PROJECT SUMMARY: Contingent on a contract to purchase the project proposed is to construct a 61slip marina, bath house, 18 space parking lot, boardwalk and riprap repair. Field Investigation Report: Beaufort Partners LLC Beaufort Marina Project Page 02 This project submitted an Environmental Assessment on February 3, 2009 and received the Finding of No Significant Impacts from the State Clearing House on February 19, 2009. The purpose of this project per the applicant is for access for recreational boating to the Beaufort area. 9. Narrative Description The Beaufort Marina project is located immediately east of the bridge at 103, 113 and 115 Cedar Street in Beaufort and is adjacent to Town Creek and the COE Turning Basin. The property is 1.9 acres in its entirety and is an average of 10' above NHW. A portion of the site currently has a Hardees restaurant. The vacant portion which used to house a gas station has been cleared with the exception of the parking lot and driveways. There is riprap along the shoreline along with large amounts of debris. There is a 10' x 145' fringe of coastal marsh which starts on the west side and ends 145' from the east side of the property. It is located waterward of the existing rip rap. It consists of Spartina alterniflora. The undeveloped and developed portion of the high ground is comprised mostly of grass, a few cedars, oak trees and scrub bushes. The developed portion of the high ground contains Hardees with its parking lot and driveways. The proposed development is a commercial project. There are commercial properties to the east and west of the project area. The Town of Beaufort's Land Use Plan classifies this property as Developed with all AEC's classified Conservation. Town Creek is not designated as Primary Nursery Area and is closed to the taking of shellfish. Town Creek within this area carries a water classification of SC and has a width of 1,102'. Water depths are an average of -2.88' nlw. Riparian corridors have been set to follow the existing alignment of the adjacent neighbor "Discovery Diving". Substrate is mostly silt. No SAV's or shellfish beds were observed within the proposal project area. 10. Project Description: The current proposal is for 61 slip marina, rip rap repair, parking lot, boardwalk and bath house. The applicants are proposing to construct a fixed pier marina with 57 permanent slips and four temporary side-to slips. The side-to slips would be located outside of the t-head platforms. The most western pier would start at nhw while crossing a 10' span of coastal wetlands and continuing waterward for 267'. The pier would be 8' wide and intersect a 6' x 101't- platform. There would be 27 permanent slips located within this area with two temporary side to slips located on the outer portion of the t-head. The slips would be numbered 1-27 with a total of 13 (3' x 20') finger piers and 14 tie pilings within this area. The temporary side -to slips would be numbered 60 and 61. Field Investigation Report Beaufort Partners LLC Beaufort Marina Project Page 03 The most eastern pier would extend from nhw over open water for 276' and intersect with a 6' x 85.6 t- head platform. There would be 30 slips located within this area with 15 (3' x 20') finger piers and 15 tie pilings. The inner slips would be numbered 28-57 with the two remaining outer side-to slips numbered 59 and 58. The typical boat would be less than 50'with an open runabout to larger cabin cruiser/yacht design. The marina policy would prohibit overboard discharge, no fueling and no overnight or live aboard dockage and would participate in the Clean Marina Program. The only "amenities" would be a bath house located on the high ground portion and a mobile pump out station located on the eastern dock. This station would be routinely removed by an approved contractor. The width of Town Creek in this area is 1,102'. The western pier would not extend farther than 273' waterward from the edge of the marsh and the eastern pier would not extend farther than 282' from nhw. The outermost portion of the piers and platforms would be located 215' from the 42' US Corp of Engineers Channel Setback and greater than 15' from the riparian corridors. The piers would comlect with a boardwalk that runs parallel with the shoreline. It would be 6' x 259' and would not extend past the nhw contour. The boardwalk would be located over a 240 square foot section of coastal wetlands at the west. A 6' x 45' slatted wooden access would connect the boardwalk with the bathhouse. The applicants are proposing to excavate the boat basin area with a bucket to barge method. A total of 14,745 cubic yards of material would be removed below nhw. The excavation dimensions are 325' x 350'. The average existing depth is -2.5' nlw with a proposed final depth of -6' nlw. The connecting water depths within this area are an average of - 6.3' nlw. The material would be trucked offsite to an approved disposal area. Currently there is existing riprap in place at a height of + 7' nhw which helps stabilize