Dear Mr. Taylor:
The North Carolina Division of Coastal Management has received your
letter of notification dated November 22, 1985 concerning repairs to the
pumping facility at the New Field Impoundment on Pea Island National Wild-
life Refuge. Repairs proposed are to the facility permitted by the U. S.
Army Corps of Engineers under SAWCO-85-N-028-0074 issued in April, 1985
and which was reviewed by the State and found consistent with the North
Carolina Coastal Management Program.

On the basis of a site visit by Mr. George Wood of our field staff
and a review of the proposed repairs we have determined that these repairs
as outlined in your letter of notification are consistent with the North
Carolina Coastal Management Program. We do recommend that vegetative
cover be established on the new ring levee as quickly as possible to prevent
further storm damage, however.
In addition, we understand from our conversation with the N. C.
Division of Environmental Management that the requirement for a 401 Certifi-
cation is met with the issuance of the Corps nationwide permit authorizing
repair and/or replacement of currently serviceable structures.

Dear Mr. Dunaway:
The State of North Carolina has completed its review of your December
6, 1984 Consistency Determination on the construction of a pumping facility
at-the New Field Impoundment, Pea Island National Wildlife Refuge, Dare County.
The proposed facility would improve water level control in the impoundment
for the purpose of creating an additional 30 to 35 acres of wildlife habitat.
The State agrees with your determination that the proposed facility is
consistent with the North Carolina Coastal Management program. A condition
of our approval is that the project be conducted in accordance with the
conditions of the States' general water quality certification for fill
behind bulkheads. A copy of this general certification is attached.

