The Application provides adequate assurance that the discharge of fill material into the waters of Bogue Sound in conjunction with the proposed development in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301,302,303,306,307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. Deed restriction (see attached example) shall be placed on all lots with jurisdictional wetlands to prevent future wetland fill. 3. Fill is not approved for the two largest wetland areas on the site except for a road crossing fill for the large wetland nearest to the "Look Realty" building. 4. Written approval from DEM for Stormwater management is required for this development. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal or Costal Area Management Act Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North. Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. It is our understanding that through negotiations with the North Carolina Division of Environmental Management (NC DEM), you have modified your your original proposal and have reduced wetland impacts to 0.49 acres. Accordingly, we have determined that your project may be authorized pursuant to Nationwide Permit #26 provided all conditions associated with this authorization and the following special condition can be met: a. Fill is to be placed only in the areas indicated on the map accompanying the letter from Mr. Larry Baldwin dated September 5, 1994 (map enclosed). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the conditions shown on the enclosure and the above special condition. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. This verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. Box 1890 Wilmington, NC 28402-1890 REFERENCE: ACTID-94-0271 Paxon Holz, McClean Estate: Application to Fill Wetlands for Industrial and Commercial Development, Emerald Isle, Carteret County, NC Dear Colonel Sperberg: The State of North Carolina has completed its review for consistency with the North Carolina Coastal Management Program, pursuant to 15 CFR 930, of Corps Public Notice number Action ID 199400271, regarding an application by Ms. Paxon Holz, Executrix, McClean Estate, to fill wetlands adjacent to Bogue Sound in Emerald Isle, Carteret County, NC. During the course of our review, we learned that only certain wetland areas proposed to be filled received a 401 Water Quality Certification from the NC Division of Environmental Management. Therefore, based upon our review, we agree that the portions of the project proposal which have received a 401 Water Quality Certification are consistent with the North Carolina Coastal Management Program provided the conditions of the 401 Water Quality Certification, dated August 2, 1994, are met. However we disagree that the portions of the project that involve wetland fill for which the 401 Water Quality Certification was not issued are consistent with enforceable policies and standards of the North Carolina Coastal Management Program. Specifically, portions of the project for which the 401 Water Quality Certification was denied are inconsistent with 15A NCAC 7M .0800. The North Carolina Wildlife Resources Commission recognizes the importance of the maritime and interdunal freshwater habitat and wetland function in the project area. In addition, the North Carolina Division of Parks and Recreation has identified Emerald Isle Woods, adjoining the project site, as a priority for protection by the Natural Heritage Program. Clearing and filling that is kept to a minimum with little disruption of the natural hydrology of the area is essential to protecting the integrity of these habitats. A copy of this letter will be mailed to the applicant to serve as our formal notice that we have found portions of the proposed activity inconsistent with the North Carolina Coastal Management program. It will also serve as notice that this finding may be appealed to the Secretary, U.S. Department of Commerce, Washington, DC. The appeal must be filed within 30 days of receipt of this letter and must specifically address the applicant's belief that either (1) the activity is consistent with the objectives of the Federal Coastal Zone Management Act, or (2) the activity is necessary in the interest of national security.
