Dear Sir:
The North Carolina Deparhnent of Transportation (NCDOT) proposes pavement reconstruction
for approximately 1.2 miles of I-40 Business, bridge replacements, interchange modifications,
and widening of Peters Creek Parkway in Forsyth County. As part of the project, 8.5 miles of 2-
inch parallel fiber optic conduits and signage for ITS communication will be installed. In
conjunction with U-2827B, project C-5620A a multi-use path along US 421/I-40 Business from
Lockland Avenue to Liberty Street will be constructed. No jurisdictional impacts are proposed for
the installation of the fiber optic conduits, signage, and multi-use path.
The permit modification #1 application dated February 16, 2018 stated there would be a total of
458 linear feet of permanent stream impact and 216 linear feet of temporary stream impact
associated with construction of the roadway project. At that time, total mitigation credits had been
acquired for 458 linear feet of stream impacts. Permit modification #2 increases the total impacts
to 562 linear feet of permanent stream impacts (50 feet is bank stabilization and non-mitigable),
and 226 linear feet of temporary stream impacts associated with construction of the project.
Additional mitigation credits for impacts to 541inear feet of stream have been received from NC
Division of Mitigation Services (see attached letter).

There will be no temporary or permanent impacts to wetlands. A design change related to the
West Fourth Historic District (FY3466) at Site 2 has instigated the need to modify the revised
permitted impacts.
Site 2 Design Change
A minimum 5-foot wide sidewalk on the west side (southbound) of Peters Creek Parkway from
the north side of the existing culvert to the intersection at Fourth Street is required by NCDOT.
Adding this sidewalk required widening the existing Peters Creek Parkway footprint beyond the
original construction limits presented in the original public hearing maps. The addition of
sidewalk here resulted in several new elements of work (culvert extension, retaining wall).
NCDOT had previously coordinated with SHPO/FHWA and reached concurrence on a No
Adverse Effect finding based on using temporary construction easements to construct the
improvements.
Recent geotechnical and environmental data has revealed poor soil conditions (soft silt and clay),
and groundwater located at shallow depths, requiring the retaining wall foundations to be
excessively deep. The cost for this wall design became excessive. On March 20, 2018, a meeting
between HPO and NCDOT decided excessive wall costs were unnecessary, and the use of fill
slopes, and extending the existing culvert onto the historic property would be permitted by HPO
under a Conditional No Adverse Effect. The official consultation sign-off form from the HPO
meeting is attached. Per HPO requirements, the Design-Build Team is required to landscape with
low-maintenance, urban plants and trees, and will not use red tips (Photinia spp.) and privet
(Ligustrum spp.) in the landscaping plan. The Design-Build Team will prepare a landscaping
submittal to NCDOT for review, coordinate with the Roadside Environmental Unit, and FHWA
will review and approve this plan. The commitment to create landscaping plans with regards to
historic resources is stated on the project commitments sheets and no project commitments will
change for the project due to this project modification.
Site 1: Permit Modification USACE Interpretation
NCDOT is interpreting impacts at Site 1 as a single and complete linear project. We have
discussed this interpretation with Monte Matthews (USACE) on May 1, 2018, and understand
him to be in agreement. Permanent impacts at Site 1 are associated with a 42" pipe
extension. This pipe extension is necessary for the widening of Peters Creek Parkway on the
north side of Business 40, and not a result of the loops for the interchange or acceleration or
deceleration lanes.
Sites 2: Permit Modification USACE Interpretation
NCDOT is interpreting impacts at site 2 and 3 as a single and complete linear project. We have
discussed this interpretation with Monte Matthews (USACE) on May 1, 2018, and understand
him to be in agreement. Permanent impacts at sites 2(upstream of Peters Creek Parkway) and 3
are associated with the installation of a 66" pipe (site 2) and 48" pipe (site 3). As stated in the first
permit modification request dated January 26, 2018, the 66" pipe at site 2 is needed to minimize
long term maintenance concerns by removing guardrail, flattening slopes and reducing stream
bank erosion. Site 3 is needed to tie the channel into the pipe system at site 2. Permanent impacts
on the downstream side of Peters Creek Parkway are needed for slope stability. Permanent
impacts at both of these sites are necessary due to impacts associated with the widening of Peters
Creek Parkway on the south side of Business 40, and not a result of the loops for the interchange
or acceleration or deceleration lanes.
Impact Summary
Table 1 shows changes in impacts from original impacts, permit modifications #1 and permit
modification #2. Previously, permit modification #1 impacts were 458 linear feet of permanent
stream impacts and 2161inear feet of temporary stream impacts. Permit modification #2 increases
the total impacts to 562 linear feet of permanent stream impacts (50 feet is bank stabilization and
non-mitigable), and 226 linear feet of temporary stream impacts associated with construction of
the project. Therefore, mitigation credits for an additional 541inear feet of stream impacts will be
requested from NC Division of Mitigation Services.

DMS will provide the amount of mitigation as determined by the regulatory agencies.
This mitigation acceptance letter replaces the mitigation acceptance letters issued on July 27,
2016, May 18, 2017, January 23, 2018 and May 2, 2018. DMS commits to implementing additional sufficient
compensatory stream mitigation credits to offset the impacts associated with this project as determined by the
regulatory agencies using the delivery timeline listed in Section F.3.c.iii of the In-Lieu Fee Instrument dated
July 28, 2010. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no
longer be valid and a new mitigation acceptance letter will be required from DMS.

General Project Narrative: The project consists of pavement reconstruction of approximately 1.2 miles of I-40 Business, bridge replacements, interchange modifications, construction of multi-use path, and
(Description of Minimization of Water widening of Peters Creek Parkway. There are two culvert extensions for a box culvert under Peters Creek Parkway, the upstream side has an attached junction box while the
Quality Impacts) downstream was needed due to a retaining wall not being feasible, a pipe extension on the same tributary upstream of I-40 business where a supplemental pipe will be required,
and a stream relocation for a small tributary that ties to the Peters Creek Tributary. An existing pipe that carries Tar Branch will also need to be replaced within the ROW limits
of the project. There will be an additional 5.0 acres of impervious area added to the project due to the widening of Peters Creek Parkway. Stormwater control measures in the
form of Media Filters have been proposed in this area to incorporate some stromwater treatment for part of this additional impervious area. In other areas of the project, there
has been a decrease of impervious area by 7.0 acres due to the removal of select ramps and loops (see plans). The proposed project has a net reduction in Impervious area of
2.0 acres. The Design-Build Team has also flattened proposed ditches whenever possible to aide in as much treatment as possible.