THE U. S. DEPARTMENT OF THE INTERIOR, FISH AND WILDLIFE SERVICE, PEA ISLAND NATIONAL WILDLIFE REFUGE, Post
Office Box 150, Rodanthe, North Carolina 27968, represented by MR. ALTON DUNAWAY, Refuge Manager, has applied
for a Department of the Army permit TO EXCAVATE A SUMP AREA AND CONSTRUCT A BULKHEAD ASSOCIATED WITH MANAGEMENT
OF A WILDLIFE IMPOUNDMENT, NEW FIELD POND, ADJACENT A TIDAL CREEK CF F PAMLICO SOUND, NCRTH OF RODANTHE, in Dare
County, 'North Carolina.
The following description of the work is taken from data provided by the applicant and from observations
made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the appiicatton
show the proposed excavation by dragline of a 70-foot-long, 15-foot-wide, 8-foot-deep, mean low water (MLW), sump
area to increase the availability of water for controlling flooding within the adjacent 320-acre wildlife
Impoundment. Approximately 280 cubic yards of sand material is to be excavated and placed on the berm on the
east side of an existing dike. Excavation would disturb approximately 825 square feet of t idal creek bottom and
approximately 400 square feet of regularly and irregularly flooded marsh vegetation. Approximately 30 linear
feet of bulkhead and a 30-inch diameter pipe are to be instal led at the water pumping facility location. The
applicant has examined other alternatives and determined the proposal to be least damaging. The purpose of the
proposed work is to better manage the 320-acre impoundment for waterfowl use. Plans showing the proposed work
are Included with this public notice.
The applicant has determined that the proposed work Is consistent with the N. C. Coastal Zone Management
Plan and has submitted this determination to the N. C. Office of Coastal Management for their review and
concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina
agencies such as:
a. The Issuance of a Water Quality Cart I f I cat Ion under Section 401 of the Clean Water Act by the N. C.
Division of Envlronmental Management.
b. The Issuance of a permit to dredge and/or fill under. N. C. General Statute 113-229 by tha N. C.
Office-of Coastal Management.
c. The Issuance of a permit under the N. C. Coastal Area Management Act (CAMA) by the N. C. Office of
Coastal Management or their delegates..
d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under N. C.
General Statute 143-341(4), 146-6, 146-11, and 146-12 by the N.C. Department of Administration and the N. C.
Council of State.
e. The submittal of an Erosion and Sedimentation Control Plan to the Land Quality Section, Division of
Land Resources, pursuant to the State Sedimentatlon Poi IutIon Control Act of 1973 (NC G.S. 113 A-50-66).
The requested Department of the Army permit will be denied if any required State or local authorization.
and/or certification Is denied. No Department of the Army permit will be Issued until a State coordinated
viewpoint Is received and reviewed by this agency. Recipients of this notice are encouraged to furnish
commsnts-on- factors of concern represented by the above agencles directly to the respective agency, with a
copy furnished to the Corps of Engineers.
Approval of this permit will give Federal authorization for maintenance dredging for a par lod of time not
to exceed 10 years from the date of permit Issuance. The permittee will be required to present plans to the
District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would
be performed In accordance with Federal, State, and local permits and regulations governing such activities at
the time the maintenance is undertaken.
This application Is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33
U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, In writing
within the comment period specified In this notice, that a public hearing be held to consider this
app l l-?at lon. Requests for public hearing shat I state, with particularity, the reasons for holding a public
hearing.
The Olstrlct Engineer has consulted the latest published version of the National Register of Historic
Places for' the presence or absence of registered properties, or properties listed as being eligible for
Inclusion therein, and this worksite Is not registered property or property listed as being eligible for
inclusion In the Register. Consultation of the National Register constitutes the extent of cultural resource
Investigations by the District Engineer, and he Is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or hlsiarlcal data may be last or destroyed by work
under the requested permit.
The District Engineer has determined, based on a review of data furnished by the applicant and onsite
observations, that the activity will not affect species, or their critical habitat, designated as endangered or
threatened pursuant to the Endangered Species Act of 1973.
The decision whether to Issue a permit will be based on an evahuatlon of the probable Impact Including the
cumulative impacts of the proposed activity on the public interest. That decision will reflect the national
concern for both protection and utilization of important resources. The benefit which reasonably may be expected
to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which
may be relevant to theproposai will be considered; among those are conservation, econanics, esthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values,
land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food production, and In general, the needs and welfare of the people. The evaluation of
the Impact of the activity on the public interest will also include application of the guidelines pr anulgated by
the Administrator, U. S. Environmental Protection Agency, under the authority of Section 404(b) of the Clean
Water Act (40 CFR Part 320). No permit wil l be granted unless its issuance is found to be In the pub! is
interest.
Generally, the decision whether to issue this Department of the Army permit will not be made until the
N. C. Division of Environmental Management (DEM), issues or denies State certification required by Section 401 of
the Clean Water Act. The OEM considers whether or not the proposed activity will comply with Sections 301, 302,
306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army
permit serves as application to the OEM for certification.
Additional information regarding the Clean Water Act certification may be reviewed at the offices of the
Environmental Operations Section, N. C. Division of Environmental Management, Salisbury Street; Archdale
Building, Raleigh, North Carolina. Copies of such materials wil I be furnished to any person requesting copies
upon payment of reproduction costs.

Enclosed is the application of the U. S. Department of the
Interior, Fish and Wildlife Service, Pea Island National Wildlife
Refuge, for a Department of the Army permit and a State Water
Quality Certification to accomplish work on Pamlico Sound. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
.been obtained or waived.
In accordance with our administrative regulations, 60 days
a-fter-receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by February 18, 1985, the District
Engineer will deem that waiver has occurred.

Alternative and Proposed Action
Pump Facility - New Field Impoundment
Pea Island National Wildlife Refuge
Background
New Field Impoundment comprises approximately 320 acres of water,
low marsh, and cropland. With current water control capabilities,
60 to 80 acres of New Field on the east side are high and dry
during most of the year. A majority of the remaining acres are low
marsh, with a narrow canal bordering the dike system.
A pumping system is needed at New Field to allow for more control
of the water level. With the installation of a 30" pump, 30-35
acres of high land could be converted to marsh. The pumping
capability for the facility is estimated to be approximately 30,000
gallons per minute. This type of water level control is necessary
to better manage the 320 acre impoundment for waterfowl use.
Proposed Action
The proposed action calls for the installation of the pumping facility
at Tidal Creek B (see aerial photo). This water source is much
deeper and wider than the water source at the existing water control
structure (see Depth Comparison Chart). With this action, a sump
area 70'x15' would be excavated to a depth of 8 feet below present
ground level on a 15'x15' area and 7' below ground level on the
remainder of the sump area (551x13'). A total of 280 cubic yards of
spoil will be excavated and moved to the berm on the east side of
the existing dike.
The excavation of the sump area will disturb 825 sq. ft. of tidal
creek bottom and 225 sq. ft. of Spartina-Juncus Marsh. An additional
180 sq. ft. of marsh will be excavated temporarily to install the
30" pipe. This section will be filled and shaped to its original
state when construction is completed.
The shed for the power unit will be constructed on pilings,
eliminating the need for extensive bulkheading. Due to the depth and
width of the creek involved, no additional dredging would be
necessary to provide the water volume needed. Also, no unnecessary
marsh would be disturbed by the spoil from the sump area, since the
280 cubic yards would be deposited elsewhere. (For details of
construction, see Diagrams 1 and 2).
Alternatives
The only alternative to locating the pumping station on "Tidal
Creek B" is to locate it on "Tidal Creek A", the site of the
existing water control structure. If this location were utilized,
extensi.ve_dredging would be necessary throughout. the tidal creek
to ensure enough water flow to feed the 30" pump. In addition,
a sump area:of comparable size would be needed.

