This permit, issued on 3- Z / ' 96 -,is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile fish populations, spawning anadromous fish
• and water quality, no excavation or filling may be carried out within the
waters of Symonds Creek from March 1 - August 30 of any years without prior
approval of the Division of Coastal Management.
(2) All excavated material must be trucked to a highground disposal site and
not allowed to enter adjacent wooded wetlands or waters of Symonds Creek.
(3) All disturbed areas must be revegetated as construction is completed. Silt
fencing and other temporary erosion control devices must remain in place
until a permanent ground cover is established.
(4) The activity must be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction-related
discharge (increases such that the turbidity in the Stream is 50 NTus or
less are not considered significant).
NOTE: This project must be carried out in compliance with the rules and regulations
of the N. C. Sedimentation Pollution Control Act.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to N.C. Department of
Transportation pursuant to an application filed on the 8th day of
October, 1985 to construct a culvert crossing of Symonds Creek.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Symonds
Creek in conjunction with the proposed culvert crossing in Pasquotank
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
condition is made a condition of the Federal Permit.

PERMIT AND WATER QUALITY CERTIFICATION
Pursuant to NCGS 113A-119(b) and 143-215 3(a)(1)(c), the Department of
Natural Resources and Community Development hereby gives Public Notice that,
NORTH CAROLINA DEPARTMENT OFi TRANSPORTATION filed an appli-
cation on nctobi?r 10, 19a5 for a. permit from the Division of Coastal
Management to develop in an Area of Environmental Concern and for Certification from
the Division of Environmental Management that a discharge of fill material in
project wetlands will not violate applicable Water Quality Standards.
According to said application, applicant proposes to replace the
bridge over Symonds Creek in P'asquotank County with three (3)
steel culverts.
A copy of the entire application and additional information may be examined
(or copies furnished, upon payment of.reproduction costs) during normal business
hours at the office of LuAnn Bryan Division of Coastal Manage-
ment, 108 South Water Street, Elizabeth City, NC 27909 and/or the Division of

SITE DESCRIPTION
The applicant proposes to replace Bridge #56 located over Symonds Creek
on SR 1182. The existing bridge does not allow boatists to pass underneath,
yet the creek is navigable on both sides of the-bridge. The bridge is bordered
on either sides by wooded swamp, with such species as cypress, typa, pickle
weed and other such species.
The applicant-proposes to replace the existing bridge with three (3) 60"
X 46" corrugated steel pipe arch culverts. This project will result in the
filling of 275 cubic yards below N.W.L.
ANTICIPATED IMPACTS
The proposed project will result in the filling of 2000 square feet of
creek bottom below N.W.L. This will result in 365 cubic yards of fill, with
275 of these cubic yards being below N.W.L.
This area has been determined by the North Carolina Division of Marine
FisheriPS to bP a Spawning area for river herring The culverts could slow the
spawning process, with observations during studies conducted on river herring
spawning showing that fish will wait in front of a culvert, and only pass through
it when the sun is in a certain position. Therefore, the culvert could be
detrimental to the river herring spawning.
