Raleigh Regulatory Field Office MAY 1 US Army Corps of Engineers 3331 Heritage Trade Drive, Suite 105 Wake Forest, NC 27587 P RE: Pre -Construction Notification: Nationwide Permit 29 & General Certification No. 4092 Autumn Lakes Subdivision, Wake County, North Carolina Dear Mr. Lastinger; Carolina Ecosystems, Inc., on behalf of LGI Homes and Bohler Engineering, has prepared the attached Pre -Construction Notification (PCN) for the above referenced project for a Clean Water Act Section 404 Nationwide Permit 29 and a Section 401 Water Quality Certification No. 4092. The site is located along Old Bunn Road and US 64 in Zebulon, NC. The project is Phase II of the Autumn Lakes subdivision, which will help meet growing demand for residences in eastern Wake County. No impacts were associated with Phase 1 of this development. Jurisdictional delineation was performed by Summit Engineering, Laboratory and Testing, Inc. and field verified by you in 2017. NCDWR verified streams subject to the Neuse River buffer rule on March 7, 2017(NBRRO #17-046). A revised determination letter, attached, was provided after re-evaluation of Ponds C and D. Six wetlands and seven unnamed tributaries of Beaverdam Creek in the Neuse River Basin occur on the property. The attached PCN form provides information for your use in review of unavoidable impacts to jurisdictional resources, including an aerial crossing of one stream and allowable impacts to its buffer, and unavoidable impacts to two wetlands. Impacts would result from a sanitary sewer crossing and an access area for maintenance of proposed infrastructure including sewer lines and stormwater BMPs. For specific locations, and impacts, please refer to the attached impacts maps. Unavoidable Impacts Two wetland impacts, totaling 0.13 acre are associated with Phase 2. Impact Area A (W 1-W2) is located in the northern portion of Phase Il, and includes a total of 0.02 acre of permanent conversion for the installation of a sewer line crossing. Impact Area B (W3 -W4) includes a total of 0.10 acre of wetland impact for the construction of a proposed turn -around and sewer crossing, and 0.01 acre for permanent conversion for the installation of a sewer line. Riparian buffer impacts at Impact Area A would total 684 square feet of Zone 1 and 1,209 square feet of Zone 2, and would be considered Allowable for the utility line crossing. A corridor 30 -feet wide is required by the City of Raleigh for maintenance, as the piers to be installed would be 20 -feet long. Diffuse flow requirements are satisfied by BMPs designed to remove at least 30% total nitrogen from stormwater. 0 S Autumn Lakes May 10, 2018 Page 2 of 2 Avoidance and Minimization Slopes at impact area B around the proposed cul-de-sac were adjusted to utilize 2:1 slopes and minimize j -he unavoidable footprint. All erosion and sediment controls would be installed prior to ground disturbance. A pre -construction meeting would be held with contractors prior to any ground disturbance. Sediment traps and basins would be immediately stabilized after installation. Phase I of the project was designed to avoid all impacts to jurisdictional resources. The impacts proposed for Phase II are necessary to extend sanitary sewer connection to western portions of the project (construction corridor limited to 30 -feet), and access is needed to maintain proposed BMPs. Phase III is anticipated in the future, but the date of this development is undetermined. There is potential for one additional road crossing (stream impact) as well as a sewer and greenway crossing. These impacts would be detailed in a future permit application, and impacts would be considered cumulatively with those proposed in this application. A Tier 1 search of the NC Natural Heritage Data Explorer found no records of federally protected species on or near the project. Their report is attached. The preceding information, along with the enclosed Pre -Construction Notification form, Vicinity map, USGS map, Aerial map, Environmental Impact Maps, NCDWR letters, and NC Division of Mitigation Services acceptance are being submitted for your review of this project. This policy applies to all refund requests made on or after the publication date of this policy. Policy Statement: The policy of DMS is to allow for refunds under certain conditions. 1. All refund requests must be made in writing to the DMS In -Lieu. Fee Program Coordinator at kelly.wiIlia ms d-ncdenr.gov. 2. All refund requests are subject to fund availability. DMS does not guarantee fund availability for any request. 3. The request must either come from the entity that made the payment or from an authorized agent. Third parties requesting refunds must provide written authorization from the entity that made the payment specifying the name and address of the authorized refund recipient. 4. Refund requests related to unintended overpayments, typographical errors or incorrect invoices should be brought the attention of the In -Lieu Fee Program Coordinator as soon as possible. Such requests are typically approved without delay. 5. Payments made under the incremental payment procedure are not eligible for refunds. h. Refund requests made within nine months of payment to DMS will only be considered for requests associated with projects that have been terminated or modified where the permittee's mitigation requirements have been reduced. Such requests must be accompanied by written verification from the permitting agency that the project has been cancelled, the pen -nits have been rescinded or have been modified, or the mitigation requirements have been reduced. 7. Refund requests made more than nine months from the payment date will only be considered for permits that were terminated or modified to not require any mitigation. Such requests must be accompanied by written verification from the permitting agency that the project has been cancelled, the permits have been rescinded and/or mitigation is no longer required. 8. Refund requests not meeting the criteria specified above are not eligible for arefund. 9. Refund requests that meet the criteria above will be elevated to DMS Senior Management for review. The following considerations apply to all refund requests: a. availability of funds after consideration of all existing project and regulatory obligations b. the date the payment was made c. the likelihood DMS can use the mitigation procured using the payment to meet other mitigation requirements 10.