Pump FSclity - Nev Field Impoundment
Pea Island National Wildlife Refuge
Background
New Field impoundment comprises approximately 320 acres of water,
low marsh, and cropland, with current water control capabilities,
60 to 80 acres of New Field on the east side are high and dry
during most of the year. A majority of the remaining acres are low
marsh,, with a narrow canal bordering the dike system.
A pumping system is needed at New Field to allow for more control
of the water level. With the installation of a 30" pump, 30-35
acres of high land could be converted to marsh. The pumping
capability for the facility is estimated to be approximately 30,000
gallons per minute. This type of water level control is necessary
to better manage the 320 acre impoundment for waterfowl use.
Proposed Action
The proposed action calls for the installation of the pumping facility
at Tidal Creek B (see aerial photo). This water source is much
deeper and wider than the water source at the existing water control
structure (see Depth Comparison Chart). With this action, a sump
area 701X15' would be excavated to a depth of 8 feet below present
ground level on a 15'X15' area and 7' below ground level on the
remainder of the sump area (55'X151). A total of 280 cubic yards of
spoil will be excavated and moved to the berm on the east side of
the existing dike.
The shed for the power unit will be constructed on pilings, eliminating
the need for extensive bulkheading. Due to the depth and width of
the creek involved, no additional dredging would be necessary to
provide the water volume needed. Also, no unnecessary marsh would
be disturbed by the spoil from the sump area, since the 280 cubic
yards would be deposited elsewhere. (For details of construction,
see Diagram 1).
Alternatives
The only alternative to locating the pumping station on "Tidal Creek
B" is to locate it on "Tidal Creek A", the site of the existing
water.control structure. If this location were utilized, extensive
dredging would be necessary throughout the tidal creek to ensure
enough water flow to feed the 30" pump. In addition, a sump area
of comparable size would be needed.

for a Department'of the Army permit TO EXCAYATE A SUMP AREA AND CONSTRUCT A BULKHEAD ASSOCIATED WITH MANAGEMENT
OF A WILDLIFE IMPOUNDMENT, NEW FIELD POND, ADJACENT./- TIDAL CREEK OFF PAMLICO SOUND, NORTH OF RODANTHE, in Dare
County, North Carolina.
The following description of the work is taken from data provided by the applicant and from observations
made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application
show the proposed excavation by dragline of a 70-foot-long, 15-toot-wide, 8-toot-deep, mean low water (MLW), sump
area toIncrease the availability of water for controlling flooding within the adjacent 320-acre wildlife
impoundment. Approximately 280 cubic yards of sand material is to be excavated and placed on the berm on the
east side of an existing dike. Excavation would disturb approximately 825 square feet of tidal creek bottom and
approximately 400 square fet? of regularly and irregularly flooded marsh vegetation. Approximately 30 linear
feet of bulkhead and a 30-inch diameter pipe are to be instal led at the water pumping facility location. The
applicant has examined other alternaifives and determined the proposal to be least damaging. The purpose of the
proposed work is to better manage the 320-acre Impoundment for waterfowl use. Plans showing the proposed work
are Included with this public notice.
The applicant has determined that the proposed work is consistent with the N. C. Coastal Zone Management
Plan and has submitted this determination to the N. C. Office of Coastal Management for their review and
con qurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina
agencies such as:
a. The Issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the N. C.
Division of Environmental Management.
b. The Issuance of a permit to dredge and/or fill under.N. C. General Statute 113-229 by the N. C.
Office of Coastal Management.
c. The issuance of a permit under the N. C. Coastal Area Management Act (CAMA) by the N. C. Office of
Coastal Management or their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under N. C.
General Statute 143-341(4), 146-6, 146-11, and 146-12 by the N.C. Department of Administration and the N. C.
Council of State.
e. The submittal of an Erosion and Sedimentation Control Plan to the Land Quality Section, Division of
Land Resources, pursuant to the State Sedimentation Pot lution Control Act of 1973 (NC G.S. 113 A-50-66).
The requested Department of the Army permit will be denied if any required State or local authorization
and/or certification is denied. No Department of the Army permit wit 1 be issued until a State coordinated
viewpoint Is received and reviewed by this agency. Recipients of this notice are encouraged to furnish
comments on factors of concern represented by the above agencies directly to the respective agency, with a
copy furnished to the Corps of Engineers.

