Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Most of the project site is undeveloped and still in a forested state. The underbrush is maintained by periodic mowing. The site abuts Market Street to the west, Amberleigh Shores Phase I to the north, Three Oaks Apartments to the south and single family residential development to the east. The primary land use in the vicinity of the project is residential. There are seven structures on the property that will be demolished to make room for the development (see Appendix A). 3b. List the total estimated acreage of all existing wetlands on the property: 1.65 acre (see Appendix D) 3c. Explain the purpose of the proposed project: To construct a high density, multi -family housing development, in a rapidly growing area of New Hanover County. Amberleigh Shores Phase II PCN (5/3/18) 3e. Describe the overall project in detail, including the type of equipment to be used: The construction of the proposed development would permanently impact a total of 0.21acre of on-site isolated (NC Division of Water Resources [DWR] Section 401) and non -isolated (USAGE Section 404), forested wetlands, and will temporarily impact 0.07 -acre of non -isolated, forested wetlands. Seven (7) permanent impact areas are proposed to be filled in order to facilitate the construction of five (5) multi -family buildings, with associated access roads, infrastructure, parking areas and sidewalks, and one (1) temporary impact area is associated with the installation of a sanitary sewer line (see Appendix D for details of the proposed development and associated wetland impacts). There are 2 stormwater ponds to be located along the east side of the site. Select trees will be removed, and the land grubbed by bulldozers and track hoes. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Due to the location of the wetlands on this site and the amount of grade between the buildable uplands and the bottoms of the wetland features, avoidance was not possible. Therefore, the following design techniques were incorporated into the site plan: 1. Utilize Retaining Walls: To reduce wetland impacts, the Applicant has incorporated five (5) retaining walls into the site plan. Due to the relatively steep topography surrounding the Basin Wetlands, a large amount of fill will need to be brought in to level the site. Utilizing the retaining walls eliminate the slope, associated with the fill, which will reduce wetland impacts by 0.16 acre. In addition, these measures eliminate the need to impact the more functionally valuable, inundated areas of the Basin Wetlands. 2. Reduce Number or Units and/or Reduce Building Square Footage: Under current City of Wilmington zoning regulations (i.e. MF -Medium High Density), 406 units could be constructed. However, instead of maxing out the number of units, which would also require 668 parking spaces, 0.86 acre of wetland impact would be necessary. Therefore, the Applicant has limited the number of units to the bare minimum, which has been determined to be 296 units. Reducing the number of units, and subsequently the number of parking spaces, in turn reduced wetland impacts by 0.684 -acre. 3. Increase Building Heights: The Applicant increased the height of two (2) buildings, which removed the need for one (1) building to reach the target goal of 287 units. With this, 0.020 acre of wetland impact was avoided. 4. Strategic Development Plan Through careful tree thinning, prior to land disturbance and throughout the design process, the Applicant will be able to preserve larger trees, which will remain after construction is complete. An expanse of large trees and shrubs will create a buffer between the undisturbed wetlands and the built upon area, which will provide habit for birds and small animals, that will utilize this area for foraging and nesting. To ensure that additional impacts do not take place during the development process, the Applicant will be required to adhere to an approved construction sequence, that includes the implementation and maintenance of sediment and erosion control (S&EC) and stormwater measures. Monitoring of S&EC controls is performed weekly or within twenty-four hours of a rain event that produces one-half inch of rainfall within a twenty -four-hour period. Notification of a discharge of sediment into wetlands is required to be submitted to the Division of Water Quality and Division of Land Resources, within 24 hours of the discharge date. State regulatory compliance agencies randomly inspect sites throughout the duration of the project. In addition, stormwater management facilities are also often landscaped with grasses, shrubs, and/or wetland plants that will provide habitat and food resources to a variety of wildlife species. Thus, erosion and sediment controls will reduce the potential for additional impacts to take place, and the stormwater management pond will serve to restore the overall natural and beneficial functions and values of the pre -development on-site wetlands. In summary, by thoroughly evaluating avoidance and minimization options, the Applicant has reduced permanent impacts by 0.75 -acre. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Prior to land disturbing activities taking place, sediment and erosion control measures, such as sediment basins, silt fence and temporary diversion ditches will be installed to ensure neither sediment nor turbid water leaves the site during construction. The site will be regularly monitored to ensure the S&EC measures are being maintained and that they are operating as intended. Orange construction fencing will be used to denote limits of disturbance within wetlands, where possible. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Wetlands located within the Coastal Plain of North Carolina provide habitat for a variety of biologically unique flora and fauna, including wetland -specific micro invertebrates. The list generated by the Natural Heritage Program (see Appendix G), indicates four (4) threatened or endangered species may occur within 1 mile of the project area. The species listed were birds, fish and mammals. This site is mostly wooded but is surrounded by development. There are no streams located within the property limits. Wildlife found on the site would likely consist of deer, raccoons, opossums, squirrels, numerous birds and other typical wildlife found within a highly developed area of New Hanover County. Based upon the fact that the project site is located in a highly developed area, that two (2) of the listed species are aquatic species, the response received from the US Fish and Wildlife Service (FWS) (see Appendix G), which indicated there is little concern for the Northern Long-eared Bat on this property, and a visual inspection of the property that did not reveal critical habitat or evidence of the existence of the two (2) bird species or any evidence of threatened, endangered or at -risk flora or fauna, it was determined that the listed species and/or flora and fauna are not likely to exist on the subject property. Therefore, the proposed wetland impacts will not have an effect on endangered or threatened species. 6. Essential Fish Habitat (Corps Requirement) 6a.
