In accordance with your request, this office has circulated to inte-
rested state review agencies U. S. Army Corps of Engineers Public Notice
.... 0098 dated March 7, 1985 which describes a project
Rutherford County Watershed Commission represented W. P. FountainpofeRutherford.
The project, involving construction of a flood control dam, is located
on a tributary of Cathy's Creek in Rutherford County.
Based on a coordinated agency review, the state interposes no objection
to the project provided the following recommendations are either made a
part of the Federal permit and/or are carried out prior to
permit action.
With reference to additional pre-project archaeological work, we refer
you to the joint memorandum of April 1 from the Division of Archives and
History.
The 401 certification which was issued on May 7, along with other
requirements, covers the low flow needs of the project stream. It should
be noted that both the Division of Environmental Management (through the
401) and the Office of Water Resources, through its comments on the Public
Notice provide input on safeguarding downstream flow by requiring that
the 7 day - 10 year flow be maintained.

Mr. Carroll Pierce, being first duly sworn, deposes and says:
That he is at the present time Acting Director of the North
Carolina Division of Soil and Water Conservation, Department of
Natural Resources and Community Development, pursuant to North
Carolina General Statute 139-4 and 143B et seq; that in this
capacity he has charge of and is in possession of the Minutes of
the meetings, duly called, and all other official records of the
said Soil and Water Conservation Commission of the Department.
That the following information is an excerpt of the Minutes of
the duly called meeting of which a quorum was present and voting,
which was held by the North Carolina Soil and Water Conservation
Commission on July 10, 1985, relating to a request by the County of
Rutherford Watershed Commission, Rutherfordton, North Carolina, W. P.
Fountain, Chairman. The Chairman was acting pursuant to a resolution
adopted by the Rutherford County Soil & Water Conservation District.
The request was for approval to use the power of eminent domain to
secure the necessary easements within Structure Site #13 (Parcels 4,
5, 6 and 7), Second Broad River Watershed Project as defined within
the requested dated June 26, 1985, and is authorized in Article III,
G.S. 139.44, of the North Carolina Small Watershed Act:
"Mr. Pierce commented on the requests made by the Rutherford
County Watershed Commission. The County has requested that the
power of eminent domain be exercised in order to acquire interest
in 4 parcels of land lying within Second Broad River Watershed flood
retention reservoir Site #13. A description of the parcels is as
follows:
Parcel #4 is owned by Robbie L. Conner and wife, Nannie Connor,
and lies within the flood pool. The tract contains approximately
33.1 acres.
Parcels #5 and #6 are owned by Patsy Moore Allen and Mildred
Ruth Henderson and lies within the flood pool. The tract contains
approximately 35.3 acres.
Parcel #7 is owned by Wyath Revis Moore and lies within the
flood pool. The tract contains approximately .1 acres.
Mr. Pierce explained that an easement was being sought for these
properties instead of fee simple title."

Pierce then passed out information provided by Dan Oakley
describing the Commission's role in eminent domain proceedings, copy
of which is attached to these Minutes (Attachment #I). He stated
the Commission's responsibility was to determine that the land was
being sought for a proper purpose.
Mr. Laughinghouse moved that the Commission concur with the
request submitted by Rutherford County. Mr. Strickland seconded
the motion and it carried unanimously.

THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and subject to
the North Carolina Division of Environmental Management Regulations in 15 NCAC
2H, Section :0500 to Rutherford County Watershed Commission pursuant to
an application filed on the 21st day of December, 1984 to construct a
flood control dam on Mill Creek.
The Application provides adequate assurance that the discharge of fill
material into a wetlands area adjacent to the waters of Mill Creek in
conjunction with the proposed flood control dam in Rutherford County
will, :not result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina certifies
that this activity will not violate Sections 301, 302, 303, 306, 307 of
PL92-500 and PL 95-217 if conducted in accordance with the application
and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That concrete foundations or beds which must be
constructed shall be "dry-poured" to insure that
live concrete does not contact surface waters.
3. That proper erosion control techniques shall be
employed during construction and that exposed
surfaces of the earthen dikes shall be planted
with a suitable ground cover.
4. That provisions be made to maintain at least the
7 day - 10 year low flow
Violations of any condition herein set forth shall result in revocation
of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permits.

PUBLIC NOTICE
THE RUTHERFORD COUNTY WATERSHED COMMISSION, represented by MR. W. P.
FOUNTAIN, Contracting Officer, Room 202, Federal Building, 121 South Main
Street, Rutherford, North Carolina 28139, has applied for a Department of the
Army permit TO PLACE PILL MATERIALS IN THE WATERS AND WETLANDS OF MILL CREEK,
A TRIBUTARY OF CATHY'S CREEK, TO CONSTRUCT A FLOOD CONTROL DAM UPSTREAM OF
S. R. 1327, NEAR GILKEY, in Rutherford County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative-of the Corps of Engineers. Plans submitted with the
application show the proposed placement of approximately 86,000 cubic yards of
earthen fill, obtained from excavation of an emergency spillway and upland
borrow locations, to construct a 38-foot-high earthen dam to span the waters
and wetlands of Mill Creek. The site of the proposed work is approximately
1,000 feet upstream of where S. R. 1327 crosses the creek. The drainage area
involved is approximately 2.7 square miles, and the dam is to establish a
permanent pool area of 23 acres and a high water (100 year-24 hour storm) pool
acreage of 69 acres. The purpose of the work is to provide for flood control
downstream of the site. Plans showing the proposed work are included with this
public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the N. C. Office of
Environmental Management has determined the applicability of a Water Quality
Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.

The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species,"Atheir critical habitat, designated as endangered or threatened
pursuant to,'"the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impact including the cumulative impacts of the proposed activity
on the public interest. That decision will reflect the national concern for
both protection and utilization of important resources. The benefit which
against -its reasonably fores eeable--detri-rents-: -Al 1-factor-s-wh-ic-h-may-be--
relevant to the proposal will be considered; among those are conservation,
economics, esthetics, general environmental concerns, wetlands, cultural,
values, fish and wildlife values-, flood hazards, flood plain values, land use,
navigation, shoreline erosion and accretion, recreation, water supply and
conservation, water quality, energy needs, safety, food production and, in
general, the needs and welfare of the people. The evaluation of the impact of
the activity on the public interest will also include application of the
Fny; ronmen.t_a_] Protection
Agency, under the authority of Section 404(b) of the Clean Water Act (40 CFR
Part 320). No permit will be granted unless its issuance is found to be in
the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the N. C. Division of Environmental Management
(DEM), issues or denies State certification required by Section 401 of the
Clean Water Act. The DEM considers whether or not the proposed activity will
comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The
applicationr and this public notice for the Department of the Army permit
serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, N. C.
Division of Environmental Management, Salisbury Street, Archdale Building,
Raleigh, North Carolina. Copies of such materials will be furnished to any
person requesting copies upon payment of reproduction costs.
The N. C. Division of Environmental Management plans to take final action
in the issuance of the Clean Water Act certification on or after April 16,
1985..
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the N. C.
Division of Environmental Management, Post Office Box 27687, Raleigh, North
Carolina 27611 on or before April 10, 1985, Attention: Mr. William Mills.

Dear Mr. Mills:
Enclosed is the application of the Rutherford County
Watershed Commission, represented by Mr. W. P. Fountain, for a
Department of the Army permit and a State Water Quality
Certification to place fill materials in the waters and wetlands
of Mill Creek to construct a dam near Gilkey in Rutherford County,
North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days,
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by April 8, 1985, the District Engineer
will deem that waiver has occurred.
