On March 13, 2018, the Division of Water Resources (Division) received your application dated
March 5, 2018, requesting a 401 Water Quality Certification from the Division for the subject
project.
The Division understands that the project impacts have increased due to an increase in the size
of the delineated wetland. Further the proposed residential subdivision has increased in area
and lot number since the previous approvals. The Division has determined that additional
information is required to process your application, therefore this application is on -hold until
all of the following information is received:
1. Regarding the wetland impacts, the Division has concerns regarding the fill impact on
the hydrology of the wetland.
a. Show the wetland boundaries on the project map and details on how the project
will preserve the hydrological quality and connection of the wetland and aquatic
life passage on either side of the proposed road.
b. Provide construction drawings of the same, detailing how and where the
wetlands will remain connected.
c. Clarify if the fill and land clearing are occurring in the same footprint or if these
are separate wetland impacts.
d. There is a third wetland impact listed on the PCN as "other" that the Division
believes is in error, please confirm this.

2. Provide additional detail for the culvert installation in the stream channel.
a. Show the bed elevation and the culvert's location relative to it.
b. Provide the width of culvert.
c. Provide a top view map of the culvert's location.
d. Provide details of how the culvert and stream will be stabilized.
e. If any rip rap is proposed around the culvert, show the length width and depth of
the rip rap on the construction drawings.
The application stated that a Preliminary Grading Plan and AutoCAD drawing of the
Culvert were included in Attachment 5, but none were provided. Please provide these to
the Division.
4. The application states that the proposed road is "smaller than typical roads," but did not
provide a specific size. Update the plans to include the width of the road.
5. Provide a copy of deeded easement and an agent authorization letter allowing the agent
to execute the application on the owner's behalf.
6. Provide details on what is occurring in the open space on the property. Will other
impervious services be constructed? Is the area being kept open for future
development? Will utilities be located in this space?
7. Provide a breakdown calculation of the project density and a drawing that highlights
each area that is used the calculation. Include the details of the proposed rain gardens
in the drawing.
8. Please note that Orange County has delegated authority for riparian buffer
determinations, authorization of impacts and review of diffuse flow. Further, Orange
County has delegated authority for stormwater management plan approval. As this
project is in a water supply watershed, please ensure proper approval is obtained from
Orange County for both of these programs.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested
information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC
27699-1617 OR by submitting all of the above requested information through this link:

If all of the requested information is not received within 30 calendar days of receipt of this
letter, the Division will be unable to approve the application and it will be returned. The return
of this project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
