Our intentions are to send all documents by the June 15th deadline. I am enclosing with this letter thirteen signed copies of SIU permits, permit rationale and applications. In all, of the 20 permitted Sills only six permits remain outstanding. We take this matter very seriously and will conduct a thorough investigation on how this normal administrative process could have been overlooked. And rest assured that follow up measures will be taken to make sure this will not happen again. In the meantime, please direct all future correspondence to my direct attention. I. Upset Conditions • An "Upset" of.Pretreatment.Facilities means an exceptional incident in which there is an unintentional and temporary noncompliance With.the effluent_limitations of the Permit because,of factors beyond the reasonable control of the Industrial User. An Upset does not include noncompliance to the extent caused by operational error, improperly designed or • inadequate treatment facilities, lack of preventativemaintenance; or careless or improper , operations: • An Upset may constitute an affirmative defense for action brought.for the-noncompliance.,: The Industrial User has the burden of proof to provide.evid.ence and.demonstratethat none • of the factors listed in the preceding paragraph were responsible for the noncompliance. J Toxic Pollutants • If a toxiceffluent,standard or prohibition (including any schedule of compliance specified . • • insucheffluent standard or prohibition) is established under:Section 307(a),of.the Federal . Clean Water Act or North.Carolina General-Statutes 143-215.1 for a Toxic Pollutant which .. is present in the discharge and such standard or prohibition is more stringent than any limitation for .such pollutant in the Permit, the Permit may be revised or modified in _ - -'accordance with thetoxic effluent standard or:prohibition: - • ' K Accidental Discharges and Slug Loads The Industrial User shall provide protection from accidental and slug discharges of prohibited materials'or other substances regulatedby the Permit . • _ • 1. Such protection shall ude, but is not limited to; the construction of containment • • dikes,the rerouting of -floor chains in the manufacturing area to a holding area,-and • the'plugging of floor airs. In conjunction with this permit renewal application package,the Flint Group respectfully requests that the MSD review and consider the following modifications to the existing permit: • The Flint Group requests an increase in the existing effluent daily maximum limit for toluene of 1.00 milligrams per liter(mg/L)at Monitoring Point (MP) 04.The facility has installed air space volatile organic compound sensors at three locations, as follows: within the 4,000-gallon process water treatment tank, within the small dissolved air flotation (DAF)discharge tank, and also at the final discharge point.The sensors are connected to the central alarm system at the facility and will immediately notify of a significant discharge of toluene. • The Flint Group requests the elimination of the existing effluent daily maximum limit for methyl ethyl ketone (MEK) of 1.00 mg/L at MP 04.The facility no longer utilizes MEK in bulk and has significantly reduced its use of MEK. In 2015,the facility did not purchase or use MEK in pure form and limited total use to approximately 2,400 gallons of a product that contains 5 percent MEK and is stored in 1- 1 gallon containers.The Flint Group anticipates this usage volume and storage trend to continue. • The Flint Group requests an increase of the existing effluent daily maximum limit for total toxic organics (TTO) of 2.13 mg/L at MP 04. • The Flint Group requests permission to shut down the zinc treatment system and eliminate monitoring for zinc at MP 04.As of December 2014,the facility has removed processes (porous rolls and older textile operations) responsible for the generation of zinc wastewater.The facility still utilizes several rubber compounds that contain zinc oxide; however,these compounds are not expected to contribute zinc to the wastewater in significant concentrations.
