Enclosed is a revised NWP 29 Application for your review. It is submitted on behalf of MTS -
Raleigh, LLC for the construction of a single-family residential development named Broadwell
Trace, located off of Coley Farm Road in Fuquay Varina, NC. Two small permanent wetland
impacts (0.037 ac) are needed for road construction and site grading. Additionally, one small
permanent open water impact (0.028 ac) is needed to install a mail kiosk/parking area near the
entrance to the site. Two temporary impacts (0.007 ac of wetlands and 0.011 ac of open water)
are needed to install retaining walls.
Enclosed are the PCN form, site maps, and the site plan. Note that you approved the wetland
line for this site back in January of 2017. Since that time, the developer has decided to only
move forward with the northern tract. Please let me know if you have any questions or need
additional information in order to issue the NWP 29. Thank you for your assistance with this

Much of the site is an existing agricultural field. Several structures are located in the central part of the site, off of Coley
Farm Road. Two streams run south through the eastern and western portions of the property. These streams have
forested wetlands adjacent to them. Some forested uplands are also located in these areas. One pond is located off of
Coley Farm Road. Adjacent land use is residential, agricultural, or undeveloped and forested.

The purpose of the project is to construct a single-family residential subdivision for this growing community. Two small
permanent wetland impacts are needed for road construction and site grading. One small permanent open water impact is
needed for a mail kiosk/parking area near the entrance to the site. Two temporary impacts are needed to install retaining
walls.

The project will include 120 SF lots, roads/sidewalks with 50' - 52' ROW, utilities, stormwater ponds, outdoor fitness area, 5'
wide gravel trail, mailbox kiosk, wooden bridge crossing, and a pump station. The roadways will be cleared of vegetation and
fill material will be brought to the site to level the area of disturbance. Utilities will be installed. Track hoe, loader, dump truck,
bob cat, and other standard construction equipment will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The project engineer attempted to minimize wetland impacts as much as possible when developing the site plan. Road widths
were minimized and lots were planned to avoid wetlands. Wetland Impact A is necessary for site grading (see enclosed cross
sections). At Wetland Impact B, a wetland drain extends into the northern part of the site. Impacts to the very tip of this drain
are needed for site grading, site access, and to adequately utilize surrounding uplands. Impacts have between minimized by
using 3:1 slopes and a retaining wall at Impact B. Open Water Impact C is needed to meet requirements of the Town of
Fuquay Varina. They require a minimum of 75' of continuous road frontage along areas classified as "Common Green Space".
This resulted in shifting the mail kiosk/parking area slightly, which will impact the edge of a pond. The mail kiosk needs to be
positioned near the site entrance so that residents can readily access it as they enter/exit the site. A retaining wall will be
utilized here to minimize impacts. No impacts to streams are proposed.

Silt fencing will be used during construction to reduce sediment from eroding into jurisdictional areas. A retaining wall will be
used to reduce impacts at Impact B & C. A piling supported pedestrian bridge will be constructed to allow access without
impacts wetlands or streams. This bridge will be a minimum of 30" above the wetland substrate.

The NC Natural Heritage Program website was used to determine the presence of federally -listed species. No federally listed
species are known to occur on or within a one-half mile radius of the site. Approximately half of the site is fields. Forested
areas support a mix of pines and hardwoods with a fairly dense shrub layer. The site is located within the "White Nose
Syndrome Zone" of the northern long-eared bat. Some forested areas will be cut on site, which could affect roosting and
wintering habitat of the bat. However, no roost trees are known to occur near the site and clearing would be exempt under the
Programmatic BO. No blasting or other percussive activities are expected to occur during site development. Furthermore,
streams within the site appear too far removed from known Cape Fear Shiner habitat. The site does not appear to provide
appropriate habitat to support other federally -listed species known to occur in the area. Therefore, no impacts to federally -
listed species are anticipated to occur from this project.

DEMOLITION NOTES
1. ALL NECESSARY PERMITS FOR DEMOLITION SHALL BE OBTAINED BY THE CONTRACTOR
PRIOR TO BEGINNING WORK. CONTRACTOR SHALL PROTECT ALL ADJACENT LANDS FROM
DAMAGE DURING DEMOLITION WORK. ANY OFF SITE AREAS DISTURBED SHALL BE RETURNED
TO A CONDITION EQUAL TO OR BETTER THAN THE EXISTING CONDITION.
2. DEMOLITION MATERIALS NOT SUITABLE FOR FILL MATERIAL SHALL BE LEGALLY DISPOSED OF
OFF SITE. ALL DEBRIS SHALL BE HAULED OFF SITE TO A DISPOSAL AREA APPROVED BY THE
STATE OF NORTH CAROLINA FOR THE HANDLING OF DEMOLITION DEBRIS.
3. CONTRACTOR SHALL BE FULLY RESPONSIBLE FOR CONTACTING ALL APPROPRIATE UTILITIES
AND ENSURING THAT UTILITIES ARE LOCATED PRIOR TO THE COMMENCEMENT OF
CONSTRUCTION/DEMOLITION ACTIVITIES ACCORDING TO NC STATE LAW. CONTRACTOR SHALL
VERIFY LOCATION AND DEPTHS OF ALL EXISTING UTILITIES PRIOR TO CONSTRUCTION.
4. ALL MATERIAL EXCEPT THAT BELONGING TO A PUBLIC OR PRIVATE UTILITY COMPANY SHALL
BECOME THE PROPERTY OF THE CONTRACTOR. THE CONTRACTOR SHALL NOTIFY THE
APPROPRIATE UTILITY PROVIDER WHEN WATER, SEWER, GAS, POWER OR COMMUNICATION
LINES AND/OR METERS ARE TO BE REMOVED OR RELOCATED. THE CONTRACTOR SHALL BE
RESPONSIBLE FOR DISCONNECTING ALL UTILITIES IN COMPLIANCE WITH WAKE COUNTY AND
UTILITY PROVIDER REQUIREMENTS.
5. ALL STRUCTURES NOT LABELED FOR DEMOLITION SHALL BE PROTECTED FROM DAMAGE
DURING ALL PHASES OF CONSTRUCTION. ANY STRUCTURES THAT ARE TO REMAIN THAT ARE
DAMAGED SHALL BE REPAIRED BY THE CONTRACTOR TO A CONDITION EQUAL TO OR BETTER
THAN THE EXISTING CONDITION AT NO ADDITIONAL COST. THE OWNER AND ENGINEER SHALL
BE IMMEDIATELY NOTIFIED OF DAMAGE TO ANY EXISTING STRUCTURE.
6. ALL CURB AND GUTTER AND SIDEWALKS NOTED FOR REMOVAL SHALL BE REMOVED TO THE
NEAREST JOINT BEYOND NEW CONSTRUCTION OR CUT WITH A SAW AND REMOVED.
7. ALL ASPHALT CUTS SHALL BE MADE WITH A SAW WHEN PREPARING PAVED SURFACES FOR
PATCHING OR WIDENING.
8. CONSTRUCTION ENTRANCE AND SILT FENCE PER THE APPROVED EROSION CONTROL PLANS
SHALL BE IN PLACE PRIOR TO DEMOLITION OPERATIONS.
9. NECESSARY BARRICADES, SUFFICIENT LIGHTS, SIGNS, AND OTHER TRAFFIC CONTROL
METHODS AS MAY BE NECESSARY FOR THE PROTECTION AND SAFETY OF THE PUBLIC SHALL
BE PROVIDED AND MAINTAINED THROUGHOUT THE LIFE OF THE PROJECT.
10. ALL NECESSARY PERMITS SHALL BE OBTAINED FOR DEMOLITION OF EXISTING HOUSE,
BUILDINGS, SEPTIC SYSTEM AND WELL ABANDONMENT PRIOR TO BEGINNING WORK.
11. THE ERECTION, EXCAVATION, DEMOLITION, ALTERATION OR REPAIR OF ANY BUILDING,
INFRASTRUCTURE OR OTHER STRUCTURE IN A RESIDENTIAL OR BUSINESS DISTRICT OTHER
THAN BETWEEN THE HOURS OF 7:00 A.M. AND 8:00 P.M. WILL NOT BE ALLOWED, WITH THE
EXCEPTION OF EMERGENCY REPAIRS.
