We are pleased to submit the following project to you for North Carolina Division of Water Resources (DWR) approval to impact 500 SF of Neuse River Riparian Buffers (NRB). Existing Conditions- The project consists of an existing medium density residential subdivision development including roads, swim club, water and stormwater infrastructure. There is an unnamed tributary to Dunn Creek and adjacent riparian buffers on the west side of this project area. Riparian Buffers Impacts- We are requesting authorization to install a stormwater discharge channel from the proposed sand filter through the riparian buffer zones. This rip -rapped swale will be :510 - feet wide and discharge to the stream bank. The proposed NRB impacts include 300 and 200 SF of Zone 1 and 2, respectively. The USFWS lists three federally -protected species known to occur in Wake County: red -cockaded woodpecker (RCW), Michaux' s sumac (MS), and dwarf wedgemussel (DWM). The North Carolina Natural Heritage Program ( NCNHP) element occurrence database records (updated April 2017) did not identify any federally listed species occurrences within the study area or within 1 -mile of the project limits. Suitable habitat is not present within the study area for RCW's due to the lack of open, mature pine stands. Potentially suitable habitat is present for MS along maintained easements, yards, and rights-of-way. KE biologists conducted pedestrian surveys for MS on April 19, 2018 and no individuals were identified. Potentially suitable habitat for DWM is present within the study area in Dunn Creek; however, the nearest occurrence was observed over 50 years ago and 23 river miles downstream. Based on NCNHP records, lack of suitable habitat, and pedestrian surveys conducted by KE staff, it has been determined the proposed project will have " no effect" on Michaux's sumac, red -cockaded woodpecker, or dwarf wedgemussel. 6.