Approval of this permit will give Federal authorization for maintenance dredging for a period of time not
to exceed 10 years from the date of permit issuance. permlttee will be required to present plans to the
District Engineer a minimum of 2 weeks prior to cammencemen-f of such maintenance work. Ail ma.jntenance wquId

This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33
U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, In writing

The District Engineer has consulted the latest published version of theational Register of Historic
Places for the presence or absence of registered properties, or properties 1 ted as being eligible for
Inclusion therein, and this worksite is not registered property or property listed as being eligible for
inclusion In the Register. Consultation of the National Register constitutes the extgnt of cultural resource
Investigations by the District Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work
under the requested permit. f
The District Engineer has determined, based on a review of data furnished 'by.-the;eapplicant and onsite
observations, that the activity wit I not affect species, or their critical habld,att,desigiated as endangered or
threatened pursuant to the Endangered Species Act of 1973.
The decision whether to Issue a permit wil l be based on an evaluation of the projaable Impact including the
cumulative impacts of the proposed activity on the public Interest. That decision w,l1?°!,t?ireflect the national
concern for both protection and utilization of Important resources. The benefit wh IA1 ason abl y may be expected
to accrue from the proposal must be balanced against Its reasonably foreseeable detrlmw&s.. All factors which
may be relevant to the proposal wil 1 be considered; among those are conservation, economics, esthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values, flood hagards., flood plain values,
land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, voter quality,
energy needs, safety, food production, and In general, the needs and welfare of the peopl6l. The evaluation of
the impact of the activity on the pubiic interest will also include application of the guidelines pr anulgated by
the Administrator, U. S. Environmental Protection Agency, under the authority of Section 404(b) of the Clean
Water Act (40 CFR Part 320). No permit will be granted unless its issuance is found to be in the public
interest.
Generally, the decision whether to issue this Department of the Army permit will not be made until the
N. C. Division of. Env ironmentai Management (DEM), issues or denies State certification required by Sect ton 401 of
the Clean Water Act. The DEM considers whether or not the proposed activity w11I comply with Sections 301, 302,
306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army
permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be reviewed at the offices of the
Environmental Operations Section, N. C. Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials wil I be furnished to any person requesting copies
upon payment of reproduction costs.

FACILITY FOR THE NEW FIELD IMPOUNDMENT ON A TIDAL CREEK OFF PAMLICO SOUND,
NORTH OF RODANTHE.,Dare County; North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during.an onsite visit by a
representative of the Corps of Engineers. 'Plans submitted with the
application show. the proposed excavation by dragline of a 70-foot-long,
15-foot-wide, 8-foot-deep sump within a tidal creek. Approximately 280 cubic
yards of excavated material is to be placed and retained on high ground
landward of the nofmal high water (NHW) contour. A 30-inch pipe is to be
installed from the sump, underneath the dike, into the impoundment. After the.
trench has been excavated and the 30-inch pipe installed, the line is to be
backfilled to preconstruction elevations and contours. A 15-foot-wide,
15-foot-long, pile supported shed is to be used as the pumphotise. No fill.
material is to be placed in any waters or marshes to the west of the existing
impoundment dike. Approximately 825 square feet of tidal creek bottom and
225 square feet of a Spartina alterniflora/Juncus roemerianus marsh is to be
excavated. A temporary fill cofferdam is to be installed within the New Field
impoundment in order to facilitate construction of a bulkhead and the intake
pipe. After the work has been completed within the impoundment, the fill
cofferdam.is.to be removed and the material is to be placed on high ground.
The purpose of this work is to provide more control of the water level at New
Field which would allow the creation of 30 to 35 acres of additional habitat.
Plans showing the work are included with this public notice.
The applicant has determined that the proposed work is consistent with

