Dear Mr. Johnson:
Condition 5 of the 401 Certification Approval and Riparian Buffer Authorization issued by the Division
of Water Quality(DWQ)on May 19, 2009 requires that stormwater flow from concentrated conveyances
shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream
buffers such that it will not re-concentrate before discharging into a stream as identified within 15A
NCAC 2B .0233 (5). Your submittal included two(2) level spreader devices proposed to meet the diffuse
flow condition. The DWQ would need further information as outlined below:
• Please provide the design information of the level spreaders along with all supporting documents.
These include a complete Level Spreader Supplement Form which comprises Design Summary
Information and Required Items Checklist, as well as a notarized Operation and Maintenance
Agreement for each device. The above information can be found at:
