DOCUMENTED CATEX ARP SOP No. 5.1 Airport sponsors may use this form for projects eligible far a categorical exclusion (CATEX) that have greater potential for extraordinary circumstances or that otherwise require additional documentation, as described in the Environmental Orders (FAA Order 1050.1 F and FAA Order 5050.4B). To request a CATEX determination from the FAA, the sponsor should review potentially affected environmental resources, review the requirements of the applicable special purpose laws, and consult with the Airports District Office or Regional Airports Division Office staff about the type of information needed. The form and supporting documentation should be completed in accordance with the provisions of FAA Order 5050.4B, paragraph 302b, and submitted to the appropriate FAA Airports District/Division Office. The CATEX cannot be approved until all information/documentation is received and all requirements have been fulfilled. Name of Airport, LOC ID, and location: Ralcigh Exccutive Jetport (TTA), Lee County, NC (refer to Figure ]) Project Title: North Terminal Development and Sanitary Sewer Extension Give a brief, but complete description of the proposed project, including all project components, justification, estimated start date, and duration of the project. Include connected actions necessary to implement the proposed project (including but not limited to moving NAVAIDs, change in flight procedures, haul routes, new material or expanded material sources, staging or disposal areas). Attach a sketch or plan of the proposed project. Photos can also be helpful. Thc proposcd projcct consists of thc dcvclopmcnt of an arca to thc north of thc cxisting hangar arca, including the construction of hangars, aircraft parking apron, vehicle parking areas, taxiway connector, and associated stormwater improvements. The proposed project also includes a 4,500 linear foot extension of 12-inch steel encased PVC sanitary sewer line. The approximate project study area is shown on Figure 2. Details far the Terminal Development are shown on Figure 3 and details for the sewer line are shown on Figure 4. The improvements are needed to satisfy a growing demand for corporate hangar space at the Airport. These corporate tenants will also result in job growth for the Airport and the surrounding community. Photos of the project study area are included in Appendix A. Give a brief, but complete, description of the proposed project area. Include any unique or natural features within or surrounding airport property. The 48-acre project study area consists of the existing maintained Airport Operations Area (AOA). This area is maintained and kept in a grassed state. A portion (approximately 9.0 acres) of the project study area is forested with pine species and contains an 0.62-acre of wetland and 137.5 linear feet of stream. The project study area also includes the existing hangar areas and associated impervious surface. A-1 Effective Date: June 2, 2017 ARP SOP No. 5.1 Identify the appropriate CATEX paragraph(s) from Order 1050.1F (paragraph 5-6.1 through 5-6.6) or 5050.4B (Tables 6-1 and 6-2) that apply to the project. Describe if the project differs in any way from the specific language of the CATEX or examples given as described in the Order. Under Order 1050.1F, project would be covered under Section 5-6.4(�. Under Order 5050.4B project would be covered under, Airfield improvements, storage areas (Table 6-2 — 31 Ofj. The circumstances one must consider when documenting a CATEX are listed below along with each of the impact categaries related to the circumstance. Use FAA Environmental Orders 1050.1F, 5050.4B, and the Desk Reference for Airports Actions, as well as other guidance documents to assist you in determining what information needs to be provided about these resource topics to address potential impacts. Keep in mind that both construction and operational impacts must be included. Indicate whether or not there would be any effects under the particular resource topic and, if needed, cite available references to support these conclusions. Additional analyses and inventories can be attached or cited as needed. 5-2.b(1) National Historic Preservation Act (NHPA) resources YES NO Are there historic/cultural resources listed (ar eligible far listing) on the National X Register of Historic Places located in the Area of Potential Effect? If yes, provide a record of the historic and/or cultural resources located therein and check with your local Airports Division/District Office to determine if a Section 106 iinding is required. No historic/cultural resources listed or eligible for listing on the National Register of Historic Places are located in the Area of Potential Effect. The State Historic Preservation Office (SHPO) had 'No Comment' on the proposed project (refer to Appcndix B). Does the project have the potential to cause effects? Is the project area undisturbed? Consultation with their THPO or a tribal representative along with the SHPO may be required. The project will not impact tribal land. Ground Disturbancc would occur within cxisting Airport property. This includes publicly owned parks, recreation areas, and wildlife or waterfowl refuges of national, state or local significance or land from a historic site of national, state or local significance. The proposed project would occur entirely within existing Airport property and no Scction 6(f) resources are present. 