Your,proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291.' Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the N. C. Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. Any violation of these terms may subject permittee to a fine, imprisonment _or civil action; or may cause the permit to be null and void. (1) Pdo. material may be used for reef building without a modification of this permit except: 1) demolition rubble from the Highway 32 bridge and/or 2) trash containers as described in the application provided that such containers must be cleaned by sand blasting or other method satisfactory to the Division of Environmental Management and the Division of Coastal Marfagement.prior to placement on site. (2) All material placed to' construct the reefs will be selected to avoid or or minimize the. movement of reef materials due to currents. All materials will be clean and free of asphalt., creosote, petroleum and other hydrocarbons, toxic residues, loose free floating material, and other deleterious substances. (3) The permittee- will maintain minimum clearances above the reefs no less than those shown on the permit application. (4) There-will be no unreasonable interference with navigation or the right of the ' public to riparian access by the existence or use of the artificial reef s (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1988 In issuing this permit, the State of North Carolina agrees that, your project is consistent with the North Carolina Coastal Management Program. BUOYING SYSTEM FOR ARTIFICIAL REEFS Each reef will be marked with a minimum of four spar buoys with one buoy located at each corner. Each buoy will be anchored by use of a tractor tire filled with concrete. Buoys will be approxinately five (5) feet in length and ten (10) inches in diameter with approxi- mately three (3) feet of the buoy above the water line. Buoys will be of the spar buoy type. To this end, the county has agreed to amend their application to include only the bridge rubble and metal trash containers. Further, the metal trash containers are to be sand- blasted to bare metal on the interior before use to assure the removal-of any potential residues. The 6-8 cu. yd. metal trash containers are likely to contain various contaminants that could have adverse impacts on water quality if they are deposited as reef material. I talked at length with Mr. Brickhouse, County Finance Officer and Chairman of the Reef Committee. I understood that he would send a letter amending the appli- cation by specifying only concrete rubble as reef material. No letter has been received. Therefore it is recommended that the application for 401 Certification be denied as proposed. If the applicant will specify which materials will be used, then we may be in a position to reconsider this recommendation. Each buoy will be anchored by use of a tractor tire filled with concrete. Buoys will be approxinately five (5) feet in length and ten (10) inches in diameter with approxi- mately three (3) feet.of the buoy above the water line. Buoys will be of the spar buoy type.
