Re: Proposal -Ten Slip Private Marina Located at Lot 1 in Summer Cove Subdivision off Hare
Hallow Road on Lake Glenville in Jackson County, North Carolina.
Please find enclosed the letter of intent dated April 2009, which shows the proposed
construction of 10 (ten) slip private marina. An application is being made to Duke Energy Lake
Services for the required Federal Energy Regulatory Commission (FERC) permit to construct this
private marina. Stabilization for this proposed site is already in place, we will be constructing the
private marina only. Plats and a dock drawing are enclosed for you review.
We ask that you advise us, by return mail with in 45 days, of any comments you may have
concerning this development or of any permits your authority may require. Your comments are
a requirement on the F.E.R. C. permit application. Thank you for your cooperation and prompt
response.

The following is an abbreviated application form for those applying for a 401 Water
Quality Certification to impact FERC (Federal Energy Regulatory Commission)
regulated lake shore or bottom under the U.S. Army Corps of Engineers Permit
CP30. This Application cannot be used for wetland or stream impacts. Please
provide seven (7) copies of this application and supporting information as well as a
non-refundable application fee to the Division of Water Quality of $200.00 for
impacts of to lake bottom of less than 1 acre and $475.00 for impacts to lake bottom
of greater or equal to 1 acre.

II. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing
property boundaries and development plans in relation to surrounding properties. You
may use the diagram below to make a hand sketch of your project. Also, see the example
below for guidance. Both the vicinity map and site plan must include a scale and north
arrow. The footprints of all buildings, impervious surfaces, or other facilities must be

hand tools, delivery trucks for floating dock and pier.
7. Amount of impact (including all excavation, backfill, rip rap, retaining walls, etc.)
below the normal pool lake level in square feet or acres: Use concrete deadman
anchors on lake bottom,

acres: Drilling holes in rock face, pier footing holes. Concrete deadman anchors on

My review was brief, using the limited information available about the desired use and
did include a site visit on September 6, 2007 with you in attendance.
At this time, Duke Energy Lake Services will consider permit applications for the above
identified lake uses on the subject property provided that all the requirements of Duke's
Shoreline Management Guidelines are met. Please be advised that:
• All uses of land and water within the subject lake require Duke's prior written
approval and said approval cannot be granted until a formal lake use permit
application has been properly completed and submitted.
• This letter does not represent approval, in any fashion, of any lake use activity nor
does it imply any intent on the part of Duke Energy to approve of any lake use
activities. Please recognize that any reliance you place on this letter for decision-
making purposes is done at your own risk.
• Conditions may change such that future lake use permit applications for the subject
had may not be allowed by Duke Energy. Duke Energy is under no obligation to
advise you of any changes which may occur.

Dear Ms. Leatherman,
This letter is a review for the proposed ten-slip private manna located at Summer Cove
Subdivision on Lake Glenville, in Jackson County. The Summer Cove Homeowner's
Association agrees to comply with all recommendations, requirements, and/or conditions
from the various federal, state, regional, and local agencies in regards to the private
marina dock application. Including the condition that no mechanical fueling of motorized
watercraft will be allowed or any form of fuel containers are permitted on the dock or
shoreline.
The proposed project is for a ten-slip private marina that would be located at Lot 1 in
Summer Cove Subdivision off Hare Hallow Road.
The proposed ten slip private marina would serve the 20 off water residence of the
Summer Cove Homeowner's Association at Glenville.