5-2.b(3) Threatened or Endangered Species YES NO Are there any federal or state listed endangered, threatened, or candidate species or X designated critical habitat in ar near the proj ect area? This includes species protected by individual statute, such as the Bald Eagle. According to North Carolina Natural Hcritage Preserve (NCNHP) Data thcrc arc no known occurrences of federal or state listed species within the project study area. Does the project affect or have the potential to affect, directly or indirectly, any federal X or state-listed, threatened, endangered or candidate species, or designated habitat under the Endangered Species Act? If yes, Section 7 consultation between the FAA and the US Fish & Wildlife Service, National Marine Fisheries Service, and/or the appropriate state agency will be necessary. Provide a description of the impacts and how impacts will be avoided, minimized, or mitigated. Provide the Biological Assessment and Biological Opinion, if required. Based on available data (aerial mapping, USGS Topographic Mapping, Soil Survey Data, NCNHP Elemental Occurrence Database, USFWS/NCNHP Habitat descriptions), and field reviews, habitat for federal and/or state listed species is not present within the foot rint of the ro osed ro'ect. A-3 Effective Date: June 2, 2017 Federally listed species taken into consideration include: • Cape fear shiner (Notropis mekistocholas); • Red-cockaded woodpecker (Picoicles horecrlis); and, • Harperella (Ptilimnium nodosum). ARP SOP No. 5.1 For the Cape Fear shiner and harperella, streams identified within the project study area do not provide habitat for these species. Therefore, the implementation of the proposcd project would have No Effect on these species. Suitable habitat for the red-cockaded woodpecicer is not present within the project study area. The maj ority of the study area has been harvested for timber within the past twenty years, eliminating any 70-80 year old pine forest habitat that may have existed. Therefare, since habitat is not present, the implcmcntation of thc proposcd proj cct would have No Effect on red-cockaded woodpecker. The USFWS has concurred with this determination (refer to Appendix B). The USFWS and North Carolina Wildlife Resources Commission (NCWRC) (refer to AppendiX B) made specific comments in regard to impacts on aquatic species and water quality. The USFWS recommended the implementation of stringent sediment and erosion control measures and that sedimentation controls be installed between construction sitc and down gradient waters. The NCWRC and USFWS also recommended maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site, utilizing Low Impact Development Techniques, utilizing native species for re- seeding, restricting the use of insecticides/herbicides near water resources, and utilizing wildlife friendly best management practices. NCWRC and USFWS also encouraged the use of the NCWRC Guidance Memarandum to Address and Mitigate Secondary and Cumulative Impacts to Aquatic and Terrestrial Wildlife Resources and Water Quality. The proposed project requires a North Carolina Division of Environmental Quality (NCDEQ) approved Sediment and Erosion Control Plan, which would ensure that the proposed project n�eets all fcdcral, statc, and local watcr quality rcquircmcnts. YESI NO Does the project have the potential to take birds protected by the Migratory Bird X Treaty Act? Describe steps to avoid, minimize, or mitigate impacts (such as timing windows determined in consultation with the US Fish & Wildlife Service). Approximatcly 9.0 acres of cicaring would bc rcquircd within thc projcct study arca. However, comparable habitat is abundant in adjacent areas for any potential displacements. If live nests are encountered during construction, the contractor will notify FAA/NCDOT to determine if coordination with USFWS is required. A-4 Effective Date: June 2, 2017 5-2.b (4) Other Resources Items to consider include: ARP SOP No. 5.1 a. Fish and Wildlife Coordination Act YES NO Does the project area contain resources protected by the Fish and Wildlife X Coardination Act? If yes, describe any impacts and steps taken to avoid, minimize, or mitigate impacts. Wetlands and Other Waters of the U.S. YES NO Are there any wetlands or other waters of the U.S. in or near the project area? X Jurisdictional arcas arc prescnt within thc projcct study arca (rcficr to Figures 2 and 3). Has wetland delineation been completed within the proposed project area? If yes, X please provide U.S. Army Corps of Engineers (USACE) correspondence and jurisdictional determination. If delineation was not completed, was a field check done to confirm the presence/absence of wetlands or other waters of the U.S.? If no to both, please explain what methods were used to determine the presence/absence of wetlands. A wetland delineation was completed and a Jurisdictional Deterinination was issued by thc USACE on June 10, 2009 (refer to Appendix C). The project study area was reassessed February 13, 2018, and an updated Jurisdictional Determination was submitted to the USACE. Approval is pending; however, the USACE indicated that since thc updated delineation was similar in nature to the previous delineation, no additional review was required (refer to email correspondence in Appcndix C). Thc NCDEQ also concurrcd with deterinination (refer to Appendix C). If wetlands are present, will the project result in impacts, directly or