Although I have yet to receive a hardcopy of your letter of Notice of Violation issued to MSD
Pretreatment Program dated May 16, 2018, I am responding to the one received via email on Monday,
May 21St. Needless to say, MSD's management was stunned to learn of the omission of required
documents and is pursuing immediate action to correct this. Our intentions are to send all documents
by the June 15th deadline. I am enclosing with this letter thirteen signed copies of SIU permits, permit
rationale and applications. In all, of the 20 permitted Sills only six permits remain outstanding.
We take this matter very seriously and will conduct a thorough investigation on how this normal
administrative process could have been overlooked. And rest assured that follow up measures will be
taken to make sure this will not happen again. In the meantime, please direct all future correspondence
to my direct attention. As we continue to work to get the requested information together should you

A. , Duty to Comply .
The Industrial User must comply with,all conditions of the Permit. Any non-compliance
with the Permit constitutes a violation of the SUO and may be.grounds for possible -
. ' " enforcement action: The MSD may levy:fines of up to twenty-five thousand,dollars -
- ($25,000.00) per day per violation. The Industrial User may be subject to crinvnal:penalties • -
levied by the State of North Carolina Of the United States of America. . -
B. Duty.to Mitigate-Prevention of Adverse Impact. ' .
• :• The Industrial User shall take,all reasonable steps to.minimize or prevent any discharge in-'
• , violation-of the Permit which has.a reasonable likelihood of adversely affecting human-
' health,the MSD Treatment Plant,the French Broad River,or the environment.
C. General Prohibitive Standards, ,

In addition to the requirements of the Permit; the Industrial User shall comply with the

GENERAL CONDITIONS AND REQUIREMENTS ,
H. Removed Substances •
•
,Solids, sludge, filter backwash, or other pollutants removed in the course of treatment'or
control of wastewaters shall be disposed of in a mariner such as to prevent any pollutants:
from such materials from entering the sewer system.•The Industrial User is responsible for
assuring its. compliance with any requirements regarding the :generation,"treatment,
storage,: Or disposal of "Hazardous Waste" as defined _under- the Federal Resource
Conservation and,Recovery Act.
I. Upset Conditions
•
An "Upset" of.Pretreatment.Facilities means an exceptional incident in which there is an
unintentional and temporary noncompliance With.the effluent_limitations of the Permit
because,of factors beyond the reasonable control of the Industrial User. An Upset does not
include noncompliance to the extent caused by operational error, improperly designed or
• inadequate treatment facilities, lack of preventativemaintenance; or careless or improper ,
operations:
• An Upset may constitute an affirmative defense for action brought.for the-noncompliance.,:
The Industrial User has the burden of proof to provide.evid.ence and.demonstratethat none
• of the factors listed in the preceding paragraph were responsible for the noncompliance.

- The Industrial User 'shall furnish to the General Mangeror his designees, within a
reasonable time; any information.MSD,-or its designee,-or the North.Carolina Department 0

On behalf of Day International, Inc. (Flint Group),Altamont Environmental, Inc. (Altamont) is pleased to
submit the subject permit renewal application package for the continued discharge of industrial wastewater
to the Buncombe County Metropolitan Sewerage District(MSD). In conjunction with this permit renewal
application package,the Flint Group respectfully requests that the MSD review and consider the following
modifications to the existing permit:
• The Flint Group requests an increase in the existing effluent daily maximum limit for toluene of 1.00
milligrams per liter(mg/L)at Monitoring Point (MP) 04.The facility has installed air space volatile
organic compound sensors at three locations, as follows: within the 4,000-gallon process water
treatment tank, within the small dissolved air flotation (DAF)discharge tank, and also at the final
discharge point.The sensors are connected to the central alarm system at the facility and will
immediately notify of a significant discharge of toluene.
• The Flint Group requests the elimination of the existing effluent daily maximum limit for methyl ethyl
ketone (MEK) of 1.00 mg/L at MP 04.The facility no longer utilizes MEK in bulk and has significantly
reduced its use of MEK. In 2015,the facility did not purchase or use MEK in pure form and limited
total use to approximately 2,400 gallons of a product that contains 5 percent MEK and is stored in 1-
1 gallon containers.The Flint Group anticipates this usage volume and storage trend to continue.
• The Flint Group requests an increase of the existing effluent daily maximum limit for total toxic
organics (TTO) of 2.13 mg/L at MP 04.
• The Flint Group requests permission to shut down the zinc treatment system and eliminate
monitoring for zinc at MP 04.As of December 2014,the facility has removed processes (porous rolls
and older textile operations) responsible for the generation of zinc wastewater.The facility still
utilizes several rubber compounds that contain zinc oxide; however,these compounds are not
expected to contribute zinc to the wastewater in significant concentrations.

Section 7.d of the permit renewal application requires the submittal of a list of chemicals and associated
Safety Data Sheets(SDSs)for chemicals used or stored at the facility in containers equal to or greater than
50 gallons.The subject chemical list is attached(Table 1). Due to the number of SDSs and their associated
bulk,these are provided with this permit renewal application electronically on a flash drive.
Section 7,e of the permit renewal application requests the submittal of an Accidental Discharge Control and
Countermeasure Plan, if available.As such,the Spill Prevention, Control,and Countermeasure(SPCC) Plan
and the Emergency Action Plan for the facility are attached.

5. GENERAL INSTRUCTIONS

6. GENERAL PERMIT CONDITIONS
a. A Permit issued in response to this Application/Survey is subject to all applicable provisions of the Sewer
Use Ordinance of MSD, NPDES No. NC0024911 for the operation of the Metropolitan Wastewater
Treatment Plant by MSD and all applicable State and Federal Regulations.
b. A Permit issued in response to this Application/Survey is required for construction and operation of any
industrial or commercial wastewater pretreatment facilities and/or continued operation of existing
wastewater pretreatment facilities.
c. This Application/Survey, a Permit issued in response to this Application/Survey and all reports or
information submitted pursuant to the requirements of such Permit must be signed and certified by an
authorized representative of the User.
d. The provisions of a Permit issued in response to this Application/Survey are severable and,if any provision
of such Permit or the Application/Survey of any provision of such Permit to any circumstances is held
invalid,the Application/Survey of such provision to other circumstances and the remainder of such Permit
shall not be affected thereby.
e. It is the responsibility of each Industrial or Commercial User to insure that all sludges generated by the
User of a Permit issued in response to this Application/Survey, are managed under applicable sludge
management requirements specified in all applicable State and Federal regulations.
f. Notice is hereby given that any Old all significant violations of provisions of the Sewer Use Ordinance of
MSD by the User of a Permit issied in response to this Application/Survey or any other Users of the MSD
Sewerage System and a list of resulting enforcement actions taken by MSD will be published each year in
the local newspaper. For the purpose of this Section, a "significant violation" shall be as defined in
Subsection 1.03.68 of the Sewer Use Ordinance of MSD.
