Dear Mr. Gribben:
On April 2, 2009,the Division of Water Quality(DWQ)received your application dated March 26, 2009
to impact 120 linear feet of streams, and 0.065 acres of open water to remediate contaminated sediments
below the Narrows Dam Powerhouse. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive five copies of the additional information requested below,
we will place this project on hold as incomplete until we receive this additional information. If we do not
receive the requested information,your project will be formally returned as incomplete. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
l. Your application states that Alcoa will obtain an"Administrative Agreement with either EPA or
the State of North Carolina that requires Alcoa to meet the substantial requirements of the various
permit provisions of the NPDES General Storm Water Permit No.NCG010000,without having
to actually obtain the NPDES permit."(page 10 of the Remediation Work Plan revised March 17,
2009). Please address why you will not just meet the requirements of the NCGO10000 directly
rather than your approach as proposed. The Division does not understand why directly meeting
the requirements of NCGO 10000 i�problematic.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me and to Mike Lawyer of the DWQ Fayetteville Regional Office at 225 Green Street,
Systel Building Suite 714, Fayetteville,NC 28301-5043. If you will not be able to provide the requested
information within that timeframe, please provide written confirmation that you intend to provide the
requested information, and include a specific timetable delineating when the requested materials will be

protected buffers. Please be aware that any impacts requested within your application are not authorized(at