indirectly X (including tree clearing)? Describe any steps taken to avoid, minimize or mitigate the impact. Approximatcly 0.62-acrc of wctland and 137.5 lincar fcct of strcam would bc iinpactcd by the proposed project. Due to the linear nature of the proposed project and the location of the wetlands/streams, total avoidance was not feasiblc. It is anticipated that mitigation would be purchased from thc North Carolina Dcpartmcnt of Mitigation Services, In-Lieu Fee Program. Is a USACE Clean Water Act Section 404 permit required? If yes, does the project X fall within the parameters of a general permit? If so, which general permit? A Section 404 permit (Nationwide 23) would be utilized for the proposed project. A-5 Effective Date: June 2, 2017 ARP SOP No. 5.1 c. Floodplains YES NO Will the project be located in, encroach upon or otherwise impact a floodplain? If yes, X describe impacts and any agency coordination or public review completed including coordination with the local floodplain administrator. Attach the FEMA map if applicable and any documentation. Farmland YES NO Is there prime, unique, state, or locally important farmland in/near the project area? X Describe any significant impacts from the project. No farmland is prescnt with thc projcct study arca, which occurs within cxisting Aitport property. The Natural Resources Conservation Service (NRCS) has concurred with this determination (refer to Appendix C) Does the project include the acquisition and conversion of farmland? If farmland will X be converted, describe coordination with the US Natural Resources Conservation and attach the completed Form AD-1006. Wild and Scenic Rivers YES NO Is there a river on the Nationwide Rivers Inventory, a designated river in the National X System, or river under State jurisdiction (including study or eligible segments) near the project? No Wild and Scenic Rivers are found within or near the project study area (http://www.rivers.gov/maps/conus.php). Solid Waste Management YES NO Does the project (either the construction activity or the completed, operational X facility) have the potential to generate significant levels of solid waste? If so, discuss how these will be managed. Soine construction debris would lilcely be generated as the result of the construction of the hangars; however, the amount of debris would not be expected to be significant. The contractor would be required to remove all construction debris from the Airport and dispose of it properly in a permitted facility. Once the new hangars are operational, any solid waste that would be generated would be similar in kind and amount as the existing facilitics. 5-2.b(5) Disruption of an Established Community YES NO Will the project disrupt a community, planned development or be inconsistent with X plans or goals of the community? The proposed project is located on the existing Airport property and no other property would bc rcquircd. Are residents or businesses being relocated as part of the project? Will the project cause a change in airfield configuration, runway use, or flight X patterns either during construction or after the project is implemented? The Proposed Action would not modify runway or flight patterns. The sewer line would bc borcd undcr thc runway (rcfcr to Figurc 4). Does the forecast exceed 90,000 annual propeller operations, 700 annual jet operations X or 10 daily helicopter operations or a combination of the above? If yes, a noise analysis may be required if the project would result in a change in operations. Based on FAA Order 1050.1F, a noise analysis does not need to be conducted for the proposed project if the farecasted airport operations are (1) less than 90,000 annual or 247 average daily, piston-powered aircraft (Design Group I and II) operations in Approach Categories A through D that have a landing speed of less than 166 knots; or, (2) there are less than 700 annual, or two average daily, jet- powered aircraft operations that occur at the Airport. Based on review of the FAA's 2017 Terminal Area Farecast, a total of 63,000 annual operations (per year) are anticipated at TTA for each year of the upcoming 12-year period. Has a noise analysis been conducted, including but not limited to generated noise X contours, a specific point analysis, area equivalent method analysis, or other screening method. A-9 Effective Date: June 2, 2017 ARP SOP No. 5.1 5-2.b(9) Air Quality YES NO Is the project located in a Clean Air Act non-attainment or maintenance area? X Lee County is not listed by the USEPA as either non-attainment, or inaintenance. If yes, is it listed as exempt, presumed to conform or will emissions (including construction emissions) from the project be below de minimis levels (provide the paragraph citation for the exemption ar presumed to conform list below, if applicable) Is the project accounted for in the State Implementation Plan or specifically exempted? Attach documentation. Not applicable. Does the project have the potential to increase landside or airside capacity, X including an increase of surface vehicles? The construction of the hangars would result in additional hangar capacity; however, the four additional hangars would not result in a significant increase in operations. Since thc proposed project is within an attainment area and is not anticipated to have a significant increase in operations, per the FAA Aviation Emissions and Air Quality Handbook, a detailed Quantitative