Although I have yet to receive a hardcopy of your letter of Notice of Violation issued to MSD
Pretreatment Program dated May 16, 2018, I am responding to the one received via email on Monday,
May 215T. Needless to say, MSD's management was stunned to learn of the omission of required
documents and is pursuing immediate action to correct this. Our intentions are to send all documents
by the June 15th deadline. I am enclosing with this letter thirteen signed copies of SIU permits, permit
rationale and applications. In all, of the 20 permitted Sills only six permits remain outstanding.
We take this matter very seriously and will conduct a thorough investigation on how this normal
administrative process could have been overlooked. And rest assured that follow up measures will be
taken to make sure this will not happen again. In the meantime, please direct all future correspondence
to my direct attention. As we continue to work to get the requested information together should you
have any questions,you may contact me on my direct line [phone].

. b. In the event of an accidental discharge,slug loading or self-monitoring indicating .
non-compliance with the SUO or the Permit,the Industrial User shall notify MSD
• within 24 hours of becoming aware of the violation by using the Report Forms on
MSD's Self-Monitoring Monthly Report Form website. .
c. If the accidental discharge, slug loading, or self-monitoring is suspected of ,
severely impacting the MSD sewer system, endangering public safety or the .
safety of MSD employees, the Industrial User shall immediately notify MSD by : ' ' •

GENERAL CONDITIONS AND'REQUIREMENTS
A. Duty to.Comply ` -
•
The Industrial User must comply with all conditions Of the Permit. Any non-compliance
with the Permit constitutes a violation of the SUOand may be grounds for possible
enforcement action. The MSD may levy fines of lip to twenty-five thousand dollars
• ($25,000.00)per day per violation. The•Industrial User may be subject to criminal penalties
levied by the State of North Carolina or the United States of America. •
B. ' Duty to Mitigate-Prevention of Adverse Impact _
•
The.Industrial User shall take all reasonable steps tominirnize or prevent any discharge it • -
violation of the Permit which has a reasonable likelihood of adversely affecting human ,
- . • health,the MSD Treatment Plant,the French Broad River,or the environment. ' •
C: • General Prohibitive Standards
•
' . In addition to the requirements of the Permit, the Industrial User shall comply with the,
general 'prohibitive 'discharge standards in .40 cER '403.5(p.) and' (b)• of'the Federal _ •
• _ pretreatment regulations. - •
D. Facilities Operation .,
' '. • The Industrial-User shall at•all times maintain in good working order' and operate as ::
- . efficiently as possible, all control facilities or systems installed or used by the Industrial ,
• - User to achieve compliance with the terms and conditions of the Permit and the'SUO. '
E: Bypass
- 1. Bypass of treatment facilities is prohibited. MSD may take enforcement action.-against
- the Industrial User ,forbypass unless MSD approves when, such -bypass-.'is in
compliance with 40 CFR'403:17.' Such conditions are: . '
• • " , a Bypass was unavoidable to prevent loss of life personal injury.,or severe property
damage; . ;
b. There were no feasible alternatives to the bypass. This condition is not satisfied if •
• -- adequate back-up equipment should have been.~installed in the., exercise- of
reasonable engineering judgment' to ,prevent a bypass which occurred during .. •
. normal periods of equipment downtime or preventative mainteriance;.and .
••. - ' c. The Industrial 'User knows in advance of the need for:the bypass, submits prior. ,
noticebf the bypass to MS1).. •

2. If the Industrial user does not know of the bypass in advance, it must submit verbal
notice to MSD as soon as the Industrial User becomes aware of the bypass. The verbal
notice shall be followed with a written submission. The written submission shall
' -describe the bypass and its cause; state:how long the bypass occurred including exact
. dates and times,'and if the bypass has not been corrected, the anticipated time it is,
expected to continue; and steps taken or planned to reduce, eliminate and prevent
reoccurrence of the bypass.
. F. Flow Measurement
1. Flow measuring and,recording facilities shall be maintained to provide an accurate
-. • measurement of the.volume discharged. If.it is-the determination of the MSD_that
•- ' - _ when,in the opinion of the MSD or Industrial User,the flow Measuring and recording '
• • facilities are not sufficiently•measuringthe flow,the,MSD may require recalibration or. '
change-out at the expense of Industrial User. •. ' •.
• 2: Any malfunction of flow monitoring and recording equipment shall be reported by the :
- Industrial User.m mediately:to MSD by phone followed-by a written report submitted
--t0 ,the General-Manager•of. MSD within, five' (5) days of the -malfunction. •. Any. '
malfunction must be corrected within seven(7) days. Certification of accuracymust be
• provided to MSD within fifteen(15) days of-the date of repair.
. G. Reports of Changed Conditions. -
, 1. The Industrial User: shall give notice to the General Manager of :any planned. .
. • •. - • significant changes to the operations or system which might alter the-nature,quality,_ , ' - .
or volume of its wastewater at least 180 days before the change. The'Industrial User . . • ,
shall not begin•the changes until receiving-Written approval from MSD. Significant •-

inadequate treatment facilities, lack of preventative maintenance, or careless or improper

The following pollutants and associated flow limit were assigned numerical limits
in this Industrial User Permit for Monitoring Point 01 based on the MSD Sewer Use
Ordinance (SUO) or Best Professional Judgment (BPJ).

Headworks Analysis, which considers most recent available industrial monitoring and
analytical characterization of the MSD Wastewater System. Limits established in
Permits to Discharge Industrial Waste were utilized in the Headworks Analysis to
determine the capability of the Wastewater Treatment Plant to operate within design and
Permit Limits, pass-through and receiving stream Water Quality Criteria, and without
chemical inhibition.

6. GENERAL PERMIT CONDITIONS
a. A Permit issued in response to this Application/Survey is subject to all applicable provisions of the
Sewer Use Ordinance of MSD, NPDES No. NC0024911 for the operation of the Metropolitan
Wastewater Treatment Plant by MSD and all applicable State and Federal Regulations.
b. A Permit issued in response to this Application/Survey is required for construction and operation
of any industrial or commercial wastewater pretreatment facilities and/or continued operation of
existing wastewater pretreatment facilities.
c. This Application/Survey,a Permit issued in response to this Application/Survey and all reports or
information submitted pursuant to the requirements of such Permit must be signed and certified by
an authorized representative of the User.
d. The provisions of a Permit issued in response to this Application/Survey are severable and,if any
provision of such Permit or the Application/Survey of any provision of such Permit to any
circumstances is held invalid,the Application/Survey of such provision to other circumstances and
the remainder of such Permit shall not be affected thereby.
e. It is the responsibility of each Industrial or Commercial User to insure that all sludges generated
by the User of a Permit issued in response to this Application/Survey, are managed under
applicable sludge management requirements specified in all applicable State and Federal
regulations.
f. Notice is hereby given that any and all significant violations of provisions of the Sewer Use
Ordinance of MSD by the User of a Permit issued in response to this Application/Survey or any
other Users of the MSD Sewerage System and a list of resulting enforcement actions taken by
MSD will be published each year in the local newspaper. For the purpose of this Section, a
