In keeping with your request, this office has circulated to interested
state review agencies U.S. Army Corps of Engineers Public Notice ...
0072 dated December 27, 1984 which describes a project proposed by Mr.
Reid A. Page and Ms. Mary Ann Page of Pinehurst. The project, involving
wetland fill for the purpose of access road improvements, is located
at Aberdeen Creek near Southern Pines in Moore County.
Based on a coordinated agency review, the state interposes no objection
to the proposal provided the following recommendations submitted by the
N. C. Wildlife Resources Commission are made a part of the requested
permit:
(1) The road width is expanded on high ground on the applicants' property
at any or all points feasible to provide safe vehicular passage;
(2) The road remain at its current width adjacent to wetlands and fill
utilized only to the extent necessary to expand passing sections
to a reasonable and safe length.
Further, it is recommended that measures be taken to prevent erosion
and sedimentation to the adjacent areas. It is recommended that silt
fencing or other temporary erosion control measures be installed during
the placement of the fill. Also, immediately following the placement
of the material, a permanent vegetative ground cover should be established.

THIS CERTIFICATION is issued in conformity with.the requirements of Section
401 Public Laws 92-500 and 95-217 of.the United States and subject to.the North
Carolina Division of Environmental Management Regulations in 15 NCAC.2H,.Section
.0500 to Reid and Mary Ann Page pursuant to an application filed on the 3rd day of
December 1984 to place fill.material in wetlands associated with the widening of
an access road.
The application provides adequate assurance.that.the discharge of fill material
into a wetlands area adjacent to the waters of Aberdeen Creek and Devil's Gut in
conjunction with the proposed access road widening in Moore County will not result
in a violation of applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that.this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and-Pl 95-217 if conducted in accord-
ance with the application and condition hereinafter set forth.
Condition of Certification:
-That the instream turbidity.not be.increased by more than 50 NTU's as a
result of the proposed activity after a reasonable opportunity for dilution
and mixture.
Violations of any condition herein set forth shall result in revocation of this
Certification.
This Certification.shall become null and void unless.the above condition is made
a condition of the Federal Permit.

Moore County
The subject project involves the filling of wetlands adjacent to
Aberdeen Creek and Devils Gut, just upstream of Watson Lake in Moore County.
This filling operation is for the purpose of.widening an existing 15 foot access
road to a width of 35-40 feet. This will involve the placement of a double
culvert (size not indicated) in the lowest part of the fill area. Two separate
sections of roadway cross wetland areas, one approximately 200 feet long and
the other 110 feet long. Approximately 1200 cubic yards of sand and gravel
fill material will be used in this project. No excavation of wetland material
is indicated. This construction is as follows:

Erosion control measures have not been addressed. However, it is

a reasonable opportunity for dilution and mixture.
If additional information or clarification is required, please
advise.

a Department of the Army permit TO PLACE FILL MATERIALS IN WETLANDS ADJACENT TO ABERCE EN CREEK, DEVIL'S GUT, CFF
LAKE WATSON, ASSOCIATED WITH WIDENING AN ACCESS ROAD, NEAR SOUTHERN PINES, in Moore County, North Carolina.
The faIIow Ing description of the work is taken from data provided by the applicant and from observations
made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application
show proposed construction to widen an existing 15-foot-wide access road to 35 feet. Two wetland areas are
crossed by the road, one approximately 110 feet wide and the other approximately 200 feet across. Approximately
1,200 cubic yards of sand and gravel, obtained from local pits, Is to be placed by front-end loader to widen the
road. A double culvert is to be placed In the lower of the two areas. The purpose of the work is to provide
safe, adequate access to a commercial business. Plans showing the proposed work are included with this public
notice.
The State of North Carolina will review this public notice to determine the need for the applicant to
obtain any required State auth?rizatlon. No Department of the Army permit will be Issued until the
coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a
Department of the Army permit be Issued until the N. C. Office of Environmental Management has determined the
applicability of a Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344).
Any person may request, in writing within the comment period specified In the notice, that a public hearing be
held to consider this application. Requests for pubic hearing shall state, with particularity, the reasons
for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of Historic -
Places for the presence or absence of registered properties, or properties listed as being eligible for
Inclusion therein, and this worksite is not registered property or property listed as being eligible for
inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource
investigations by the District Engineer, and he Is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work
under the requested permit.
The District Engineer has determined, based on a review of data furnished by the applicant and onsite
observations, that the activity wll I not affect species, or their critical habitat, desigiated as endangered or
threatened pursuant to the Endangered Species Act of 1973.

been obtained or waived.
