Dear Permittee:
The North Carolina Division of Water Resources completed a review of the 2017 Annual Report for the City of
Morganton’s Distribution of Class A Residuals (DCAR) on April 25, 2018. This inspection was conducted to verify
that the facility is operating in compliance with the conditions and limitations specified in Non-discharge Permit No.
WQ0002127. A summary of the findings and comments noted during the inspection are provided in the enclosed
copy of the inspection report.
The following violation was noted during the inspection:

Record Keeping The Residuals Source - Generating Facility monitoring (TCLP, Nutrients, Metals) was not done
for the permit cycle March 13, 2009 - February 29, 2018. _________________________________________________________________________________________________________________________________________________________________________
Corrective Action:
The Residuals Source – Generating Facility monitoring should be completed within 90 days of receipt of this Notice.
The Asheville Regional Office should be notified when the analyses are complete.
A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility’s Non-discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or

fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss
overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of
your response will be considered along with any additional information provided. You will then be notified of any
civil penalties that may be assessed regarding the violations. If no response is received in this Office
within the 10-day period, a civil penalty assessment may be prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law

Inspection Summary:
The Annual Report review was conducted by Beverly Price of the Asheville Regional Office.
The report narrative indicates that 723 dry tons of residuals were distributed in 2017.
The Residuals Source - Generating Facility monitoring is required once per permit cycle for TCLP, nutrients and metals.
This monitoring was not done for the permit cyce March 13, 2009 - February 28, 2018. A Notice of Violation/Intent to
Enforce will be issued.
The Class A residuals nutrient/metals analyses were performed according to permit requirements. The metals results
appeared to be within the ceiling concentration and monthly average concentration permit limits. The once/permit cycle
monitoring for Class A residuals for TCLP was done 2010.
Pathogen and Vector Attraction Reduction is accomplished using the Fecal Coliform Density Test and a Process to Further
Reduce Pathogens (Composting) and Option 5 (Aerobic Processes Greater than 40 degrees C). Time & temperature
requirements appeared to have been met.