Air Quality Analysis was not completed for the proposed project. Could the project impact air quality or violate local, State, Tribal or Federal air X quality standards under the Clean Air Act Amendments of 1990 either during construction or operations? As stated above, thc proposcd projcct is in an attainmcnt arca. 5-2.b (10) Water Quality YES NO Are there water resources within or near the project area? These include groundwater, X surface water (lakes, rivers, etc.), sole source aquifers, and public water supply. If yes, provide a description of the resource, including the location (distance from project site, etc.). There are is one stream channel (unnamed tributary to Wombles Creek) and one wetland system within the project study area. According the North Carolina Division of Environmental Quality, Wombles Creek is classified as WS-IV, which indicates that it is related to a public water supply. Using the EPA's NEPAssit program, no sole sourcc aquifers appear to be present within, or near the project study area. Will the project impact any of the identified water resources either during construction X or operations? Describe any steps that will be taken to protect water resources during and after construction. To minimize temporary impacts to water quality, the contractor would be required to comply with erosion and sediment control measures as specified in FAA Advisory Circular (AC) 150/5370-10 entitled Standards for Specifying Construction of Airports, and specifically Item P-156 Temporary Air and Water Pollution, Soil Erosion, and Siltation Control. The effects of an action are considered highly controversial when reasonable disagreement exists over the project's risks of causing environmental harm. Mere opposition to a project is not sufficient to be considered highly controversial on environmental grounds. Opposition on environmental grounds by a federal, state, or local government agency ar by a tribe or a substantial number of the persons affected by the action should be considered in determining whether or not reasonable disagreement exists regarding the effects of a proposed action. Based on review of the USEPA NEPAssist website (including RCRA, air einissions, water dischargers, toxic releases, Superfund, and Brownfields databases), no 1<nown hazardous substances or sites were identified on, or adjacent to, the Airport. In addition, the NCDEQ Federal Remediation Branch indicated that no known federal rcmcdiation sitcs arc within 1.0-milc of thc projcct study arca (rcfcr to Appcndix B). If the project involves land acquisition, is there a potential for this land to contain X hazardous materials or contaminants? Thc proposcd projcct would occur cntircly within cxisting Aitport property and would not require additional land acquisition. Will the proposed project produce hazardous and/or solid waste either during X construction or after? If yes, how will the additional waste be handled? Some solid waste in the form of construction debris would be expected to be produced as a result of the construction. All construction debris would bc rcmovcd from the site and disposed of properly in a permitted solid waste facility. When considered with other past, present, and reasonably foreseeable future X projects, on or off airport property and regardless of funding source, would the proposed project result in a significant cumulative impact? The construction of the Airport resulted in additional impervious surfaces. Future Airport improvements would also likely add additional impervious surface (refer to Airport Layout Drawing — AppendiX E). These additional impervious surfaces could increase thc amount of runoff into nearby surface waters. However, the Proposed Action and other future improvements impacting greater than one acre would be required to complete thc NPDES permitting process and review of the Stormwater Management Plan prior to construction. These efforts would minimize the amount of stormwater runoff entering into surface waters and result in avoidance of cumulative impacts to water quality near the Airport. Past impacts to wcflands and strcatns havc occurrcd from residcntial, commcrcial, and industrial development within and adjacent to the Airport, where wetlands have been filled, drained, or otherwise altered. In addition, natural strcarns within thc arca havc also been channelized for silviculture and agriculture. Executive Order 11990 and the CWA Section 404 process have dramatically reduced the rate of wetland loss; however, wetland loss is likely to continue. The protection of wetlands is regulated on a case-by-case basis by state and federal agencies and mitigation for permitted impacts is typically required. To fill wetlands ar other waters of the United States, a permit would have to be granted by USACE prior to construction of projects and a Section 401 Water Quality Certification from NCDEQ. Mitigation may be required for impacts, which would offset the wetland loss associated with future development proj ects. Therefore, with USACE and NCDEQ oversight as well as mitigation requirements, thc potential iinpacts to wetlands froin projects occurring in the area would be minimized. The Proposed Action is anticipated to result in approxiinately 137.5 linear feet of stream and 0.62-acre of wetland impact. In addition, future development at the Airport could potentially result in impacts to wetlands and other jurisdictional waters of the United States. