or less are not considered significant).
2. Deed restriction (see attached example) shall be placed on all lots with
jurisdictional wetlands to prevent future wetland fill.

Dear Ms. Holz:
Please reference your application dated April 15, 1994, requesting
Department of the Army (DA) authorization to place fill material in 1.16 acres
of isolated maritime forest wetlands associated with commercial development
adjacent to NC Highway 58, in Block 42, Emerald Isle, Carteret County, North
Carolina. It is our understanding that through negotiations with the North
Carolina Division of Environmental Management (NC DEM), you have modified your
your original proposal and have reduced wetland impacts to 0.49 acres.
Accordingly, we have determined that your project may be authorized pursuant
to Nationwide Permit #26 provided all conditions associated with this
authorization and the following special condition can be met:
a. Fill is to be placed only in the areas indicated on the map
accompanying the letter from Mr. Larry Baldwin dated September 5, 1994 (map
enclosed).
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the conditions shown on the enclosure
and the above special condition. This nationwide permit does not relieve you
of the responsibility to obtain other required State or local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
This verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification. If during the two years,
the nationwide permit authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced or are
under contract to commence, in reliance upon the nationwide permit, will
remain authorized. This is provided the activity is completed within twelve
months of the date of the nationwide permit's expiration, modification or
revocation.

By copy of this letter, we are also retiring your individual permit file at
this time.
Questions or comments may be addressed to Mr. Scott McLendon, Wilmington

Dear Mr. McLendon:
September 9, 1994 "`"'V"' uf?UUF
of Engineers
28402-1890
On September 2, 1994)I met with Larry Baldwin of Land Management, Inc.,
John R. Dorney, Steve Kroeger and James H. Gregson, all with the State of
North Carolina Department of Environment, Health and Natural Resources.
Following the meeting we walked the property and it is my understanding
that we will be allowed to fill several wetlands which were determined
while on site not to be part of the larger ridge and swale maritime forest
system that is contiguous with Bogue Sound and the Intracoastal Waterway.
I am enclosing a map showing the areas that I understand we will be allowed
to fill. Please confirm this with Mr. Dorney. I hope you will respond to
my genuine concern for the environment as well as my duty as Trustee to
make the maximum use possible of this commercial land which my family has
owned for some four decades. We have paid inheritance taxes on this
property
property
earliest
and continue to pay extremely high real estate taxes on the
and we need to develop it. Please let me hear from you at your
possible convenience.

WE APPRECIATE NCDEH&NR'S REVIEW AND COMMENTS ON 09/02/94 DURING THEIR ON-SITE
REVIEW OF INDIVIDUAL 404 PERMIT APPLICATION (COE #199400271; DEM #93894) FOR
FILL WITHIN ISOLATED WETLANDS OF THE 7.8 ACRE W.B. McLEAN ESTATE BLOCK 42 N.
WE ORIGINALLY APPLIED FOR 1.16 Acres OF FILL FOR ALL ISOLATED 404 WETLAND
AREAS IN ORDER TO FEASIBLY DEVELOP THE TRACT. NCDEH&NR ISSUED A 0.2 Acre FILL
PERMIT (Certification #2902) ON 08/02/94. THIS WOULD RESULT IN 40-45% OF THE
TRACT BEING UNUSABLE OR INACCESSIBLE FOR DEVELOPMENT.
AFTER THE ON-SITE REVIEW WITH NCDEH&NR IT WAS DETERMINED THE SMALLER ISOLATED
WETLANDS COULD BE FILLED AND THE TWO DEDICATED ROAD CROSSINGS OVER THE TWO
SEPARATE LARGER ISOLATED WETLANDS COULD ALSO BE FILLED (See Enclosed Revised
Map). THIS WOULD RESULT IN ONLY MINOR IMPACTS TO THE 2 LARGER ISOLATED WET-
LAND AREAS AND A TOTAL OF 0.49 Acres OF FILL (See Revised Map). USING THESE
SELECTIVE FILL AREAS WILL ALLOW 86% OF THE TRACT TO BE UTILIZED, WHILE MINI-
MIZING IMPACTS TO MAJOR 404 WETLAND AREAS.
IF THE ABOVE IS AGREEABLE TO ALL PARTIES, WE NEED NCDEH&NR TO REVISE THE 401
CERTIFICATION PURSUANT TO OUR 09/02/94 MEETING. THANK YOU FOR YOUR TIME AND
INPUT INTO THIS PROJECT.

for Industrial and Commercial Development, Emerald Isle, Carteret
County, NC
Dear Colonel Sperberg:
The State of North Carolina has completed its review for consistency with the North
Carolina Coastal Management Program, pursuant to 15 CFR 930, of Corps Public Notice number
Action ID 199400271, regarding an application by Ms. Paxon Holz, Executrix, McClean Estate,
to fill wetlands adjacent to Bogue Sound in Emerald Isle, Carteret County, NC.
During the course of our review, we learned that only certain wetland areas proposed to
be filled received a 401 Water Quality Certification from the NC Division of Environmental
Management. Therefore, based upon our review, we agree that the portions of the project
proposal which have received a 401 Water Quality Certification are consistent with the North
Carolina Coastal Management Program provided the conditions of the 401 Water Quality
Certification, dated August 2, 1994, are met. However we disagree that the portions of the
project that involve wetland fill for which the 401 Water Quality Certification was not issued are
consistent with enforceable policies and standards of the North Carolina Coastal Management
Program. Specifically, portions of the project for which the 401 Water Quality Certification was
denied are inconsistent with 15A NCAC 7M .0800.
The North Carolina Wildlife Resources Commission recognizes the importance of the
maritime and interdunal freshwater habitat and wetland function in the project area. In addition,
the North Carolina Division of Parks and Recreation has identified Emerald Isle Woods,
adjoining the project site, as a priority for protection by the Natural Heritage Program. The area

contains several types of natural communities that are becoming increasingly rare due to
development in the coastal area. Clearing and filling that is kept to a minimum with little
disruption of the natural hydrology of the area is essential to protecting the integrity of these
habitats.
A copy of this letter will be mailed to the applicant to serve as our formal notice that we
have found portions of the proposed activity inconsistent with the North Carolina Coastal
Management program. It will also serve as notice that this finding may be appealed to the
Secretary, U.S. Department of Commerce, Washington, DC. The appeal must be filed within 30
days of receipt of this letter and must specifically address the applicant's belief that either (1)
the activity is consistent with the objectives of the Federal Coastal Zone Management Act, or (2)
the activity is necessary in the interest of national security.
Should either you or the applicant have questions regarding our finding, conditions, or
comments, please contact Steve Benton or Caroline Bellis, Division of Coastal Management, at
(919)733-2293.
