Dear Ms. Manuelle:
In follow up to our phone conversation on September 15, 2006 and your subsequent site
inspection on September 20, 2006, the purpose of this letter is to confirm your verbal
approval of the request for a one-year extension to the above permit Special Conditions,
paragraph m), in regards to the stream and buffer mitigation portion of the mitigation
plan for Ford's Colony Rocky Mount, adjacent to golf hole number 6. It is our intention
to commence construction on this portion of the work in the fall of the year 2007, with
planting planned for the November 2007 through March 2008 timeframe. I will attach
your approval letter to my letter to the Division of Water Quality regarding DWQ
20041801 Conditions of Certification paragraph 6.b.
As you know, plans and specifications for the subject work have been prepared by W. K.
Dickson. We have proposals from EBX and were in the process of obtaining additional
bids to commence work. However, the construction of the adjacent golf course is
sufficiently behind schedule to cause significant concern about potential damage that may
be caused to the golf course. Even without specific damage from work, there would be
an unacceptable risk of silt transport from golf hole number 6 onto the mitigation work
area if the subject work proceeded this year. The period of inclement weather breaks in
golf course construction, especially during the months of June through August 2006, is
the primary cause for delay. The Bermuda grass sprigs are not mature. The cooler nights
of this season will result in less than optimum coverage and ground stabilization until
July or August 2007.

Thank you for your prompt response and inspection of Ford's Colony Rocky Mount. I
appreciate the advice you shared with our development team. Chuck Thompson is
working on the short list of inspection items. I am pleased that your inspection was
satisfactory overall.
As we discussed, I pulled the construction plans from the bid process for this year.
