CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section
401 Public Laws 92-500 and 95-217 of the United States and subject to the North
Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section
.0500 to Wildlife Resources Commission pursuant to an application filed on the
11th day of April, 1985 to make improvements and expansion of the Sunset Harbor
access area.
The application provides adequate assurance that the discharge of fill mat-
erial into the waters of Lockwood Folly River in conjunction with the proposed
boat ramp construction bulkheading and parking lot surfacing in Brunswick County
will not result in a violation of applicable Water Quality Standards and dis-
charge guidelines. Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL
95-217 if conducted in accordance with the application and conditions herein-
after set forth.
Condition(s) of Certification:
rf
1. That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases such that the turbidity in the stream is
25 NTU's or less are not considered significant).
2. That the concrete for the boat ramp construction must be poured in com-
pletely dewatered forms.
3. That all gravel for the parking areas must be constructed and located
in such a manner as to provide a 30-foot grassed buffer between the
parking area and the mean high water contour.
Violations of any condition herein set forth shall result in revocation of
this Certification.
This Certification shall become null and void unless the above condition(s)
are made conditions of the Federal Permit(s).

The N. C. Wildlife Resources Commission proposes to improve and expand
the existing access area at Sunset Harbor by constructing twin concrete
boat ramps, bulkheads, and surfacing a i acre parking area with gravel.
The access area is located adjacent to the Lockwood Folly River, classified SA.
The proposed project has been reviewed to determine impacts on water
quality. The following comments are provided:
1. A 401 certification will be required for the proposed project.
2. It is recommended that the following conditions be included
. in the certification:
(a) all gravel for parking areas must be constructed and
located in such a manner as to provide a 30' grassed
buffer between the parking area and the mean high water
contour.
(b) concrete for boat ramp construction must be poured into
completely dewatered forms.
(c) instream turbidity shall not exceed 25 NTU, due to
project activity
3. It is anticipated that once the project has been completed, that
water quality will not be adversely impacted beyond existing conditions.

8. Project summary The Wildlife Resources Commission proposes to construct and improve he
existing access area at Sunset Harbor into twin 12' wide by 20' long concrete boat ramps.
Two 60' retaining walls will also be constructed.

9. PROJECT DESCRIPTION:
The project site is located at Sunset Harbor at the end of S.R. 1112 along the
Lockwood Folly River. The existing wildlife ramp has a gravel and dirt parking
area which exten;',s back to the intersection of Riverview Drive and Lockwood Folly
Drive in.Sunset Harbor. The ramp is near the AIWW also. The existing ramp has
broken concrete and riprap scattered along its slope. It is also irregularly
sloped and is eroded. No marsh is found around its perimeter. The intertidal
bottom is comprised of fine sand, shell and silt.
The applicants desire to replace the existing ramp with.twin 12' wide by 20' long
concrete slabs containing 9 cubic yards. Two 60' long wooden retaining walls will
be installed along the edges of the ramp. The bulkheads will be capped with 3'
wide decking for docks.. Approximately 130 cubic yards of intertidal bottom around
the base of the ramps and bank will be excavated and reshaped. The broken concrete
at the waterward end of the existing ramp will be removed from the site. The 2 acre
parking lot will be topdressed with 4" of gravel.
LO. ANTICIPATED IMPACTS:
The project as proposed has few negative impacts associated with it. The site has
an existing ramp that historically has been used for boating access to both the
Lockwood Folly River and the AIWW. The 1,920 s.f. bottom is disturbed at this ramp
and the additional 12' expansion is not significant. Turbidity impacts are antici-
pated during the excavation work but they would be minimized if excavation work is
only carried out during ebb tides. The need for another ramp at this location has
been demonstrated and its completion should satisfy a goal in the Brunswick County
Land Use Plan.

at end of SR 1112 as requested in the permit tee's application dated 414/85 including
attached plats, 2, sheets 1 and 2 of 2, existing ramp, dated rec. 4/11_/85 and proposed
ramp, dated revised 3/13/85.
This permit, issued on S' Z.-Z -a 5 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The bulkhead alignment will approximate the mean high water level.
(2) All backfill material will be obtained from a highground source and confined
behind the permitted bulkhead.
(3) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated
on the plat.
(4) All excavated materials will be confined above mean-high water and landward
of regularly or. irregularly flooded marsh behind adequte dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(5) The excavation work will be carried out by dragline only during ebb tides.
.NOTE: A Section 401 Water Quality Certification is required for this project
and is being processed by the Division of Environmental Management.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site. to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit -expires on
December 31. 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Pursuant to NCGS 113A-119(b) and 143-215 3(a)(1)(c), the Depart-Lient of
Natural Resources and Community Development hereby gives Public Notice
that NC WILDLIFE RESOURCES COMMISSION
filed an application on APRIL 17, 1985 for a permit from the
Office of Coastal Management to develop in an Area of Enuironmex_tal
Concern and for Certification from the Division of Environmental
Management that a discharge of fill material in project wetlands will
not violate applicable Water Quality Standards.
According to said application, NC WILDLIFE RESOURCES COMM. proposes to
CONSTRUCT AND IMPROVE THE EXISTING ACCESS AREA AT SUNSET HARBOR INTO
TWIN 12' WIDE BY O' LONG CONCRETE BOAT RAMPS. TWO 60' RETAINING WALLS
WILL ALSO BE CONSTRUCTED. PROJECT IS LOCATED AT SUNSET HARBOR
WILDLIFE RAMP AT THE END OF S.R. 1112 ALONG LOCKWOOD FOLLY RIVER.
A copy of the entire application and additional information may be
examined (or copies furnished, upon payment of reproduction costs) during
normal business hours at the Office of Coastal Management and/or the
Division of Environmental Management, Regional Office, 7225 Wrightsville
Avenue, Wilmington, North Carolina 28403.
