Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the inspection conducted at the
subject facility on February 5, 2009, by Ms. Barbara Sifford of this Office. Thank you for the assistance and cooperation
provided during the inspection by Ms. Robin Lancaster.
After discussion with other regional staff and storm water permitting staff of the Central Office in Raleigh it has
been determined that your facility does not need to have a storm water permit. If the facility can provide shelter for the
chemicals stored outside to prevent any runoff contamination the permit may be rescinded. You need to submit a written
letter to the permitting office asking for rescission.

All rainwater existing the property is discharged by sheet flow, therefore you do not have an outfall pipe to make
observation of during rainfall events. If the chemicals stored outside can be covered to prevent exposure to rainfall and
prevent stormwater contamination you can request that the permit for the facility be rescinded.

Comment: No outfall pipe exists from the property all rainwater is discharged by sheet
flow to the property boundary.. The City of Troutman has graded a right of way along
the property line for a sewer line.

Thank you for attaching the letter you received from our DEMLR Stormwater Permitting group. Mr. Moore
and I reviewed it to understand what requirements you had if you are renewing your permit. The letter asks
for Stormwater Outfall location information so I accessed the compliance database to determine what
information DEMLR already possessed for your permit. It noted that your outfall location was unknown but
had a latitude/longitude entered that was close to your facility. There was an inspection noted in 2009 so I
reviewed it with Mr. Moore to determine if it contained any information on the outfall at your facility. I have
attached a copy for your review.
One of the three requirements that trigger the need for an industrial stormwater permit is having an outfall
(pipe, swale, etc.) that concentrates stormwater and discharges from the property. If you review the
inspection report it notes that stormwater leaves your site as sheet flow; it is diffuse flow and does not
concentrate. The cover letter for the inspection by Ms. Sifford also notes that since you do not have an
outfall you can rescind your permit coverage.
If you have not changed how stormwater flows at the site since the 2009 inspection, you can ask for permit
rescission. If at some time in the future you rework the site and create an outfall then permit coverage will
be needed based on your industrial activity and the exposure of materials to stormwater at your facility.
Therefore, if you review the DEMLR letter you can follow the link in the first paragraph that states "If you no
longer need this permit..." to complete the permit rescission form. You can note the reason for rescission
as no stormwater outfall and provide the attached inspection report as proof. You are also welcome to
include a copy of this email correspondence. Once your permit coverage is rescinded you will no longer
have to pay the $100 annual permit fee.
