Description of projects area and activity: This authorization is for temporary and permanent impacts to streams and wetlands associated with the construction of an educational institution as follows: Crossing #1: Stream ISC (Impact #1) 95 -linear feet of permanent impact for the installation of a single 90LF, 36 inch RCP culvert and 7 linear feet of rip rap for a velocity dissipation pad and 10 linear feet of temporary impacts for construction access/dewatering. Crossing #2: Wetland WC 1-16 (Impact #2) 1600 square feet of permanent fill for roadway and sideslope construction; Stream ISCA (Impact #3) 47 -linear feet of permanent impact for the installation of a single 47 LF, 36 inch RCP culvert and 7 linear feet of rip rap for a velocity dissipation pad and 10 linear feet of temporary impacts for construction access/dewatering. Rip rap dissipation pads will be installed so that the top of the rip rap is even with the existing stream bed elevation (see attached plans). Applicable Law: ® Section 404 (Clean Water Act, 33 USC 1344) ❑ Section 10 (Rivers and Harbors Act, 33 USC 403) Authorization: Regional General Permit Number and/or Nationwide Permit Number: NWP 39 Commercial and Institutional Developments SEE ATTACHED RGP or NWP GENERAL, REGIONAL AND/OR SPECIAL CONDITIONS Special Conditions: A pre -construction inspection of the proiect site must be performed by the Armv Corps of Engineers. Wilmington District (USAGE), prior to beginning work within iurisdictional waters. The applicant must contact the USACE to establish a suitable date and time to conduct the pre -construction inspection. The applicant, and construction contractor who will be placing the authorized fill, must be present during the pre -construction inspection. Also, the exact footprint of the proposed fill must be demarcated for the pre -construction meeting. Geographic coordinates (latitude and longitude), for the stream impact endpoints (upstream and downstream locations) and the wetland impact perimeter must be provided before or on the pre -construction inspection date. The coordinates must be provided in North American Datum 1983(NAD83), decimal degree format and shown on a map with applicable scale. 2. The applicant must notify the USACE, either by telephone or in writing (e-mail is acceptable), within 7 days of the placement of fill into iurisdictional waters. The notification must be provided to Andrew Williams, Regulatory Proiect Manager, Raleigh Regulatory Field Office, 3331 Heritage Trade Drive, Suite 105, Wake Forest North Carolina 27578. 3. The applicant must notify the USACE, in writing, no later than 30 days after completion of work within jurisdictional waters. The notification must be sent to Andrew Williams, Regulatory Proiect Manager, Raleigh Regulatory Field Office, U.S. Army Corps of Engineers, 3331 Heritage Trade Drive, Suite 105, Wake Forest, North Carolina 27587. 4. At the request of the USACE, a post construction survey of the filled areas will be conducted, within 30 days, by a Register Professional Land Surveyor (RPLS). This survey will include the geographic coordinates for the proiect end points and/or fill limits, as described in Condition #1 above. Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached conditions and your submitted application and attached information dated January 11, 2018, including information provided on March 13, 2018. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C.