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject document. Comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667e), North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; 1 NCAC 25) and North Carolina General Statutes (G.S. 113-131 et seq.). The Sanford-Lee County Regional Airport Autharity proposes to develop an area north of the existing terminal of the Raleigh Executive Jetport. Construction would include hangars, aircraft aprons, a taxiway connector, a taYilane and associated stormwater improvements. The Jetport is located approximately seven miles northeast of Sanford. Aerial maps and images indicate a tributary to Wombles Creek flows directly north of the proposed development. There aze records for the following rare aquatic species downstream of the project site in the Cape Fear River: the federal species of concern and state-endangered, yellow lampmussel (Lampsilis cariosa); the federal species of concern and state-threatened, Roanoke slabshell (Elliptio roanokensis); the federal species of concern and state-Watch List, Atlantic spike (Elliptio producta); and the state- tYu�eatened, eastern lampmussel (Lampsilis radiata). In addition, there are three Natural Heritage Natural Areas located downstream of the site — Cape Fear River/McKay Island Floodplain, Cape Fear RiverBuckhorn Levees and CPF/Upper Cape Fear River Aquatic Habitat. The NCWRC offers the following recommendations to minimize impacts to sensitive aquatic and terrestrial wildlife resources: 1. Maintain a minimum 100-foot undisturbed, native, forested buffer along perennial streams, and a minimum 50-foot buffer along intermittent streams and wetlands. Maintaining undisturbed, forested buffers along these areas will minimize impacts to aquatic and terrestrial wildlife resources. Wide riparian buffers are helpful in maintaining stream bank stability. In addition, these buffers provide a travel corridor for wildlife species. The project footprint should have u�pdated surveys for wetlands and streams to ensure there are no impacts to surface waters. In addition to providing wildlife habitat, wetland areas and streams aid in flood control and water quality protection. United States Army Corps of Engineers Section 404 Permits and NC Division of Water Resources Section 401 Certifications are required for any impacts to jurisdictional streams or wetlands. 3. Stormwater runoff to receiving surface waters can be minimized by reducing impervious surfaces and increasing infiltration on site using Low Impact Development (LID) techniques. LID techniques appropriate for this project may include permeable pavement and bioretention areas that can collect stormwater from parking areas. Additional alternatives include narrower roads, swales versus curbs/gutters and permeable surfaces such as turf stone, brick and cobblestone. 4. The use of non-invasive, native species is recommended. Using native species instead of ornamentals should reduce the need for water, fertilizers and pesticides. 5. If pesticides or chemicals will be used for site maintenance, stormwater runoff from the site should be funneled to bio-retention areas prior to discharge to streams or wetlands. Pesticides, fertilizers and other chemicals should not be used near streams. 6. Sediment and erosion control measures should be installed prior to any land-disturbing activity. The use of biodegradable and wildlife-friendly sediment and erosion control devices is strongly recommended. Silt fencing, fiber rolls andlor other products should have loose- weave netting that is made of natural fiber materials with movable joints between the vertical and horizontal twines. Silt fencing that has been reinforced with plastic or metal mesh should be avoided as it impedes the movement of terrestrial wildlife species. Excessive silt and sediment loads can have detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs and clogging of gills. The NCWRC encourages the applicant to consider additional measures to protect aquatic and terrestrial wildlife species in developing landscapes. A delineation of this site was verifed by the Corps of Engineers on June 10, 2009. The verification expired on June 10, 2014. Your submitted map indicate the same waters as the verifed 2009 map. We recommend that you have a qualified environmental consultant familiar with stream and wetland delineations review the previously verifed stream and wetland boundaries on site. Should you find additional jurisdictional waters located on the site that were not identified on the previous jurisdictional determination, we recommend that you provide us with a new jurisdictional determination request, with the updated supporting information (maps, routine wetland determination data sheets, etc). At this time, we do not plan to conduct a site inspection, unless you identify additional jurisdictional waters and submit an updated/new jurisdictional determination request. If the boundaries are the same as those previously verified, we recommend that you document those conditions as well, and provide it to us with a permit application/Pre-construction notification (PCN), should your project require the placement of dredged or fill material into any jurisdictional waters. However, until additional data is furnished which details the extent of the construction limits of the proposed project, we are unable to verify that the project will not have jurisdictional impacts.