the existing embankment and shoreline. The applicants are proposing to repair the existing riprap. The new riprap would be a total length of 301 linear feet and would not be located farther than a maximum distance of 5' waterward and an average distance of 2' waterward of the nhw contour. The riprap would be located landward of the existing coastal wetlands on the west side of the property. A total of 650 square feet of rock would be placed below normal high water level. The proposal is for the bathhouse and parking lot area located on the high ground portion. The applicants are proposing a wooden, one story elevated bath house with screen porch and deck for the use of the marina patrons. The building would be 25' x 35' with a 45' x 70' deck surrounding the bathhouse. The existing grade is +8.0' MSL with the completed first floor building height at +10.75' MSL. The 18 space parking area would be located south and directly behind the bathhouse building. The bathhouse and parking area would be located over existing impervious which for the entire combined tracts is 46, 982 square feet or 57%. The bathhouse and parking area would require a total of 11,02 t square feet of high ground to be graded and filled. The amount of impervious proposed along the tract within the AEC is 15% with the entire tract at 61 %. The bathhouse and deck would be located 40' from the nhw at the east side and 55' from the nhw at the west side. The parking lot would be located a distance of 120' from the nhw and 72' from the DOT right of way. 11. Anticipated Impacts: The upland portion of this project would require the grading and filling of 11,021 ft2 with a finished impervious of 15% within the AEC and 61% for the entire tract. The proposed docks and fingers would shade 7,143.6 ft2 and incorporate 50,703 ft2 of open water. The western dock would shade and incorporate 380 ft2 of coastal wetlands. The excavation would disturb 113,750 ft2 of shallow bottom habitat and remove 14,745 cubic yards of material from the system while the riprap placement would fill 650 ft2 of shallow bottom also. Here is a total of 301' of shoreline. The setting of pilings and riprap placement would cause an increase in temporary turbidity. There would be no hindrance to navigation due to the fact that all work proposed would be 215' from the 42' USACOE channel setback. BEAUFORT The following are my comments and recommendations regarding the aforementioned proposal. The proposal is for the repair of existing riprap, construction of piers with all associated platform, pilings and fingers for a 61 slip marina, excavation and high ground development. There would be a total of 57 permanent slips with four side to temporary slips. The slips would be numbered 1-61. A total of 28 tie pilings and 28 finger piers would be located within the new slips areas. A total of 14,745 cubic yards of material would be removed below nhw to a final depth of -6' nlw from an average depth of -2.5'nlw. All work would be a distance of 215' from the USACOE 42' channel setback. The riprap would be 301' in length and would not extend farther than 5' waterward of the nhw comtour.The high ground work would grade and fill a total of 11,021 square feet and would remain outside of the 30' buffer. The total area to be covered by impervious within the AEC would be 15% and 61% outside the AEC (including the existing impervious and new bath house). The width of the docks would be greater than six feet, however per 71-1.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. The proposed work is consistent with 15A NCAC 7H.0208 and .0209 therefore the Morehead City District Office recommends the project be authorized as proposed on plats dated received April 25, 2009, contingent upon all applicable general conditions and the following standard conditions: • The number of slips shall not exceed 61 as shown in the Environmental Assessment which received State Clearinghouse review of No Significant Impacts on February 19, 2009. • The length of the proposed docks and fingers shall not exceed the distance as shown on the plats. • No work shall hinder navigation in any way. • Riprap placement shall be landward of the existing coastal wetlands. • The shoreline for this project is 301' so the allowable platform square footage shall not exceed 1,204 square feet. • In order to provide safe use the piers shall be no wider than 8'. Gregson Director NorthCarohna Natutallif Project Narrative CAMA Major Permit Beaufort Marina Project Beaufort Partners, LLC - Applicant The proposed marina project site is located on Town Creek in Carteret County within the commercial waterfront district of the City of Beaufort, North Carolina The site is comprised of three tracts of land: lot 120 at 115 Cedar Street containing 0.96 acres (41,861 sq. ft.) of uplands, 113 Cedar Street containing 0.52 acres (22,651 sq.ft) of uplands and 103 Cedar Street containing 0.46 acres (20,037 sq.ft.). The waters of Town Creek adjacent to the property are classified as SC by the North Carolina Environmental