and a private boat basin 60 feet by 25 feet. A
280 linear foot wooden bulkhead is proposed along the shoreline. The
property is located adjacent to the AIWW in the Myrtle Grove Sound area,
classified SA.
A review of the proposed project to determine impacts to water quality
offers the following comments:
1. A 401 certification will be required, but should meet the
conditions of a General 401 Certification for bulkhead
construction.
2. The proposed project is not expected to cause adverse impacts
on existing water quality within the area of the project.

channel and to provide a new single vessel dock for the basin. He also proposes to
stabilize his shoreline by bulkheading.

9. PROJECT DESCRIPTION:

The project;is located along the shoreline of the applicants property. Within
the project boundaries there is an existing private (members only) boat ramp and
pier facility and at the north end there is an existing access channel and boat
'.,basin. The dimensions of the original feature were approximately 150' long x 30'
ie for the channel and 60' long x 50' wide for the basin. Smooth cordgrass
marsh has become re-established in this basin to a large extent due to a lack of
maintenance. Than bank of the original basin was lined with rip-rap material to
slow down the effect of erosion. There are also existing rock jetties along the
Ooreline of the project area at several locations. Just south of the existing
?hmp the deposition of old rip-rap including ferrous materials has resulted in
anunsafe and unsightly condition. Between the ramp/pier area and the basin/
channel area is a boarder of smooth cordgrass (Spartina alterniflora) marsh up
to 110' wide. This marsh has gradually filled in this area over the last few
years. No work is proposed in this particular area. The project is located
within an area classified as a primary nursery area and in SA waters.
The applicant proposes to maintain the access channel and a portion of the boat
basin; to build a bulkhead along the shoreline for stabilization and to build
a single floating dock for the maintained basin. The dimensions of the channel
will be 150' long x 25' wide x -6' MLW. The basin will be approximately 60' long
x 25' wide x -6' MLW. The applicant is proposing the use of a dragline and truck
with mats to accomplish the excavation. Approximately 1,000 cubic yards of
material will be removed to highground (lot(s)) for disposal. The material will
be graded and grassed for stabilization. The applicant proposes to construct
approximately 280 linear feet of bulkhead aligned at or above the mean high water
(MHW) contour. The dock for the basin will be approximately 20' long x 5' wide
and will be connected to highground by a ramp. -
10. ANTICIPATED IMPACTS:

The project as proposed will cause to be consumed approximately 875 s.f. of
smooth cordgrass marsh most of which has become established in recent years. If
this loss is avoided it appears that the project can still be completed by
installing a longer pier and dock.

Department of the Army permit and a State Water quality
Certification to accomplish work on Myrtle Grove Sound, the
4 Atlantic Intracoastal Waterway (AIWW), New Hanover County, North
Carolina. Your receipt of this letter verifies your acceptance of
a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We-are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
R' after receipt of a.request'for certification is considered a
reasonable time for St..ate action. Therefore, if your office has
not acted on the request by May 6, 1985, the District Engineer

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed),.which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received March 4, 1985, for a
Department of the Army permit to maintain a channel/canal and
basin;-construct and backfill a bulkhead and replace a pier on
Myrtle Grove Sound, the Atlantic Intracoastal Waterway (AIWW), New
Hanover County, North Carolina, indicates it to be a candidatle fors
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review.agencies will be furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taketi on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you-begin work.
Your application, pursuant to Section 10 of the'River and
Harbor Acct and Section 40,4 of the Clean Water Act, has been
assigned No. SAWC085-N-065-0137 and will be coordinated by
Mr. Mike Smith, telephone [phone]. He is available to

Reference the application of Mr. Thomas D. Williams for a
Department of the Army permit to maintain a channel/canal and
basin, construct and backfill a bulkhead, and replace a pier on
Myrtle Grove Sound, the Atlantic Intracoastal Waterway (AIWW), New
Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. No Spartina alterniflora marsh will be excavated. The
basin will have to be shortened and the pier will have to be
extended to meet this condition and to provide access.
b. All excavated material will be placed directly on high
;.ground. There will be no double-handling of material which would
require its placement in waters or wetlands.
c. All excavated material will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded marshlands.
d. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
