HomeMy WebLinkAboutUSACE Scoping LetterMr. James Connie Project Engineer NCDOT, Division 9 DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 151 PATTON AVENUE ROOM 208 ASHEVILLE, NORTH CAROLINA 28801-5006 Issue Date: Apri125, 2018 Response Deadline: May 21, 2018 Project: U-6077 Subject: Notification of start of study for STIP No. U-6077, widening to multilanes of SR 4315 (Kernersville Road), from SR 2632 (Sedge Garden Road) in Winston-Salem to Harmon Creek Road in Kernersville [Forsyth County] This letter is in response to your Apri125, 2018 letter to the Corps' Charlotte Field Office regarding U-6077 (i.e., development of environmental and engineering studies for the subject project). General Comment(s) The Corps regulates waters of the United States (WoUS) pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act. WoUS are defined in 33 Code of Federal Regulations (CFR), Part 328. These waters include more than navigable WoUS and are the waters where permits are required for the discharge of dredged or fill material pursuant to section 404 of the Clean Water Act. Therefore, the Corps recommends a qualified environmental professional conduct a delineation of WoUS within the proposed project area to determine if WoUS would be affected by the proposed project.
