In Corps' Nationwide Permits there is a Regional General Condition for Culvert Placement. The requirements for culvert
placement states that "for all NWPs that involve the construction/installation of culverts, measures will be included in the
construction/installation that will promote the safe passage of fish and other aquatic organisms. The dimension, pattern, and
profile of the stream above and below a pipe or culvert should not be modified by altering the width or depth of the stream
profile in connection with the construction activity. The width, height, and gradient of a proposed culvert should be sufficient to
pass the average historical low flow and spring flow without adversely altering flow velocity." In addition culverts must be
buried, to a certain depth depending on size, to maintain aquatic passage and to maintain passage during drought of low flow
conditions.
The Corps is in agreement with the state (Dave W.) and believes current installation of the culvert and riprap could restrict
aquatic passage within the culvert. Therefore, the Corps along with the state recommend that the riprap be placed at the outlet
as the plans show. Please provide written confirmation and pictures once the modifications to the culvert is complete.

I understand from our phone conversation earlier today that DOT believes that the low flow barrel will backfill with channel
sediments overtime forming a new channel bottom at the elevation of the sills inside the culvert. DWR agrees that this may
occur. However, the issue we have is with the placement of the riprap above the toe of the outlet. The plans do not show
riprap higher than the bottom of the pipe. Therefore, we are requesting that the riprap be placed at the outlet as the plans
show. Let us know when the repairs are complete. Thanks.

Dave,
The original pipe was significantly perched so we stepped down with rock to make-up grade and dissipate energy. Also, the rip-
rap is higher than the bottom of the pipe but it is not higher than the sill.

The attached picture shows rip rap as installed at the low flow outlet. The plans and narrative explain that riprap will be placed
at the toe of outlet to dissipate energy at the existing blow hole. However, it appears that the riprap is actually blocking the
bottom portion of the outlet, of which will likely prevent aquatic passage. Was there a particular reason for placing rip rap in
this manner?