Generally, the decision whether to issue this Department of the Army
permit will not be made until the N. C. Division of Environmental Management
(DEN), issues or denies State certification required by Section 401 of the
Clean Water Act. The DEN considers whether or not the proposed activity will
comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The
application and this public notice for the Department of the Army permit
serves as application to the DEN for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, N. C.
Division of Environmental Management, Salisbury Street, Archdale Building,
Raleigh, North Carolina. Copies of such materials will be furnished to any
person requesting copies upon payment of reproduction costs.
The N. C. Division of Environmental Management plans to take final action
in the issuance of the Clean Water Act certification on or after
January 28,1984.

We request your review of the following project for a Section 401 water
quality certification.
We are proposing to replace approximately 719 feet of existing wooden bulkhead
with concrete sheo-t pile bulkhead at the Oregon Inlet Marina (see enclosed
plan). Of this total, approximately 181 feet, on the northern end, will have
the concrete slabs placed directly in front of the existing bulkhead. The re-
maining bulkhead will be removed and replaced by concrete slabs. A clam
bucket will be necessary to remove an estimated 250 cubic yards of sand and
silt which may settle into the.basin during construction.
The concrete slabs, 12 inches thick, will extend to four feet below the bottom
of the basin (-14 feet MLW), with filter fabric backing to -12 feet (MLW). A
new layer"of,,cement sand bags will be added to the existing sand bags at the
southeast corner.
We are•conturrently applying for a joint state/Corps permit and for a
consistency determiriation from the Office of Coastal Management.

Alternative and Proposed Action
Pump Facility - New Field Impoundment
4? Pea Island National Wildlife Refuge
Background
New Field Impoundment comprises approximately 320 acres of water,
low marsh, and cropland. With current water control capabilities,
60 to•80 acres of New Field on the east side are high and dry
during most of the year. A majority of the remaining acres are low
marsh, with a narrow canal bordering the dike system.
A pumping system is needed at New Field to allow for more control
of the water level. With the installation of a 30" pump, 30-35
acres of high land could be converted to marsh. The pumping
capability for the facility is estimated to be approximately 30,000
gallons per minute. This type of water level control is necessary
to better.manage the 320 acre impoundment for waterfowl use.
Proposed Action
The proposed action calls for the installation of the pumping facility
at Tidal Creek B (see aerial photo). This water source is much
deeper and wider than the water source at the existing water control
structure (see Depth Comparison Chart). With this action, a sump
area 70'x15' would be excavated to a depth of 8 feet below present
ground level on a 15'x15' area and 7' below ground level on the
remainder of the sump area (551x13'). A total of 280 cubic yards of
spoil will be excavated and moved to the berm on the east side of
the existing dike.
The excavation of the sump area will disturb 825 sq. ft. of tidal
creek bottom and 225 sq. ft. of Spartina-Juncus Marsh. An additional
180 sq. ft. of marsh will be excavated temporarily to install the
30" pipe. This section will be filled and shaped to its original
state when construction is completed.
The shed for the power unit will be constructed on pilings,
eliminating the need for extensive bulkheading. Due to the depth and
width of the creek involved, no additional dredging would be
necessary to provide the water volume needed. Also, no unnecessary
marsh would be disturbed by the spoil from the sump area, since the
280 cubic yards would be deposited elsewhere. (For details of
construction, see Diagrams 1 and 2).
Alternatives
The only alternative to locating the pumping station on "Tidal
Creek B" is to locate it on "Tidal Creek A", the site of the
existing water control structure. If this location were utilized,
extensive dredging would be necessary throughout the tidal creek
to ensure enough water flow to feed the 30" pump. In addition,
a sump area of comparable size would be needed.
