Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has .not acted on the request by October 7, 1985, the District Engineer will deem that waiver has occurred. C. 27889 Dear Mr. Gossett: I am writing in response to your letter of July 1, 1985 in which you asked what limitations, if any, will be placed on reef construction, or on boating within the restricted area off of Harvey's Point where one of our proposed artificial fishing reefs is to be constructed. I have spoken with Ralph Barr fran the Harvey Point military installation and with Harry Mann who is in charge of the Dare County Target Canplex. Both men stated . that their activities would not interfere with boating or reef construction at all. The restricted area restricts air activity only. Boats can operate at all times within the restricted area. If you need more information Mr. Mann stated that he would be glad to furnish a letter to that effect. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized reefs. The activity will not cause an unacceptable interference with navigation. b. A minimum vertical clearance of 7 feet will be maintained between the top of the reefs and the normal low water elevations. c. Material used to construct the reefs will be clean and free of organic materials and petroleum products. d. The artificial reefs will be identified and marked as prescibed by the United States Coast Guard. Installation and maintenance of buoys will be at the permittee's expense. F a4 ...,.,t. -2- e. Each buoy will be anchored by use of a tractor tire filled with concrete. Buoys will be five (5) feet in length and ten (10) inches in diameter with three (3) feet of the buoy above the water line. The Application provides adequate assurance that the discharge of fill material into the waters of Albemarle Sound and Perquimans River in conjunction with the proposed artificial fishing reefs in Perquimans County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner ,as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That only clean concrete rubble and steel from the Highway 32 Bridge shall be used in constructing the reefs. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 16th day of September, 1985. Y, Environmental settin The applicant is proposing to construct an artificial fishing reef in two locations in Penquimans County. Site A will be located in the Albemarle Sound in the Restricted Area off of Harveys point in approximately 17' of water; Site B will be, located in the Perquimans River off of Grassy Point in approximately 12' of water. Project proposal The applicant is proposing to construct two artificial fishing reefs with concrete materials from the demolition of the N.C. 32 Albemarle Sound Bridge. Each reef will be 440' in length and 100' in width. A water clearance of 7' will be maintained above the top of each reef. I have spoken with Ralph Barr fran the Harvey Point military installation and with Harry Mann who is in charge of the Dare County Target Canplex. Both men stated that their activities would not interfere with boating or reef constriction at all. The restricted area restricts air activity only. Boats can operate at all times within the restricted area. If you need more information Mr. Mann stated that he would be glad to furnish a letter to that effect.
