On January 8, 2007, S&EC received the final revised 401 approval for the above project,
replacing the approvals received May 16, 2006 and June 30, 2006. Condition No. 7 of that
approval states that a "...written Stormwater management plan (including a signed and notarized
Operation and Maintenance Agreement) for each phase of the entire project shall be submitted to
the 401 Oversight and Express Permitting Unit....and the Stormwater management plans shall be
approved in writing by this Office before the impacts for that particular phase may occur per
Condition No. 4 in GC No. 3402. "
S&EC had previous discussions and Pre-Construction meetings with your office regarding the
phasing aspects of the project. Due to its size (over 800 acres) and the nature of the proposed
development within the subject property, it has been our intention from the earliest Pre-
Construction meetings to submit Stormwater management plans for those phases requiring
Stormwater treatment devices prior to beginning that phase of construction (i.e. phases with
greater than 30% impervious surface). Per the attached Stormwater Phasing Plan for the
development, only Phase 4 has greater than 30% impervious cover (59.83 %) and therefore, per
condition No. 4 in GC No. 3402, this is the only phase of the Olde Towne development that will
require an approved Stormwater Management Plan. We are aware that the remaining phases will
require devices that ensure diffuse flow into the protected riparian buffers.
We are requesting a revision to condition No. 7 of the most recent 401 approval that requires
approved Stormwater Management Plans for the entire development and instead only requires a
Stormwater Management Plan for Phase 4 which will have greater than 30% impervious cover.
We intend to fully comply with all aspects of the 401 Water Quality Certification and DWQ's
Stormwater Best Management Practices manual in that no permanent structures will be

constructed within Phase 4 prior to DWQ's approval of that phase's Stormwater Management
Plan, except for the proposed road crossings.
