Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The new bulkhead will be constructed on or landward of the alignment of the deteriorated bulkhead. (2) All backfill material will be obtained from an upland source and confined landward of the permitted bulkhead. (3) The pier additions will be constructed in strict accordance with the dimensions shown on the attached plan view of the dock. (4) The authorized structures will be properly maintained. (5) The marina shall prominently post and enforce a locked-head policy for boats without holding tanks. (6) The marina will display a sign showing the location of the nearest pumpout facility, listing the telephone numbers of local septic tank pumping services and including other appropriate waste disposal information. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. . All work must cease when the permit expires on December 31. 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent sand blasting residue and/or other facility wastes from entering the adjacent waters. Such a discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: The project area falls within the Riverside Avenue Historic District. Should any cultural resources be encountered during ground-disturbing activities, the permittee must immediately stop work and notify the N. C. Division of Archives and History at 733-4763, the District Engineer, Wilmington Corps of Engineers at 343-4629 and the N. C. Division of Coastal Management at 338-1558. NOTE: No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized structures. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Pasquotank River in conjunction with the proposed bulkhead construction in Pasquotank County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. Attn: Mr. Bill Moore Dear Mr. Moore: FOUNDED 1903 Or The Elizabeth City Shipyard has two railways and one travel lift that we use to haul boats from the water. One railway is a 300 ton unit that you ( Mr. Moore) saw in operation some 6 months ago and commented on how well you liked the operation. The second railway is a 600 ton unit that is very similar to the 300 ton unit. The 60 ton travel lift speaks for itself. We haul vessels up to 60 feet in length with this unit and move these around the yard for what ever work is needed. When the 300 ton unit is in use the vessel is hauled out of the water and all work is done on land above the mean high water mark. We use a boom at the water's edge and enclose the vessel with curtains to contain any air or water pollutants so far as possible while working. We also spray paint and blast when needed, weather permitting. On the 600 ton lift we enclose the vessel in the same manner as on the 300 ton lift. This cradle has a deck covering the entire top of the cradle and the boat is draped to contain the paint and blast (if used) so none of this gets into the water. Before launching the sand is vacuumed up as was done on the floating dry dock. In 1980, we sat down with all the environmental groups we could to discuss the operations and maintenance of a boat yard and vessel repair. At that time each division talked about regulations with which they were concerned. Since that time, we have been very cognizant of these regulations and have done our very best to comply. (919) 338-2118 (919) 338.2878 Actually, our permit request does not seek any new lifts or railways, for these have been in place and use since around 1902 for the purpose of hauling vessels and repairing them. At such times when sand blasting and spray painting are required, we have covered the vessels so none of this material gets into the water. One thing I must state, the sand blasting procedure does not go on 365 days a year. In fact, there-are only a few days a year this particular operation is used at all. We try very hard to keep Elizabeth City Shipyard a good citizen and neighbor and work within the confines of your regulations, at the same time giving people jobs; so if you would please send us a copy of your regulations we will do our very best to follow your guidelines. Project summary The applicant proposes to construct a bulkhead, 15 dolphin, extend 2 Piers, drive 18 mooring pilings on property.located on Riverside Avenue, Elizabeth - r BID REPORT PAGE 2 HADLO CORPORATION The applicant's property is located in Elizabeth City at 722 Riverside Avenue ontthe Pasquotank River. There is an existing marina and shipyard on the property, with their associated buildings. The property is approximately 6 feet above MSL. The shipyard has been in existence since 1902, and has two marine railways that can handle vessels up to 600 tons. The Shoreline is bulkheaded except for one section, which is now dilapidated and is being proposed to be replaced at the old alignment. Mine piers can accommate approximately 100 boats, varying with size. No pump out facilites are provided, with the water classification being SC. The applicant proposes to bulkhead along the old bulkhead alignment, extending out a maximum of 12 feet and an average of 7 feet. This is a scalloped area that is currently full of old concrete blocks that were behind the old bulkhead. A portion of the old bulkhead can be seen, as shown in the plat. The applicant proposes to use sheet piling, and treated timbers to construct the bulkhead. The applicant also proposes to connect 3 new additions onto.3 existing piers for marina and marine railway use, in addition to minor repair work on the other piers. The new sections will be additions to piers # 8 & 7, thus increasing their length from 92 feet to 200 feet and from 150 feet to 204 feet respectfully. The minor repair of the other existing piers will not involve any new pilings, just the redecking of the pier. The applicant also proposes one at the end of pier # 8. The pilings between piers # 1 and # mooring pilings will increase his 18 slips.. 4 dolphin out in front of his dock, as well as applicant also prpposes to drive 18 mooring 2. This will be done by a pile driver. The marina slips for smaller boats by approximately ANTICIPATED IMPACTS The proposed project will result in the filling of 840 square feet of river bottom, with approximately 108 cubic yards of fill being required. The proposed project will result in an increase of turbidity, with the effects being localized and short term in duration. The extension of the 2 piers will make them equal with surrounding piers, and not interfer with the harbor line. The marina currently doesn't have a pump out facility located-on the property, but does have a locked head policy. However, a pump out would reduce the potential of water degradation in the area, especially with the potential increased use of the marina.
