Hi Rick,
Thank you for following up. We finished discussing these permits this week and will have no further comments on
NCG05 or NCG13.
Our inquiries on the continuance of tiered control obligations into the next permit cycle showed that it is probably legal.
We agree that it is not necessary because the future permit may establish categories that put prior obligations in place,
but perhaps not. Whatever is used would be at least as stringent for the permitee or subject to a backsliding argument.