Management Commission (EMC). SC waters are used for aquatic life propagation and survival, fishing, wildlife and secondary recreation. Town Creek discharges into Gallant Channel and the Newport River in eastern North Carolina and eventually flows into the Atlantic Ocean. The project site is located in the White Oak River Subbasin 03020106. Waters in this vicinity are currently listed as impaired and closed to shellfishing. Total waterbody width of Town Creek is approximately 1,102 feet and the current combined linear feet of shoreline for the subject lots is approximately 301 feet. The proposed project will provide access to and enhancement of recreational fishing and boating opportunities. Over the past 25 years, improvements to the waterfront areas of Beaufort have resulted in increased revenue for the City of Beaufort, increased property values and increased tourism. The proposed marina project would strengthen the aforementioned benefits to Beaufort. In addition, the project would offer employment opportunities for the community in the form of marina construction and maintenance positions as well as custodial services needed for the proposed bath house and grounds. Beaufort Partners, LLC proposes to construct a commercial, fixed pier marina with 57 permanent slips, four (4) temporary "side-to" slips situated on the outside of the T-Head docks, a bath house with screened in porch and open deck space, and an 18 space parking lot. The future site will be comprised of three parcels in various stages of commercial use. Wooden boardwalks and t-heads will be six feet wide except for the water situated piers which are proposed to be 8' wide to accommodate dock boxes, utilities, and safe pedestrian passage in both directions. All finger piers are to be 3' wide and 20' long. One parcel, lot 120 or subject property is vacant except for remnant asphalt and concrete surfaces as well as one concrete block building left over from the previous business. The existing concrete building will be removed and a portion of the existing impervious surface will be utilized for the proposed 18 space (1 space per 4 slips) parking area. A breakdown of existing impervious surface and proposed new impervious surface coverage for the project can be found on the Existing Conditions and Site Plan sheets of this application. Proposed impervious surface coverage within the 75' AEC will be approximately 15%. The other two parcels are currently being utilized as Hardees (103 Cedar St.) and its associated infrastructure including parking, trash dumpsters, restaurant space and utilities (113 Cedar St.). The applicant has an existing "contract to purchase" with the other property owners which will be implemented once a permit has been issued. All of the current uses of the property are proposed to remain the same except for the improvements to the parking area and construction of a bath house on lot 120. A State Stormwater Plan has been submitted to the Division of Water Quality for the site on 13 March 2009 and will be reviewed concurrently with this CAMA Major Permit application. There will be no dock office, fuel service or maintenance areas provided. Rip rap stabilization will be performed along the entire length of shoreline as needed to bolster existing rip rap along the waterward edge of the property and will not exceed more than 2 feet on average beyond the NHW line and will be landward of any vegetated wetlands where they exist A submerged aquatic vegetation (SAV) and shellfish study was conducted in the adjacent subtidal waters of Town Creek in December 2007 in preparation of Environmental Assessment (EA) process. The study was performed to ascertain the presence or absence of SAV and shellfish and to attempt to quantify any shellfish resources encountered in order to determine if those resources constitute a significant resource. The sampling was conducted over a period of two days and no SAV or SAV rhizomes were encountered and the amount of shellfish, specifically clams, noted does not constitute a significant resource. Oysters were found along the shoreline but will not be impacted by the proposed marina since they will be bridged by any pier structures. A bucket to barge operation will be used to excavate approximately 1.54 acres of public trust bottom area with approximately 14,745 cubic yards of sediment being removed. Silt curtains will be employed during the dredging activities in order to reduce the affect of suspended sediments in the immediate vicinity. This proposed dredging will assure navigable access for vessels ranging in length from 30 feet to 50 feet. All excavated material will be disposed of by a licensed and permitted contractor at an offsite location. The yet to be selected contractor will be responsible for placing the material in an approved spoil disposal site. It is understood that DCM and the COE will approve the location of the spoil site and that the contractor will be responsible for obtaining any required authorizations from the Division of Land Resources. .
