Dear Mr. Payne:
The Division of Water Resources (DWR) has determined that the MSD Buncombe County's Pretreatment
Program has failed to meet the minimum requirements as specified in 15A NCAC 2H .0900 and 40 CFR
403.8 (f). Specifically,the MSD Buncombe County has failed to re-issue industrial user permits(IUPs).
According to Division records, there are 23 significant industrial users (Sills) covered by the MSD
Buncombe County pretreatment program. The IUPs expired December 31, 2016. The control authority
is required to transmit copies of all issued SIU pretreatment permits to the Division upon issuance. To
date,three IUPs have been received. Numerous request for the information have been made. To avoid
further enforcement action, submit copies of the remaining IUPs, along with the transmittal letter to the
SIU, permit synopsis and permit application to the PERCS Unit no later than June 15,2018.
