Suggestion for wording of a 401 Condition:
1. Maintenance of Low Density Criteria
This development will be considered to be Low Density as long as all of the
following criteria are met throughout the entire site:
a. The overall site plan, excluding ponds, lakes, rivers (as specified in
North Carolina's Schedule of Classifications) and saltwater wetlands
(SWL), must contain less than 24% impervious surface area
considering both current and future development.
b. All stormwater from the entire site must be transported primarily via
vegetated conveyances designed in accordance with the most recent
version of the NC DWQ Stormwater BMP Manual.
C. The project must not include a stormwater collection system (such as
piped conveyances) as defined in NCAC 2B .0202.
d. Stormwater conveyances that discharge to wetlands must discharge at
a non-erosive velocity prior to entering the wetland during the peak
flow from the ten-year storm.
e. Any area within the project that has impervious surface area of 24% or
greater must be located away from surface waters and drainageways
and shall drain to surface waters and drainageways via diffuse flow.
Diffuse flow measures must be designed in accordance with the most
recent version of the NC DWQ Stormwater BMP Manual.
Should the site plan ever be modified in the future such that it no longer
meets ALL of the Low Density criteria listed above, then the a Stormwater
Management Plan (SMP) must be submitted to DWQ for its review and
approval. The SMP must comply with the version of Stormwater Management
Plan Requirements for Applicants other than the North Carolina Department of
Transportation that is in place on the date of the submittal of the SMP. All BMPs
must be designed in accordance with the version of the NC DWQ Stormwater
BMP Manual that is in place on the date of the submittal of the SMP.

He is doing great! Had a couple nights he has slept through the night.
Vegetated swales are fine for low density...I don't remember why we said to remove
them. Anyways, it looks like there is minimal piping. I'm ok with having to capture
and pipe out to daylight from those courtyard areas. If he is below the threshold,
no curb & gutter, and "away" from streams, I'd say he is good to go from the limited
plans he is showing us.
I'm usually ok with 2:1 slopes on that back side of a pond.
I'd like to go on the level spreader look-see, but I don't know that I have time.
Let me know if you see anything interesting.

I hope you are doing well - how's your son doing? I imagine you and your wife are
pretty tired out. . .
This is still that same project - the applicant is bending over backward to make it
"low density." What do you think? He removed most of the vegetated swales and the
runoff is now designed to sheet flow to the adjacent undeveloped areas. There is
still a bit of piping but it has been reduced. The applicant realizes that from here
on out, the development would have to meet the low density requirements.
I also have a question for you about embankments. Do you let applicants have 2:1 side
slopes on the outer portion of an embankment (I mean downslope of the wet detention
pond)? A consultant wants to design a 15'
tall one that way. He has to get a low hazard dam permit from DLR for it and he says
that the 2:1 side slope will meet DLR's requirements.

and submit revised plan sheets and applications per the new layout?
That is, submit a new sheet 2/4 from the SWU-101 Application, but leave
all else the same? I believe this is the only page from the previously
submitted application that will change. The Low Density Supplement
previously submitted can remain as-is.

Annette,
Thanks again for taking the time to meet with Bob and me this morning.
It was helpful to sit down and work through some of the site concerns together
in person.
Attached is a revised version of the layout we reviewed this morning. As
discussed, I have removed the perimeter ditches to facilitate dispersed
overland flow closer to the toe of slope and modified some of the contours to
more accurately reflect the drainage patterns along
the roadway. Upon your review and concurrence with this approach, I will
provide more detailed construction drawings with pipe inverts and
site contouring that more accurately reflect the intent.
Feel free to contact me with any questions or concerns as you review this
information.
I look forward to hearing back from you later this week.
