G. Industries, Incorporated, near Forest City, Rutherford County, North Carolina. You have plans to relocate a small creek through a culvert and place fill material in the existing channel in order to expand the plant site by constructing a new building. Through contact with Mr. Jeff Richter of my staff, you were informed that while the Corps of Engineers has jurisdiction over this type of project, a nationwide permit has been issued which authorizes work in areas having a flow of less than 5 cubic feet per second provided that a 401 Water Quality Certification has been issued by the North Carolina Division of Environmental Management. This certification has been received by our office, dated May 28, 1985; therefore, your project is authorized by a nationwide permit in accordance with 33CFR Part 330.5(a). You may comnence work on this project and follow the plans previously submitted to this office. The application provides adequate assurance that the discharge of fill material into the waters of a tributary to Morrow Creek in conjunction with the proposed stream relocation in Rutherford County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North.Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the instream turbidity not be increased by more than 50 NTU's as a result of the proposed activity after a reasonable opportunity for dilution and mixture. 2. That no "live" concrete be allowed to contact stream water. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above condition(s) are made conditions of the Federal Permit. In a telephone conversation of May 6, 1985, with Mr. Cur Eckerd of Hickory Construction Company, contractor for the work, he indicated that the culvert would first be laid in a dry area, then the stream would be directed into the culvert to minimize adverse impacts from digging in an ac- tive stream. In the same conversation, Fir. Eckerd was advised to keep "live" concrete from contacting surface waters. Most of the length of the tributary on which the subject work will occur is already culverted; the proposed project will simply extend the culvert to run the length of American Greetings, Inc.'s property. The Asheville Regional staff recommends issuance of a positive 401 Certification for the Morrow Creek tributary project. /pf Public Notice of Application for Water Quality Certification The North Carolina Division of Environmental Managament of the Depart- ment of Natural Resources and Community Development has received an applica- tion from the AG Industries, Inc., 30 Pine Street, Forest City, Rutherford County, for a Water Quality Certification pursuant to Section 401 of the Federal Clean Water Acts as amended. The activity for which the Certification is sought is the relocation of a 500 foot long segment of a small tributary. to Morrow Creek near Alexander Mills. The stream will be rerouted to a culvert and approximately 300 feet of existing stream bed will be filled. The purpose of the stream relocation is to allow for the construction of an additional building for A. G. Industries, Inc. The public is invited to comment on the impact of the proposed project on water quality. A copy of the application may be inspected at the Depart- ment's office in Raleigh, Archdale Building, 512 N.
